Minutes of June 2, 2009
Committee Members Present: Tim Tietjens, Planning Director (designated representative of the City
Manager); Martha Gillett, City Secretary; and Lt. Gary Rice (designated
representative of the Police Chief)
Staff Members Present: Clark Askins, Assistant City Attorney; Debbie Wilmore, Chief Building
Official; and Peggy Lee, Office Coordinator
1. Call to order
Meeting called to order by Chairman Tim Tietjens at 2:07 p.m.
2. Consider approval of May 5, 2009, meeting minutes.
Motion by Martha Gillett to approve the Minutes of May 5, 2009. Second by Lt. Gary Rice. The
motion carried with all in favor; Minutes approved as presented.
3. Conduct public hearing to receive input on a request by Charlie Hinds Paint & Body, Inc. for
issuance of two emergency auto wrecker permits, under Section 78-297 of the La Porte Code of
Ordinances.
A. Open public hearing
The Chairman opened the public hearing at 2:09 p.m.
B. Staff comments
Debbie Wilmore reported that Mr. Hinds has indicated he does not intend to utilize Mr.
DeWalt's yard for vehicle storage. Mr. Hinds has begun construction of his own storage
yard in La Porte, which is approximately 75% complete.
C. Public comments
Christopher Tine, Managing Partner for Reliance Ford, 621 N. Hwy. 146 S., spoke in
opposition to Mr. Hinds's request. Mr. Tine noted that Mr. Hinds's company is not
located in La Porte and granting the request would take business away from Reliance
Ford.
The applicant, Charlie Hinds, addressed the Committee. Mr. Hinds reported on the
construction status of his storage yard in La Porte. He stated that he is a resident of La
Porte, a business owner for 35 years, and continues to be involved in the community.

D. Close public hearing
The Chairman closed the public hearing at 2:15 p.m.
4. Consider action to grant or deny two emergency auto wrecker permits to Charlie Hinds Paint &
Body, Inc., under Section 78-297 of the La Porte Code of Ordinances.
Martha Gillett directed a question to the City Attorney about the number of permits the city is
allowed to issue. Clark Askins responded the City can legally increase the number of auto
wrecker permits issued as there is a limitation on the City's authority to limit the number of
wrecker permits issued.
Motion by Lt. Rice to grant two emergency auto wrecker permits to Charlie Hinds Paint & Body,
Inc. Second by Martha Gillett. The motion carried with all in favor

The Chairman opened the public hearing at 2:20 p.m.
B. Staff comments
Debbie Wilmore reported she met with the Body Shop Manager for Reliance Ford to
discuss the current impound yard and how it would need to be expanded if new permits
were issued. The manager confirmed that Reliance Ford has enough land and funds to
expand the yard.
C. Public comments
There were no comments from the public.
D. Close public hearing
The Chairman closed the public hearing at 2:22 p.m.
6. Consider action to grant or deny emergency auto wrecker permits to Reliance Ford, under
Section 78-297 of the La Porte Code of Ordinances.
Lt. Rice recalled a problem from the past when Reliance Ford had a large failure to respond
rate. Mr. Tine stated the problem was with one of their contractual wreckers prior to them
having their own wrecker. Mr. Tine confirmed the problem had been corrected.

Tim Tietjens asked Mr. Tine about the undefined vehicle on his application. Mr. Tine confirmed
Reliance Ford will own the vehicle.
Motion by Tim Tietjens to grant an emergency auto wrecker permit to Reliance Ford for a 2000
Chevrolet 3500 HD vehicle and additionally to grant conditional approval of an emergency auto
wrecker permit to Reliance Ford for a yet to be determined vehicle, with said permit effective at
a point in time when all required documentation has been received and determined to be
acceptable. Second by Martha Gillett. The motion carried with all in favor.

There were no administrative reports.
8. Committee Comments
A. Matters appearing on agenda
Lt. Rice asked Mr. Tine about the wrecker vehicle listed on his application. Mr. Tine
confirmed Reliance Ford has contracted with Fast Eddies, who owns the vehicle and will
base it at the home residence listed on the application.
Mr. Tietjens commented that the Committee's approval in no way impacts any deed
restrictions that may be violated by having a commercial vehicle parked in a deed
restricted area.
B. Inquiry of staff regarding specific factual information or existing policy.
There were no inquiries of staff.
9. Adjourn
The Chairman adjourned the meeting at 2:30 p.m.
