CALL TO ORDER The meeting was called to order by Director of Planning Guy Rankin at 3:08 P.M. Member of Wrecker Committee Present: Director of Planning Guy Rankin, City Secretary Sue Lenes, Police Chief Bobby Powell, Police Lt. Aaron Corrales, Assistant City Attorney John Armstrong. pkr31�s Others Present: Mike Gordon, representing Les Marks Chevrolet -Mazda and Tim DeWalt. 2. APPROVE MINUTES OF PUBLIC HEARING AND SPECIAL CALLED REGULAR MEETING OF THE LA PORTE WRECKER COMMITTEE APRIL 1, 1996 Motion was made by Lt. Aaron Corrales to approve the minutes of April 1. 1996, as written. Second by Guy Rankin. The motion carried, 3 ayes and 0 nays. Ayes: Police Lt. Aaron Corrales, City Secretary Sue Lenes, and Director of Planning Guy Rankin Nays: None 3. PUBLIC HEARINGS: (CONTINUATION PUBLIC HEARING OF APRIL 1ST) REQUEST OF LES MARKS MAZDA, FOR AN AUTO WRECKER EMERGENCY PERMIT OPEN PUBLIC HEARING REVIEW BY STAFF OF REQUEST PUBLIC INPUT RECOMMENDATION OF LA PORTE WRECKER COMMITTEE ADJOURN PUBLIC HEARING Planning Director Guy Rankin called the public hearing to order at 3:10 P.M. Mike Gordon, representing Les Marks Chevrolet, addressed the Committee. Mr. Gordon noted that Les Marks Mazda had made application for an E-Tag. Mr. Gordon requested the application be withdrawn. Mr. Gordon requested that the committee consider a transfer of his present E-Tag to Tim DeWalt Towing under the name of Les Marks Chevrolet/Mazda. Minutes of Public Hearing and Regular Meeting La Porte Wrecker Committee May 1, 1996, Page 2 Assistant City Attorney John Armstrong asked Mr. Gordon if his intent was to only withdraw the application for Les Marks Mazda or to also apply for a transfer to DeWalt Towing for Les Marks Chevrolet. Mr. Gordon indicated he would request a transfer to DeWalt Towing as quickly as possible. Mr. Armstrong informed the Committee that the transfer could not be addressed at this meeting, however, a regular meeting, which requires 72 hours advance notice, could be held. An affidavit would need to be filed on behalf of the dealership indicating discontinuance of the Auto Wrecker covered in the permit and that another wrecker will be used in its place. A $25 transfer fee will also be required. Police Chief Bobby Powell inquired about the $15 per vehicle per day storage fee that was discussed at the previous meeting. Mr. Armstrong noted that the suggested increase for storage must be made to the wrecker ordinance then submitted for Council approval. Information has been gathered and a proposal reflecting the changes to the ordinance are forthcoming. Chief Powell inquired about cross rotating wreckers and indicated the Police Department did not - have a problem with this idea. Mr. Armstrong confirmed that this action could be done .vithout a change to the ordinance. Mr. Rankin asked for other public input. There being none, Mr. Rankin declared the Public Hearing closed at 3:17 P.M. The withdrawal of the application was accepted by the Committee with no action being taken. 4. CONSIDER RECOMMENDATION OR OTHER ACTION BY THE WRECKER COMMITTEE OF THE CITY OF LA PORTE There was none. 5. STAFF REPORTS Mr. Rankin recommended a regular meeting be held Wednesday, May 8, 1996, at 3:00 P.M., to hear Mr. Gordon's request for a transfer. All members concurred. Chief Powell distributed a memo prepared by Lt. Corrales showing average wrecker pulls for the years 1993 and 1995, utilizing a 7 wrecker rotation. A copy of this memo is attached and is a part of these minutes. Mr. Rankin asked Lt. Corrales if he had a recommendation regarding the number of wrecker E-Tags to be utilized. Lt Corrales recommended we continue with the six E-Tags issued at the present time. Mr. Rankin stated, "We will utilize the six tags presently held. If at any time the committee finds there is a problem, or the Police Department is not getting proper service in due time, the Wrecker Committee will hold a meeting and be ready to add the seventh E-Tag". 6. ADJOURNMENT There being no further business to come before the Committee, the meeting was duly adjourned at 3:22 P.M.
