Dear Ms. Black:
We have been informed by the building inspection Department of La Porte
that referenced Ordinance prohibits the living in a trailer parked on
a vacant lot for the purpose of living in same.
We, Valcon II, Inc., are the General Contractor engaged in the construction
of the La Porte Junior High School (Lomax). The schedule and security of
this project requires our superintendent to be on the job site constantly
Monday through Friday and until noon on Saturday.
We respectfully request permission for Mr. Sapp to be allowed to sleep a
portion the time on this project in his combination Conference and Office
quarters. This is not Mr. Sapp`s home, he lives with his wife and family
at his address in Yoakum, Texas.
If Mr. Sapp`s staying on the jobsite under the above described conditions
is in conflict with any ordinance or rule, please grant us a variance that
will allow him to do so.

SUBJECT: APPEAL-VALCON II, INC.
The City has received an appeal from the decision of the Building
Official concerning the placement of a travel trailer for living
purposes on the site for the new Lomax Junior High School.
HISTORY:
Section 13-405(2) of the Zoning Ordinance states the following:
"Temporary buildings and/or Trailers: (Used for construction
purposes only) shall be removed upon completion or abandonment of
construction work. Temporary buildings and/or trailers cannot be
used as a place of residence."
Valcon II, Inc. had asked about the placement of a travel trailer for
living purposes on the new school site before they began the job.
They were advised that it was not permitted under the terms of the
ordinance. Subsequently the travel trailer was placed on the site
without a permit. This trailer was wired improperly and without a
permit. The City water main was tapped by the contractor without the
City's knowledge and without a meter. The latter two situations have
now been remedied.
Similar requests have been relatively common on the larger
construction jobs. All previous contractors have simply placed the
travel trailers in one of the several mobile home and RV parks within
the City. This request states that the unit is needed for security
purposes Monday through Friday and until noon on Saturday. There will
be someone living in the unit during these times. The question before
the Board is to decide whether or not the decision of the Building
Official is a correct interpretation of the ordinance.

The section of the ordinance should be analyzed and a decision made as
to the validity of the Building Official's decision. If the
interpretation of the ordinance is correct then the appeal should be
denied. If the interpretation of the ordinance is incorrect then the
Board should overrule the decision of the Building Official.

Dear Mr. Baker:
At the meeting of the La Porte Zoning Board of Adjustment
held May 9, 1985, your appeal of the above referenced section was
heard. After due deliberation, the Board of Adjustment has denied
your appeal for this variance.
If you wish to pursue this further, you have recourse to do
so through the County Court.
