The meeting was called to order by Chairman Andy Wilson at 7:00 P.M. Members of the Board Present: Chairman Andy Wilson, members Ronnie Rowell, Linda Mains, Bogert Swanagan,. Charlie Young Members of the Board Absent: Sidney Grant, Lawrence Farias Members of the City Staff Present: Assistant City Attorney John Armstrong, Chief Building Official David Paulissen Others Present: Mrs. Carol Lambeth, Gordon Westergren • 2. .The minutes of the October 27, 1983, meeting were considered for approval. Several corrections were noted. Motion was made by Ronnie Rowell to approve the minutes as corrected. Second by Robert Swanagan. The motion carried, 5 ayes and 0 nays. Ayes: Rowell, Mains, Swanagan, Young and Wilson Nays: None 3. The Board considered the request of Herman's Trucking for a Special Use Permit to allow a trucking terminal in an Indus- trial zone. Mrs. Carol Lambeth, Secretary-Bookkeeper for Herman's Trucking Company, appeared before the Board. She requested a Special Use Permit be granted for Block 1141, City of La Porte, in order that they might build a trucking terminal where they will be legal in their operation. Chief Building Official David Paulissen explained that Herman's Trucking had purchased commercially zoned property on 26th St. for a truck terminal. Subsequent to the purchase, Ordinance 780ZZZ, amending the zoning ordinance, was passed, which re- quired truck terminals to operate in an Industrial zone with a Special Use Permit granted.... Ordinarily, the "Grandfather • clause" would have sufficed to allow the business to operate, • • • Minutes, Regular Meeting, La Porte Zoning Board of Adjustment November 17, 1983, Page 2 but since no permanent improvements had been made to the site when the ordinance-was amended, they were placed in the situa- tion of being in an illegal, non-conforming use, which places them in violation of the zoning ordinance. They started their office in the 900 block of First Street, and again, in running the business, have had some trucks there, which again places them in violation of the zoning ordinance. They now request that Block 1141 have a special use permit to allow the operation of their dump truck terminal and repair facility. Herman's Trucking proposes to improve the "L" Street right- of-way from 16th to Block 1141, to access this, as per other City policies. Staff recommends the Special Use Permit be granted. Motion was made by Ronnie Rowell to grant the Special Use Permit for a truck terminal and. repair facility within an Industrial zone. Second by Robert Swanagan. The motion carried, 5 ayes and 0 nays. Ayes: Rowell, Mains, Swanagan, Young and Wilson Nays: None 4. The Board considered a request from Gordon Westergren for a Special Use Permit to allow a truck terminal within an Industrial zone. Gordon Westergren appeared before the Board to request a Special Use Permit for a truck service facility and a truck terminal in Block 351, Lots 17 through 20, Town of La Porte. Chief Building Official Paulissen reported that Mr. Wester- gren has made application for a building permit. He wishes to build a facility that would service commercial vehicles basic- ally by dispatching tire repair trucks; also minor servicing commercial vehicles if they come to his site - oil changes, etc.; also tire repair. This is industrially zoned property off of North Broadway. Staff's recommendation is that the Special Use Permit be granted. Mr. Paulissen pointed out that in both cases, if the properties in question or the businesses ever change hands, the property will revert to its original classification and the special use permit will be null and void. New applications would have to be made by whoever acquired the property. Dr. Tolles requested a permit to enclose his 10' x 18' patio. This permit was denied because Dr. Tolles' home is built exactly 10 feet from the combined utility easements in the rear. As you know, our zoning ordinance requires a rear yard of 10 feet from the nearest utility easement. After examining the plat of the property, I find an 8 foot underground utility easement and a 5 foot aerial easement. If any relief is granted, Houston Lighting & Power must also release this proposal. Based on the above facts, I recommend that the denial of the permit be upheld.
