MINUTES OF THE

MEETING OF THE LA PORTE ZONING BOARD OF ADJUSTMENT
JULY 25, 1985
1. The meeting was called to order by Assistant City Attorney
John Armstrong at 7:00 P.M.
2. The Oath of Office was given to the new board who were
present: Vivian Covington, Lawrence Farias, Jeanne Zemanek,
Gladys Roth, and alternates Cecil Knight and Deborah Bernay.
New member Jack Humphrey was not present.
3. Election of Chairman, Vice Chairman, and Secretary was held.
Lawrence Farias was elected Chairman, Vivian Covington was
elected Vice Chairman, and Jeanne Zemanek was elected
Secretary.
4. The Board considered the request of Bennie D. Mills for a
variance regarding Section 13-205(3) of the Zoning ordinance,
dealing with front yard fences.
Mr. Mills was present and stated that he would like the front
yard fence for security reasons; there have been 9 break-ins
in the past 2 months. Also, he has a small child and would
like to keep the fence for safety reasons, as well. Mr. Mills
restores antique automobiles and has several stored on his
property. The fence would help protect the autos from theft,
vandalism, etc.
Mark Lewis, Code Enforcement Division, requested the Board to
table this request and also the request of Wilbert Haygood
(the following agenda item) until the proposed zoning
ordinance is enacted; there is a provision in the new
ordinance that allows front yard fences. If that part of the
ordinance should not be approved, then the Board can take
another look at the issue and see if the fences will have to
be removed. Until that time, he requests the requests of Mr.
Mills and Mr. Haygood be tabled.
At this time, Assistant City Attorney John Armstrong briefed
the Board regarding their duties and responsibilities.

Motion was made by Vivian Covington to take the recommendation
of staff and table this item and the request of Wilbert
Haygood until the new zoning ordinance is adopted. Second by
Gladys Roth. The motion carried, 6 ayes and 0 nays.

5. This item was incorporated with item 3.
6. The Board considered the request of Robert Boyd for a special
exception to Section 13-204(1) of the Zoning Ordinance,
regarding an encroachment to the building line on his
property.
Mr. Boyd wishes to build a carport, and his lot is shaped so
that one corner of the carport encroaches on the building
line. He wishes to have a variance granted in order to
complete the carport.
Staff recommends that the variance be granted because of the
configuration of Mr. Boyd's lot.
Motion was made by Vivian Covington to grant Mr. Boyd's the
request for variance. Second by Deborah Bernay. The motion
carried, 6 ayes and 0 nays.

The staff has received two virtually identical variance requests.
Both requests are for front yard fences in the Lomax area.
HISTORY
As you know, the Lomax area is primarily rural in character. The
current front yard fence prohibition is contained in a zoning
ordinance that was written for "Old La Porte". Since the
consolidation with La Porte, the traditional barbed wire cattle fences
have been allowed in the Lomax area. The fences in question here are
chain link fences around residences.
ANALYSIS
This area of town is unique in character with predominantly large
rural lots. These lots lend themselves to fencing around the entire
home sites. These requests are also located on long straight streets
that are conducive to speeding.
The current zoning ordinance was not intended to speak to the Lomax
area. There is a change, concerning front yard, fences in the new
proposed zoning ordinance. This change would allow the placement of a
four foot front yard fence.
RECOMMENDAIION
Due to proposed changes concerning the zoning ordinance, the staff
would recommend that there be a stay of proceedings until such time as
the status of the front yard fence proposal is determined. Mr.'s
Mills and Haygood should be informed that if the proposed change is
not affected then removal of the fences in question would be required.

SUBJECT: Request for Sp. Exception
Robert Boyd
The City has received a building permit application from Mr. Robert
Boyd of 11033 Houston Dr. in the Lomax area. The permit was denied as
the proposed car port would encroach in a 3 x 4 triangle into the
required front yard set back. Mr. Boyd's lot is basically triangular
in configuration.
Section 16-200 of the zoning ordinance allows the granting of relief
under these circumstances by the use of a special exception. Sub (1)
of this section allows the modification of yard area due to the
unusual topography or restricted area and shape of a lot that would
prevent appropriate development without such modification.
The staff feels that this request meets the requirements of a special
exception that. Staff recommends that the request for a special
exception be granted.
