Police Lt.- (designated representative of the Police Chief) Staff Members Present: Clark Askins, Assistant City Attorney; Sharon Harris, Assistant City Secretary; and Peggy Lee, Office Coordinator 1 CALL TO ORDER Meeting called to order by Chairman Wayne Sabo at 2:01 PM. 2. CONSIDER APPROVAL OF JUNE 28~ 2006, MINUTES. Motion by Martha Gillett to approve the Minutes of June 28, 2006. Second by Lt. Carl Crisp. The motion carried. Minutes approved as presented. 3. CONDUCT PUBLIC HEARING TO DISCUSS AN APPLICATION BY CHARLIE HINDS, CHARLIE HINDS PAINT & BODY, INC. FORAN EMERGENCY AUTO WRECKER PERMIT, IN ACCORDANCE wrm SECTION 7g-297 OF TIlE CODE OF ORDINANCES. A. OPEN PUBLIC HEARING Chairman Sabo opened the public hearing at 2:02 p.m. B. STAFF COMMENTS Assistant City Secretary, Sharon Harris, reported that on June 30, 2006, the City received an application and associated fee for an emergency auto wrecker permit from Charlie Hinds. At that time, the applicant was informed there were no emergency tags available, but Mr. Hinds chose to proceed with the application process. When questioned, Ms. Harris concurred that a correction had been made to Mr. Hinds's Certificate of Liability Insurance naming the City of La Porte as Certificate Holder. C. PUBLIC COMMENTS Charlie Hinds, of Charlie Hinds Paint & Body, 4421 Red Bluff, resident of La Porte since 1979, addressed the Committee. Mr. Hinds stated his service would be an asset to the City by providing another truck to help with needs and would allow time for better policing of all trucks. In Mr. Hinds's experience, the following applies: · In other cities, one owner can hold only one tag. There are no limits as to the number a trucks an owner can have, but he is limited to one license/tag. Wrecker Committee Minutes of August 1, 2006 Page 2 of3 · In order to eliminate monopolizing, an owner cannot own more than 10% of a secondary company 1n the wrecker business. · In other cities, license holders usually own the truck, hold the insurance and have a secondary company operate the truck. Mr. Tim DeWalt, of DeWalt's Towing, addressed the Committee. Mr. DeWalt is opposed to the -request by Mr. Hinds as he does not feel there is enough business to justify need and necessity for issuance of another permit. Mr. DeWalt noted he is under contract with the Chevrolet dealership. The dealership owns the permit and he owns the truck and is required to maintain the insurance. Mr. Hinds commented he owns two commercial acres on Sens Rd. where he could construct a lot. Charles Mainor inquired about a verbal agreement between Mr. Hinds and Bobby Slocum for Mr. Hinds to utilize Mr. Slocum's lot, which is located within city limits of LaPorte. Mr. Sabo read aloud a June 30lb letter from Mr. Slocum making his lot available to Mr. Hinds to store his towed vehicles. Mr. Hinds stated he has a verbal contract with Mr. Slocum, which would allow Mr. Hinds to tow vehicles to Mr. Slocum'~ lot. Mr. Sabo expressed concern that the City does not have provisions to issue a temporary tag and no.contract exists that would ensure permanent lot provisions. D. CLDSE PUBLIC HEARlNG Mr. Sabo closed the public hearing. 4. CONSIDER APPLICATION BY CHARLIE HINDS, CHARLIE HINDS PAINT & BODY, INC. FOR AN EMERGENCY AUTO WRECKER PERMIT. Motion by Lt. Carl Crisp to table the application by Charlie Hinds, Charlie Hinds Paint & Body, lnc.. for an emergency auto wrecker permit,. to a future uncertain date,. until the City Attorney receives, reviews and approves a lease agreement between Mr. Hinds and Mr. Slocum for the use of Mr. Slocum's storage lot, which is located within the city limits of La Porte. Second by Martha Gillett. The motion carried unanimously. 5. ADMINISTRATIVE REPORTS There were no administrative reports. 6. COMMl1TEE COMMENTS Wrecker Committee Minutes of August 1. 2006 Page 3m3 Mr. Sabo suggested the Committee review several issues at a future meeting: issuance of multiple tags to one owner; legality of need and necessity language and regulation of number of tags allowed; and the fee allowed to be collected by wrecker operators. 7.
