LA PORTE ZONING BOARD OF ADJUSTMENT
FEBRUARY 9, 1984
1. The meeting was called to order by Chairman Andy Wilson at
7:00 P.M.
Members present: Chairman Wilson, Members Sidney Grant,
Ronnie Rowell, Linda Mains, Lawrence Farias, Charlie Young
Members absent: Robert Swanagan
Others present: Assistant City Attorney John Armstrong,
Building inspector Mark Lewis, Dr. & Mrs. Reed Tolles
2. The Board considered approving the minutes of the November 17,
1983, meeting.
Motion was made and seconded to approve the minutes as presented.
The motion carried, 6 ayes and 0 nays.
® Ayes: Wilson, Grant, Rowell, Mains, Farias, Young
Nays: None
3. The Board considered electing a vice-chairman.
Sidney Grant resigned as secretary and Linda Mains was ap-
pointed to that position.
Motion was made by.Linda Mains, second by Charlie Young, to
elect Sidney Grant as vice-chairman. The motion carried, 5
ayes, 0 nays and 1 abstain.
Ayes: Wilson, Rowell, Mains, Farias, Young
Nays: None
Abstain: Grant
4. The Board considered the request of Dr. Reed Tolles for a
variance to enclose a patio.
Building inspector Mark Lewis reviewed the request and ex-
plained that the building permit had.been denied because
Dr. Tolles' home is built exactly 10 feet from the utility
easements in the rear and the zoning ordinance requires a
rear yard of 10 feet from the nearest utility easement. There
exists an 8 foot underground utility easement and a 5 foot
• aerial easement.

After questions to Mr. Lewis and to Dr. Tolles, motion was
made by Sidney Grant to grant the request for the variance.
The motion died for lack of a second.
Linda Mains moved to deny the request for a variance. Second
by Charlie Young. The motion carried, 4 ayes and 1 nay.
Ayes: Rowell, Mains, Farias, Young
Nays: Grant
The Tolles were informed that if they wish to appeal the
decision of the Board, they could do so through County Court.
5. There being no further business to be brought before the
Board, the meeting was duly adjourned at 7:43 P.M.

I have received a request from Mr. Richard Hooper for
the granting of a special exception to the rear yard setback.
The property is described as section 2 lot 6 tract 14 of the
W. B. Root subdivision. This is better known as Spenwick.
There is no way to place a home on this piece of property and
meet the rear yard requirement. I have attached a copy of
both the plot plan and the legal description for your review.
The exception would allow the structure to be placed
within six feet of the rear property line on the west side of
the tract and fourteen feet on the east side. This request
is well within the parameters of the special exception
section of the zoning ordinance. It is the recommendation of
this department that this exception be granted.

GENTLEMEN:
THE PURPOSE OF THIS LETTER IS TO REQUEST APPROVAL TO
BUILD RESIDENTIAL STRUCTURES ON SECTIONS 2 AND 3 OF LOT 6 TRACT
14 OF THE U.B. ROOT SUBDIVISION BETTER KNOWN AS SPENWICK
SUBDIVISION RECENTLY ANNEXED BY THE CITY. THIS IS AN IRREGULAR
SHAPED PIECE OF PROPERTY THAT WILL NOT PERMIT COMPLIANCE WITH
THE NORMAL MINIMUM REQUIRED SETBACK AS SET FORTH IN THE CXTY'S
ORDINANCES CONCERNING RESIDENTIALLY Z014ED REAL ESTATE.
CITY ORDINANCES INDICATE A MINIMUM SETBACK ON THE FRONT OF
THE STRUCTURE TO BE 25 FEET FROM THE STREET AND 18 FEET FROM THE
BACH OF THE PROPERTY. I AM REQUESTING A VARIANCE FROM THIS IN

acres) tract being more particularly described by metes and bounds as follows

BEGINNING at a 5/8" iron rod found on the west line of Spencer Highway Estates
Section 1, as recorded in Volume 38, Page 57 of the Map Records of Harris

Re: Special Exception Pulte Homes Corp. Block 4, Lot 13,
Meadow Park
I have received a request from Pulte Homes Corp. for a
front and rear yard setback special exception. The lot is
described as Lot 13, Block 4 of Meadow Park subdivision.
Included is a plot plan that indicates the nature of the two
setback exceptions. The plan that is shown is the smallest
of their plans. The structure will encroach 3 feet into both
the front and rear yards. The front yard encroachment will
be a right triangle 'of about 10' X 3'. The rear yard
encroachment will be about 7' X 3'. I have asked Pulte Homes
to examine all of the other lots within this subdivision to
insure that no other exceptions will be required. They have
responded that this will be the last exception needed.
This is somewhat of a self imposed hardship. This
request does however seem to be within the parameters of a
special exception. The only alternative to granting this
exception is to leave this lot vacant. Since Pulte Homes has
assured us in writing that this is the last such request, I
would recommend that this exception be granted.

I am requesting that a variance be granted on Lot 13,
Block 4 of Meadow Park, Section 1. Option "A" appears
to be the most favorable of the three options we have
presented. The 526 Plan I would like to put on this
lot is the smallest house, with respect to slab area,
that I have in the subdivision. The granting of the
variance will allow me to utilize this lot.

To Whom it May Concern:
It is my desire to construct a split rail wooden fence
in the front yard of my home locaed aL she above address.
T.Uis property is a 60' X 1251 tract of land containing ai,r
of Lot Six (6), the Northwesterly 20' of Let Seven (7),
and the Southeasterly 15' of Let rive (5), in Block Two
Hundred Fifty One (251), Tovm of La Porto, Harris County,
Texas, according to the map as recorded in Volume 60,
Pages 112 and 113 of the Harris County Dead Records.
Due to the constant flow of juvenile traffic, both on feet
and on bicycle, vandalism problems, and large dogs destroying
private property, I would like the board to gra
variaxce to Zoning Regulation 13-205 paragraph 73)sand
allow construction of this fence. If built the foxes will
meet the requirements of Section 14-202 paragraph (3)
and there will be a permanent opening across the
driveway with no gate.
Since there are several front yard fences in do
immediate neighborhood, I believe a foxes properly
built and maintaim^e vill not bo dotrimeental to local
nronerty values.
