OF THE
REGULAR MEETING OF THE LA PORTE ZONING BOARD OF ADJUSTMENT
MAY 24, 1984
1. The meeting of the La Porte Zoning Board of Adjustment was
called to order by Chairman Andy Wilson at 7:00 P.M.
Members Present: Chairman Andy Wilson, Members Sidney Grant,
Ronnie Rowell, Robert Swanagan, Charlie Young
Members Absent: Linda Mains, Lawrence Farias
City Staff Present: Chief Building Official David Paulissen,
Assistant City Attorney John Armstrong
Others Present: Eddie Gray, Gray Enterprises; Bill Netherton
and Frank Redfield, Miller Transporters, Inc.; Bill McNutt,
Waste Control Management
C 2. The Board considered approving the minutes of the meeting
held March 29, 1984.
Motion was made, seconded, and duly passed to approve the
minutes of the March 29 meeting as presented.
3. The Board considered approving the minutes of the meeting
held April 19, 1984.
Motion was made, seconded and duly passed to approve the
minutes of the April 19 meeting as presented.
4. The Board considered the request of Eddie Gray for a special
use permit for a truck terminal facility.
Chief Building Official David Paulissen reviewed his memo to
the Board which answered questions the Board had asked at the
meeting of April 19 (copy of memo attached to these minutes).
Mr. Paulissen stated that staff's opinion is that the majority
of the specifications for a special use permit have been met,
and that staff recommendation, based on these facts, is that
the special use permit be granted. A memo from the Engineering
Department was reviewed and the fact noted that the City might
not close the street involver.
Detailed discussion regarding drainage, street closing, pro-
posed facility plans, chemicals involved, truck routes, road
paving, etc., was held.

Mr. Eddie Gray spoke to the Board regarding the request,
what Miller Transporters plan for the property and sewer
and water lines to the property.
Bill McNutt answered questions from the Board regarding
what products would be in the trucks they would be handling
at the facility, and explained federal rules, regulations
and requirements they must follow.
Extensive questions from the Board were answered by repre-
sentatives from Miller Transporters.
Motion was made by Grant to approve the request for a special
use permit for a truck terminal facility. The motion died
for lack of a second.
Robert Swanagan requested that the Chief Building Official,
the Director of Community Development and his staff sit down
and discuss the issue. Mr. Paulissen reiterated that although
there is no formal written policy, he does have the ordinances
C ~s guidelines, and according to those, his recommendation would
be that the permit be granted.
Chairman Wilson commented that the area being dealt with is
zoned Industrial, and the facility would be a good companion
use; the ordinances on the books dealing with wastewater and
the chemical situation would give some control; and he feels
the facility would be making proper use of the land since it
is located in the industrial zone.
b?otion was made by Charlie Young to deny the special use permit
for a truck terminal facility. Second by Ronnie Rowell. The
motion to deny carried, 3 ayes and 2 nays.

Nays: Grant, Wilson
5. There being no further business to come before the Board, the
meeting was duly adjourned.

SUBJECT: APPEAL OF DECISION OF INSPECTOR, JACK RODRIGUEZ, OWNER
DATE: 8/20/84
This request should have been properly labeled as an appeal of the
decision of the building inspector. It was removed from the agenda of
July 26, 1984 because no permit application had been filed. Mr.
Rodriguez had asked me verbally if a permit could be issued for this
construction. My reply was no as this request was in violation of the
zoning ordinance. After the last meeting Mr. Rodriguez was contacted
by this office and was requested to submit a building permit.
Application was done this date and the permit was denied based on
section 13-201-8 of the Zoning ordinance.
This memo should be read in connection with my last memo of 6/22/84
for its history and recommendation.

SUBJECT: VARIANCE - JACK RODRIGUEZ

The Inspection Department has received a request for a variance from
Mr. Jack M. Rodriguez. Mr. Rodriguez owns a piece of property at 518
S. Third. At the time of purchase, there was a house and a garage on
the site. The garage contained a small bath and kichenette but was
not us~ as a living unit. Note that the garage doors were in place at
the time of purchase.
The request is not proper as it asks for approval of remodeling. The
Board of Adjustment does not approve building permits and can only
deal with an appeal from a decision of the Building Official. The
request should properly ask for the placement of a secondary dwelling
unit for rental purposes in an R-1 zone.
Before this sort of request can be effected the question off' lo-t---s-~,~e
must also be addressed. The current ordinance requires'6000 sq. ft:~~
of lot area for a dwelling unit in an R-1 zone. Also r_gs~.t "-~~-s °t05fl'

The "continued use of this secondary dwelling unit" is not a proper
request as the building in question was clearly used as a garage until
converted by Mr. Rodriguez. Note that all of the problems and
questions now before us could have been easily avoided by making a
building permit application prior to construction.
This request is in clear conflict with the intent and letter of the
zoning ordinance and denial of the request is hereby recommended.

Dear Board Member(s)
I have been advised to request a meeting of the Board of Adjustments
to review my request for approval to continue the remodeling of an
exsiting secondary dewelling at 518 South 3rd Laporte, and the use
of this dewelling as a rental unit.
The exciting bathroom and kitchen facilities within this structure
have been in place since the early 60's and are within regulations of
building codes and FHA requirments. No new or additional plumbing
facilities or electrical service will be constructed or converted
on this structure during remodeling, so no electrical or plumbing
permits are requested in this letter.
Since my recent purchase of this property I have been in the process
of remodeling and restroration, to upgrade the appearance and aesthetics
of the property. I can assure you that my deepest concern lie with
the upkeep and proper maintenance of this property to it's highest
level at all times.
I would like to request your consideration for the continued use of
this secondary dewelling at 518 South 3rd as a rental unit.

SUBJECT: APPEAL OF DECISION OF BUILDING INSPECTOR, CARPORT LA FITTE
DATE: 8/20/84
The City has received a Building permit application from Mr. James
La Fitte to build a carport within the required front setback of his
residence at 107 South Lobit. This permit was denied due to the
proposed 20 foot encroachment into the front yard. A copy of the
permit application is enclosed for your review.
Mr. La Fitte has filed a subsequent letter requesting a "variance" to
allow the placement of this carport. Sections 10-601 & 10-602 of the
zoning ordinance do not include a carport as a permitted obstruction
in a require yard.
Based on the zoning ordinance and its requirements staff must
recommend the denial of this request.

This is a request for a varience to be granted that will
allow construction of a 20'x20' carport at 107 South Lobit.
The carport will be constructed of aluminum and the end of
it will be less than 25' from the property line.
