HomeMy WebLinkAbout10-18-94 Public Hearing and Regular Meeting La Porte Wrecker CommitteeMINUTES PUBLIC HEARING AND REGULAR MEETING LA PORTE WRECKER COMMITTEE OCTOBER 18, 1994 Wrecker Committee Members Present: Planning Director Chuck Harrington, Police Lieutenant Aaron Corrales, City Secretary Sue Lenes and Assistant City Attorney John Armstrong Others Present: Jan Bosone, Bosone Body Shop, Keith Mainor, La Porte Towing and Bob Phillips, DBA Phillips Towing & Recovery representing Les Marks Chevrolet 1. The meeting was called to order by Chairperson of the Wrecker Committee Chuck Harrington at 2:03 P.M. 2. Chairperson Chuck Harrington opened Public Hearing A - Request of Jan Bosone, DBA Bosone Body Shop, for an auto wrecker emergency permit. Mr. Harrington reviewed the request. He asked Mrs. Bosone if she would like to speak regarding her request. Mrs. Bosone brought to the attention of the committee the background information regarding her company and the reasons for her request. The committee held a question and answer session with Mrs. Bosone regarding her request. Mr. Harrington asked for public input. Mr. Mainor and Mr. Phillips asked several question of the wrecker committee. Mr. Mainor brought to the committee's attention facts regarding the amount of calls within the past year. He reported the number of calls for emergency wrecker service have decreased in the past couple of years. Mr. Harrington closed public hearing A at 2:22 P.M. 3. Chuck Harrington opened Public Hearing B - Request of Keith Mainor, DBA La Porte Towing and Recovery, for an auto wrecker emergency permit. Mr. Harrington asked Mr. Mainor if he would like to speak regarding his request. Mr. Mainor brought to the committee's attention the background information regarding his request. Mr. Mainor explained he is requesting consideration for a future permit in the event Joe Camp Ford does not renew his present permit in December of this year. Mr. Harrington explained, "We would be unable to act on a future permit as this application is a request for an additional permit to be added to the seven presently held. If Mr. Camp does not reapply for a permit both companies applying today have the option to submit an application for a permit to fill the vacancy. There is no assurance that the committee will find a need for the same number of permits as La Porte has issued to date. It will become a wrecker committee decision at that time to review a need for the same number of permits." Mr. Harrington asked Mr. Manior if he would like to continue with this hearing for a new permit or would he like to withdraw his request. Mr. Manior withdrew his request for a permit. Mr. Harrington asked for public input. There were Minutes Wrecker Committee October 18, 1994, Page 2 no requests to speak. Mr. Harrington Closed Public Hearing B at 2:30 P.M. 4. Mr. Harrington asked for a motion from the committee to either approve or deny the request of Mrs. Bosone. Motion was made by Lt. Aaron Corrales to deny the request for an auto wrecker emergency permit. Second by Sue Lenes. Mr. Harrington stated, "Over the years we have been operating close to 1,300 to 1,400 accidents with the seven permits we presently have issued. At this point in time we are down almost 1/3 of that number and I do not see the necessity of adding an eighth permit. I concur with the motion." All were in favor of the motion to deny the request. Mr. Harrington explained to Mrs. Bosone she may reapply for a permit in January in the event one of the seven now holding a permits does not renew by December 31, 1994. 5. Assistant City Attorney John Armstrong reported information regarding the deregulation of trucking which has been proposed by the Clinton administration. This will take affect January 1, 1995. He stated, "This will affect the way we do business in the City of La Porte. We will be looking at revising the present ordinance." John Armstrong asked if there could be a consideration to have a member of the wrecker association appointed to this wrecker committee? Mr. Harrington asked Mr. Manior and Mr. Phillips if the Wrecker Association still existed? Mr. Manior reported there are only four companies who hold permits at this time. Mr. Manior indicated there is no association at this time but they are looking at the possibility of having a representative in the near future. Assistant City Attorney John Armstrong recommended an ordinance change to eliminate the need for a fourth member on the wrecker committee. 6. There being no further business to come before the committee, the meeting was adjourned at 2:41 P.M.
