1. The meeting was called to order by Acting Chairman Sidney Grant at
7:00 P.M.

2. The Oath of Office was given to Vivian Covington by Assistant City
Attorney John Armstrong.
3. The Board considered electing a Chairman of the Board of Adjustment.
Motion wa~ made by Linda Mains that Sidney Grant be elected ~
Chairman. Second by Ronnie Rowell. The motion carried, 4 ayes and
o nays.
Ayes: Grant, Rowell, Mains, Covington
Nays: Non e
Ronnie Rowell was appointed as Vice-Chairman.
4. The Board considered approving the minutes of the Board of
Adjustment meeting held August 23, 1984.
Motioo was made by Linda Mains that the minutes of the August 23
meeting be approved as presented. Second by Ronnie Rowell. The
motion carried, 4 ayes and 0 nays.

5. The Board considered the request of James N. Wallace for a special
use permit to allow a yard for storage and repair of trucks and
waste containers at Browning-Ferris, Inc.
After discussion and questions from the Board to Mr. Wallace had
been addressed by Mr. Wallace and the Chief Building Official,
motion was ~ad~Qy Ronnie Rowell to grant the special use permit to
arowning-Ferris~allQ~ygrd for storage and repair of clean and
decontaminated trucks and waste conigin~. Second by Vivian
Covington. The motion carried, 4 ayes and 0 nays.
Ayes: Grant, Rowell, Mains and Covington
Nays: None
6. There being no further business to corne before the Board, the
meeting was adjourned at 7:47 P.M.

Gentlemen:
With reference to the above location, a "Special Use Permit" is
required by City Code. I am, therefore, applying for such per-
mit for myself and on behalf of Browning-Ferris, Inc.
The purpose of this permit is to allow a truck terminal, i.e.
B.F.I. to expand their present yard and facility. B.F.I. operates
a solid waste vehicle yard for storage and repair of trucks and
waste containers. This property will also be used for employee
parking. Proposed improvements include fencing and paving the
property.
As requested, a survey of Block 643 is attached. We respectfully
request that all of the foregoing current operations be allowed
on this tract of land.

At the City Council meeting of October 3, 1984, Council
passed Ordinance No. 780-DDDD, changing the classification of
Block 643, Lots 1-32, from Commercial to Industrial. This was
done to allow Browning-Ferris, Inc., to expand their facilities.
A letter from Mr. James Wallace is attached which will
explain what expansion they propose. A Special Use Permit will be
needed in order that they may do this.
All information pertinent to this request is enclosed in this
agenda packet.

Dear Mr. Wallace:
On October 17 I sent you a certified copy of Ordinance 780-DDDD,
which rezoned the above referenced property from Commercial to
Industrial. As you are aware, even though the property has been
rezoned, you must still obtain a "Special Use Permit" in order to
use the facilities as a truck terminal.
I have scheduled a meeting of the La Porte Zoning Board of
Adjustment for Thursday, October 25, at 7:00 P.M., at which time
you may present your request for the "Special Use Permit." I will
send you a copy of the agenda for the meeting early next week.

AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE
ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN
PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council of the City of La Porte
hereby finds, determines and declares that heretofore, to-wit:
on the 13th day of August, 1984, at 7:00 P.M., a public hearing
was held before the Planning and Zoning Commission of the City
of La Porte, Texas, pursuant to due notice, to consider the
question of the possible re-classification of the zoning classi-
fication of the hereinafter described parcel of land.
There
is attached to this Ordinance as "Exhibit A," and incorporated
by reference herein and made a part hereof for all purposes, a
copy of "Notice of Public Hearing" which the City Council of
the City of La Porte hereby finds was properly mailed to the
owners of all properties located within two hundred feet
(200') of the properties under consideration.
Section 2. The Publisher's Affidavit of Publication of
notice of said hearing is attached hereto as "Exhibit B,"
incorporated by reference herein and made a part hereof for
all purposes.
Section 3. Subsequent to such public hearing, the City
of La Porte Planning and Zoning Commission met in special
session on August 13, 1984, to consider the changes in classir-
ication which were the subject of such public hearing. The
City Council of the City of La Porte is in receipt of the
wri tten recommendations of the City of La Porte Planning and
Zoning Commission, by letter dated August 17, 1984, the original
of which letter is attached hereto as "Exhibit C," incorporated
by reference herein, and made a part hereof for all purposes.

Section 4. On the 3rd day of October, 1984, at 7:00
P.M., a public hearing was held before the City Council of the
City of La Porte, pursuant to due notice, to consider the

of the City of La Porte hereby accepts the recommendation of
the City of La Porte Planning and Zoning Commission, and the
zoning classification of the hereinafter described parcel of
land, situated within the corporate limits of the City of
La Porte, is hereby changed in accordance therewith, and the
zoning classification of said parcel of land shall hereafter be
"Industrial." The description of said parcel of land re-zoned
is as follows, to-wit:
Lots One (1) through Thirty-Two (32), both
inclusive, in Block Six Hundred Forty-Three
(643), in the City of La Porte, Harris
County, Texas.

Sect ion 7. The City Council off ic ially finds, determines,
recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City Council
was posted at a place convenient to the public at the City Hall
of the City for the time required by law preceding this meeting,
as required by the Open Meetings Law, Article 6252-17, Texas
Revised Civil Statutes Annotated; and that this meeting has been
open to the public as required by law at all times during which
this ordinance and the subject matter thereof has been discussed,
cons idered and formally acted upon.
The City Counci 1 further
ratifies, approves and confirms such written notice and the
contents and posting thereof.
Section 8. This Ordinance shall be effective fourteen (14)
days after its passage and approval.
The City Secretary shall
give notice of the passage of this ordinance by causing the
caption hereof to be published in the official newspaper in the
City of La Porte at least twice within ten (10) days after the
passage of this ordinance.
Section 9. The City Secretary of the City of La Porte is
hereby directed to notify the applicant of the zoning reclassifi-
cation that has been approved by the City Council of the City
of La Porte and is contained herein.
Said notification shall
specifically contain the following language:
TO THE APPLICANT:
The application for rezoning you filed with the
City of La Porte has been approved. Take notice,
however, that the City of La Porte is undergoing
a Comprehensive Plan adoption process. This Plan
adoption process includes the possibility that the
entire City of La Porte, specifically including your
property, would be rezoned.
The granting of your application in no way affects
this possible comprehensive rezoning effort by the
City of La Porte, and you should understand that

in order to insure your input as to the future
zoning classification your property might have,
you should attend the public hearings that will
be scheduled.

Mr. James N. Wallace met with the Planning and Zoning
Commission in public hearing on August 13, 1984, to request

Light Industrial to accommodate the expansion of the

SUBJECT: SPECIAL USE PERMIT-JAMES N. WALLACE
BLOCK 643, LOTS 1-32, LA PORTE
The City of La Porte has received a request to grant a "special
use permit" to allow a truck terminal from Mr. James Wallace.
The request is on block 643, lots 1-32, La Porte.
HISTORY
The City has recently rezoned this property to an "I" Industrial
zone. This is the zoning that is required in order to construct
a truck terminal. Presently B.F.I. is using the block directly
North of this site for the purpose requested here. The use
proposed is the storage of dumpsters and trucks as well as
employee parking. Within a one-half mile area there are two
other similar uses. These are the Chemlime Corporation, and the
BFI Inc. Construction. Both of these businesses include the
storage of trucks as part of their operation.
ANALYSIS
This site is located one block West of 16th and one block South
of the present B.F.I. yard. The site will be used for the
parking of trucks, dumpsters, and employee parking. It is
accessed from a paved street that is currently used for heavy
truck traffic. Utilities are not a problem as no structures will
be placed at this time.
RE.CQMMENDATION
This request is in keeping with other uses in the area. It "will
not adversely affect the implementation of the Comprehensive
Plan; and will not adversely affect traffic, public health,
public safety, and the general welfare." Staff recommends that
this special use permit be granted as it meets the qualifications
set forth in the City'S Zoning Ordinance.
