LA PORTE ZONING BOARD OF ADJUSTMENT
AUGUST 23, 1984
1. The meeting was called to order by Chairman Andy Wilson at
7:00 P.M.
Members Present: Chairman Andy Wilson, Members Linda Mains,
Lawrence Farias, Charlie Young
Members Absen~: Sidney Grant, Ronnie Rowell, Robert Swanagan
Others Present: John Armstrong, David Paulissen, James
LaFitte, Jack Rodriguez
2. The minutes of the Board of Adjustment meeting held May 24,
1984, were approved as presented.
3. The Board considered the request of James LaFitte to appeal
the decision of the Building Inspector regarding sections
10-601 and 10-602 of the Zoning Ordinance.
David Paulissen, Chief Building Official, explained that Mr.
LaFitte had applied for a building permit for a carport. The
Zoning Ordinance requires a 25 foot front setback; Mr.
LaFitte's proposed carport would require a 20 foot
encroachment. Based on the Zoning Ordinance, a carport is not
a permitted obstruction in a required yard.
After questions from the Board were answered by Mr. Paulissen
and Mr. LaFitte, motion was made by Linda Mains to deny the
appeal pf Mr. LaFitte. Second by Charlie Young. The motion
to deny the appeal carried, 3 ayes and 1 nay.

4. The Board considered the request of Jack Rodriguez to appeal
the decision of the Building Inspector regarding section
13-201-8 of the Zoning Ordinance.

David Paulissen explained that Mr. Rodriguez had begun
converting a two-car garage that had a kitchenette and
bathroom facilities from a previous owner. It was being used
as a garage when Mr. Rodriguez purchased the property. A
permit had not been obtained by Mr. Rodriguez for the work he
was doing, so the job had to be stopped.
The Zoning Ordinance provides for a secondary dwelling unit on
site in a residential zone if it is your homestead and if the
living quarters are for bona fide servants, family, guests,
etc., and specifically states it is not to be used for rental
purposes.
Mr. Paulissen understood that Mr. Rodriguez had bought the
property for the purpose of renting and had intended that the
garage be converted into a secondary dwelling unit and rented,
also.
Mr. Rodriguez hadd verbally inquired if a buillding permit
could be issued for this, and Mr. Paulissen had verbally told
him it could not. Subsequent to that, Mr. Rodriguez did apply
for a building permit and it was denied, as it did not meet
the requirements of the ordinance.
Mr. Rodriguez spoke to the Board and passed out photographs of
the subject property showing the existing kitchenette and
bathroom facilities that had electrical and plumbing already
in place when he purchased the property. Mr. Rodriguez stated
he is requesting a permit to complete the remodeling of the
secondary dwelling and if granted the permit, the secondary
dwelling would be in a condition that would enhance the area.
He stated that he had intended to rent both structures in
order to meet the note each month.
After questions from the Board, motion was made by Charli~
Young to deny the request of Jack Rodriguez to appeal the
decision of the Building Inspector regarding section 1~-201-8
of the Zoning Ordinance. Second by Lawrence Farias. The
motion to deny the appeal carried, 3 ayes and 1 nay.

Mr. Rodriguez was informed that if he wishes to appeal the
decision of the Zoning Board of Adjustment, he may do so
through County Court.
5. There being no further business to come before the Board, the
meeting was duly adjourned.
