(designated representative of the Police Chief) Staff Members Present: Clark Askins, Assistant City Attorney; Debbie Wilmore, Chief Building Official; Tammy Noel, Community Service Inspector: Mike Kirkwood, Inspector I; and Peggy Lee, Office Coordinator 1 CALL TO ORDER Meeting called to order by Chairman Wayne Sabo at 2:02 PM. 2. CONSIDER APPROVAL OF APRIL 25,2006, MINUTES. Motion by Martha Gillett to approve the Minutes of April 25, 2006. Second by Lt. Carl Crisp. The motion carried. Minutes approved as presented. 3. REVIEW FOR COMPLIANCE, ELEMENTS OF AGREEMENT OUfLINED IN THE JANUARY 11,2006, MEETING MINUTES AND THE STATUS UPDATE AS RECORDED IN THE MARCH 15,2006, MEETING MINUTES. Motion by Lt. Crisp to review for compliance, the elements of agreement outlined in the January 11, 2006, meeting minutes and the status update as recorded in the March 15, 2006, meeting minutes. Second by Martha Gillett. The motion carried. 4. CONDUCT PUBLIC HEARlNG TO REVIEW EVIDENCE OF ALLEGED STATE LAW AND LA PORTE CITY ORDINACE VIOLATIONS BY DE WALT'S TOWING, LLC, (WRECKER PERMIT NUMBERS 475, 476, 477 AND 478) ASSOCIATED WITH THE BUSINESS LOCATED AT 400 EAST MAIN STREET, IN LA PORTE, TEXAS. A. OPEN PUBLIC HEARING Chairman Sabo opened the public hearing at 2:04 p.m. B. STAFF COMMENTS Chief Building Official, Debbie Wilmore, presented a PowerPoint presentation showing pictures of current conditions at the subject site. Mrs. Wilmore responded to questions from the Committee as follows: In the opinion of the Chief Building Official, the yard is being used to operate a salvage business, which is beyond the limits of the zoning permits issued for the wrecker business. Wrecker Committee Minutes of June 28, 2006 Page 2 of3 The sign in the right-of-way has been removed. The weed violation has been addressed and completed. The additional layer has not been added to the screening material that was being installed. Not all shipping containers have been removed from the site. No confirmation of resolution to problem of fue fighting access. Affidavits have been provided describing 11 vehicles that are necessary on-site for the operation of the business; however no documentation has been provided stating the number of vehicles that have been removed from the yard. The City has received reports of parking on the undeveloped Kansas St. right-of-way, as well as reports of vehicles blocking the E. Main St. right-of-way. Mrs. Gillett inquired about the average length of time a vehicle would be impounded. Lt. Crisp described worst case scenarios ranging from 90 days to 6 months with the typical time frame being less. C. PUBLIC COMMENTS Jimmy Crump, employee of De Walt, stated there are wrecked vehicles on site that have been there longer than a year, due to varying reasons. There is a shipping container on a trailer that is ready to be moved. Mr. Crump explained that Mr. De Walt underwent surgery earlier in the day. Mr. De Walt has been trying to get things cleaned up, but his condition has affected his work during the past month. Approximately 100 cars stacked in the rear of the yard have been removed. Mr. Crump noted that during times when the yard is full and a call comes in to pick up a chassis or trailer from locations such as the Lion King, it becomes necessary to park the big truck outside the yard. When asked by Lt. Crisp why the business continues to bring in more vehicles even though the yard is full, Mr. Crump responded that Mr. De Walt is a kind person and sometimes is just trying to help people out, occasionally at no charge. With regard to salvage activities, Mr. Crump stated that no parts are sold from the yard. Deborah Meade, of Alliance Chevrolet, addressed the Committee. Ms. Meade was of the understanding that Alliance's wrecker permit could possibly be suspended. Ms. Meade was informed that was not the case. Mr. Sabo read aloud from a faxed letter received from J. B. Williamson, attorney for Mr. De Walt, informing the City that he would be unable to attend the meeting, due to restricted activity ordered by his doctor following recent heart surgery. Also in the letter, Mr. Williamson advised that Mr. De Walt was unable to l!.ttend the meeting due to his major surgery scheduled on the morning of the meeting. Mr. De Walt has requested the Wrecker Committee Minutes of June 28, 2006 Page 3 of3 meeting be rescheduled for a later date in order for him to have an opportunity to participate. Mr. Sabo asked for guidance on how to proceed from the Assistant City Attorney, Clark Askins. Mr. Askins referred to Section 78-223 of the Code of Ordinances and noted that as long as the applicant has received proper notification, which has been done, the Committee may consider the evidence and take action. He noted there have been three public hearings on this matter. D. CLOSE PUBLIC HEARING Mr. Sabo closed the public hearing at 2:36 p.m. 5. CONSIDER POSSIDLE ACTION TO SUSPEND, CANCEL, OR REVOKE WRECKER PERMIT NUMBERS 475,476,477 AND 478, ISSUED TO DE WALT'S TOWING, LLC. During discussion, Mrs. Wilmore responded to questions from Committee Members. Motion by Lt. Carl Crisp to suspend Wrecker Permit Numbers 475, 476, 477 and 478, issued to De Walt's Towing, LLC, for a period of 45 days or until stated violations have been abated and after 45 days to meet again to review further and consider additional action. Second by Martha Gillett. The motion carried unanimously. 6. ADMINISTRATIVE REPORTS There were no administrative reports. 7. COMMITTEE COMMENTS There were no committee comments. 8.
