The meeting was called to order by Chairman Grant at 7:00 P.M. Members Present: Sidney Grant, Bill Thompson, Andy Wilson, John Albanese, Linda Mains Others Present: Donald Johnson of U.S. Homes 2. The Board considered the minutes of the November 17, 1981, meeting. A motion was made by Grant to approve and adopt the minutes as submitted. Second by Albanese. The motion carried, 5 ayes and 0 nays. Ayes: Nays: Grant, Thompson, Wilson, Albanese and Mains None 3. The Board considered a request for variance by Donald Johnson to the 25 foot front set back building line at 5009 Glen Valley. After some discussion by the Board, a motion was made by Wilson to grant the variance to permit a 20.5 front set back line at 5009 Glen Valley in the Glen Meadows Subdivision. Second by Thompson. The motion carried, 5 ayes and 0 nays. Ayes: Nays: Grant, Thompson, Wilson, Albanese, Mains None 4. Administrative Reports: The Board discussed a change of meeting night. It was a unanimous decision to change meeting night for the Board of Adjustment to 7:00 P.M. on the fourth Thursday of each month. 5. There being no further business to be brought before the Board, the meeting was duly adjourned. As duly appointed representative of the Architectural Control Committee for Glen Headows, Section Two, I make no objection to such encroachment. By not objecting, the Committee specifically disclaims any responsibility to defend u. S. Home Corporation in the event litigation is instituted by third parties as a result of such encroachment, such defense to be at the sole expense of u. S. Home Corporation. Hamilton, Assistant City Attorney Re: Zoning Board of Adjustment Article 1011g of the Revised Civil Statutes of Texas provides that the Board of Adjustment is to have the following powers: 1. To hear and decide appeals from a decision or deter- mination made by an administrative official. 2. To hear and decide special exceptions. 3. To authorize variances upon appeal from an action of a city official. The state statutes also impose various requirements for the ad- ministration of the Board of Adjustment as follows: 1. The Board is to consist of five members and four alternate members. The attendance of alternate members is necessary only if requested by the City Manager, to fill the place of absent meIT'bers. 2. At least four members (or alternate members) must be present before any decision can be made. 3. The chairman of the Board has the power to subpoena witnesses, where needed. 4. All meetings must be open to the public. 5. The minutes of the proceedings of the Board must indicate how each member voted on each matter. 6. All records of the Board are public records. 7. Appeals from action of a City official must be taken "within reasonable time". The Board should establish rules for this procedure and for the amount of time it considers to be rea- sonable. When someone appeals an action of a City official, the action will not be enforced until the appeal is heard, unless the City official shows that such would cause imminent peril to life or property. 9. When an appeal is requested, the Board will set a time for the hearing, give public notice and specific notice to each of the parties. A party may be represented by an at- torney if he wishes. 10. In its action on an appeal, the Board may uphold the City official's decision or reverse it or make any modifications it chooses. 11. It takes four votes to over-rule the decision of the City official, or to grant a variance or special exception. 12. If the person is still not satisfied after the decision of the Board, he must then take it to court, not to the City Council. The petition must be filed with the court within ten days after the decision of the board. Please note the following definitions: 1. Special exception - The zoning ordinance can have areas which allow for specific named exceptions from the ordinance where approval is obtained. The applicant does not have to show hardship. 2. Variance - An actual change in the provisions of the zoning ordinance as it relates to a particular situation. No pro- vision was made for such a change in the ordinance. The applicant must show that: a. There are special circumstances b. Unnecessary hardship would result c. The variance is not contrary to the public interest d. The variance is within the general spirit of the ordinance.
