Gary Rice (designated representative of the Police Chief) Staff Members Present: Clark Askins, Assistant City Attorney; Debbie Wilmore, Deputy Building Official; and Peggy Lee, Office Coordinator 1. Call to order. Meeting called to order by Chairman Tim Tietjens at 2:00 p.m. 2. Roll call of members. All members were present. 3. Consider approval of July 7,2009, meeting minutes. Motion by Lt. Gary Rice to approve the Minutes of July 7, 2009. Second by Martha Gillett. The motion carried with all in favor; Minutes approved as presented. 4. Conduct public hearing to receive input on a request by RBEX, Inc. dba Apple Towing Co. for issuance of an emergency heavy duty auto wrecker permit, under section 78-297 of the La Porte Code of Ordinances. A. Open public hearing. The Chairman opened the public hearing at 2:04 p.m. B. Staff comments. Building Official, Debbie Wilmore, noted staff's concern with the applicant's arrangements to utilize DeWalt Towing's yard for storage, given past problems with overflow of stored vehicles at that location. C. Public comments. Mike Scully, President of Apple Towing (RBEX, Inc.) addressed the Committee. Mr. Scully informed the Committee that his company is in the final stage of negotiations to purchase the De Walt Towing property. The following points were noted during discussion: Wrecker Committee Minutes of August 25,2009 Page 2 of 3 · Property sale transaction should be final within 2-3 weeks. · DeWalt Towing has the only heavy duty auto wrecker permit in La Porte; approval of Apple Towing's request would fill the void after DeWalt Towing is no longer in business. · Mr. DeWalt has begun moving out his inventory. · Current facility is large enough for the proposed operation. · Entire facility will be totally renovated. · New factory painted sheet metal privacy fencing will be installed along the perimeter of the property. · Fencing/facility will be painted white with green trim (company colors). · Overgrown shrubs will be removed. · Phase I environmental has been completed and there are no issues; a copy of this report will be provided to the City. · Electric company has been contacted to straighten up poles and lines. · Architectural plans are being prepared. · Property will be re-surveyed. · Old structure at the front of the property is being torn down. · Applicant will work with City staff to address pre-existing non-conforming site issues. · Security lighting and cameras will be installed. · Electric sliding gate will be installed. · New asphalt parking spaces will be installed. · Facility will be manned 24 hours a day. · RBEX currently operates three government seized asset storage facilities for FBI, DEA & US Marshals; a secure facility is required. · Mr. Scully will provide the City a new letter that specifies an ending date of December 31,2009, for Apple Towing to utilize DeWalt Towing's storage yard. · Company is capable of handling pick-ups/tows in all scenarios and is contracted with several crane companies. Todd Johnston, with Apple Towing, participated in the discussion. D. Close public hearing. The public hearing was closed. 5. Consider action to grant or deny an emergency heavy duty auto wrecker permit to RBEX, Inc. dba Apple Towing Co., under Section 78-297 of the La Porte Code of Ordinances. Motion by Tim Tietjens to grant an emergency heavy duty auto wrecker permit to RBEX, Inc. dba Apple Towing Co. conditioned upon the following: · Applicant shall submit by Tuesday, September 1, 2009, an amended vehicle storage permit letter that allows Apple Towing to utilize DeWalt Towing's Wrecker Committee Minutes of August 25, 2009 Page 3 of 3 storage yard for a period ending December 31, 2009. If for any reason the property closing does not occur, the permit shall become null and void. . Application shall be amended to show the correct address as 400 E. Main. · Meet all ordinance required site plan criteria, including all improvements noted during the hearing. · Install new factory painted sheet metal privacy fencing along perimeter of property or where setbacks allow. · Install landscaping in accordance with an approved landscaping plan. · Coordinate with utility company to correct leaning poles/lines. · Submit Phase I Environmental report. · Install full cut-off lighting. · Install new asphalt parking spaces.
