MINUTES OF THE
LA PORTE ZONING BOARD OF ADJUSTMENT
APRIL 25, 1985
1. The meeting was called to order by Chairman Sidney Grant at
7:00 P.M.
Members of the Board Present: Sidney Grant, Vivian Covington,
Lawrence Farias, Charlie Young, Ronney Rowell
Members of the Board Absent: Robert Swanagan, Linda Mains
Members of City Staff Present: Chief Building Official David
Paulissen, Assistant City Attorney John Armstrong

2. The Board considered a special use permit for Dana Tank
Container, Inc.
David Paulissen, Chief Building Official, reviewed the site,
which is currently zoned industrial, and the request of Dana
Tank Container for a special use permit for a truck wash and
truck storage yard (freight terminal). He addressed some of
the problems to be overcome before the site could be used,
namely, sanitary sewer extension, water lines, part of a
street needing to be constructed, and drainage.
Paulissen stated that staff recommends a conditional special
use permit, if the problems can be met and overcome.
A representative of Dana Tank Container gave a review of their
operations.
After questions from the Board, motion was made by Ronney
Rowell to grant a special use permit providing the conditions
laid out by the City staff are met by Dana Tank Container,
Inc. The motion was seconded. The motion was carried, 5 ayes
and 0 nays.
Ayes: Grant, Covington, Farias, Rowell and Young
Nays: None
3. There being no further business, the meeting was adjourned.

RE: Special use permit to allow truck wash and truck terminal.
Dear Ms. Black:
Dana Tank Container, Inc. was incorporated on May 27, 1983, in the
state of New Jersey. The company is privately held by Mr. Ronald
B. Dana.
Dana Tank Container was developed to control the cleaning, maintenance,
and ISO tank equipment leasing opportunities that have surfaced in the
New Jersey area. This market previously had been ignored by the
transportation companies on the eastern seaboard. The future growth
potential of these particular business areas is excellent.
In October 1984, Dana established a sales office in Houston to explore
the possibilities of performing the same business functions in the
gulf region. The response was so positive that Dana has negotiated
for property in La Porte to establish a full service terminal.
The site is located at 303 North L Street and it is presently zoned
industrial property. The intended use of the site is as follows:
- TANK WASHING FACILITY
- TANK EQUIPMENT REPAIR
- EMPTY TANK STORAGE
- DISPATCHING OF TANK TRUCKS
- LEASING OF TANK EQUIPMENT
Dana is aware of the various permitting requirements that must be
arranged in both the City and the State. Many of the applications
are already in our possesion and in various stages of completion.
We will be contacting the proper authorities in La Porte and in
Austin in the near future to finalize the application processes.

above should you have further questions about our proposed use of
the site. We look forward to meeting with the board in the near
future.

SUBJECT: SPECIAL USE PERMIT-DANA TANK-BL.24
The City has received a request from Dana Tank Container, Inc. for a
special use permit to operate a Truck Terminal and Truck Wash. The
proposed location is on North "L" Street and describe as the Eastern
265 feet of blk. 24. This site is North of the old land fill site and
just South of the Gulf Motorship car terminal.
HISTORY
Dana Tank Container, Inc. is an East coast tank truck line and tank
cleaning company. The proposed site is currently zoned "I"
industrial, but must have a special use permit to allow the truck wash
and terminal. Dana has completed both the utility verification and
address request paperwork. Water and sewer service as well as a road
must be brought to the site. Sanitary sewer service is the most
critical challenge faced by this proposal as depth of the main is a
problem. Drainage must also be accomplished from the proposed site.
ANALYSIS
The site is not currently served by any City utilities. The lack of
services can be resolved if the following specifics are addressed:
Sanitary sewer service will require a utility extension of about
2000 feet of probably 12" sewer line. The location of the
building on the site will be critical if it is to be served by
sewer without the construction of a lift station. Since this
information is late in coming there is not a site plan for your
review as of yet.
Water will require an extension of about 1500 feet of 8" water
line. Due to Fire Code requirements, an interior fire loop or
extension will also be required on site so that no part of the
building is more than 300' from a hydrant. The extension of the
water main has one other challenge to face. The indications are
from previous plans that "L" St. is closed West of 2nd street.
Since any water extension must follow this route, an easement will
have to be produced by Dana.
As mentioned above, certain construction drawings indicate that
"L" is closed West of 2nd St. Ingress and egress should be along

"L" St. Therefore, a street or other suitable access must be
built and easement requirements taken care of to provide for this
access.
This area is on the fringe of the developed area of town.
Drainage must be designed to contain chemical spills and storm
water run off. Since the proposed use would see the cleaning of
possible hazardous waste, drainage design and construction must be
done thoroughly and properly.
These items will be expensive and must be accomplished by Dana if the
site is to be viable.
.RE~OMME!mA TION
The area in question is suited for the proposed use. It is adjacent
to a large new car marshalling and preparation area. The area is
proposed to be "Heavy Industrial" under the proposed zoning plan. It
is the recommendation of the staff that if the above challenge can be
met and overcome that the special use permit for a truck terminal and
truck wash be granted.
