MINUTES OF THE
LA PORTE ZONING BOARD OF ADJUSTMENT MEETING
MARCH 13, 1986
1. The meeting was called to order by Acting Chairperson Vivian
Covington at 7:00 P.M.
Members of the Board Present: Vivian Covington, Jack Humphrey,
Zeanne Zemanek, Cecil Knight
Members of the Board Absent: Lawrence Farias, Deborah Bernay,
Gladys Roth
Members of City Staff Present: City Inspector Mark Lewis,
Assistant City Attorney John Armstrong
Others Present: Bennie and Melba Contreras
2. The Board considered approving the minutes of the October 17,
1985, meeting.
John Armstrong asked that the minutes be amended to show
Gladys Roth present at the October 17 meeting.
Motion was made by Jack Humphrey to approve the minutes of
the October 17, 1985, meeting as amended. Second by Cecil
Knight. The motion carried, 4 ayes and 0 nays.

3. The Board considered approving the minutes of the January 26,
1986, meeting.
Motion was made by Zeanne Zemanek to approve the minutes of
the January 26, 1986, meeting. Second by Jack Humphrey. The
motion carried, 4 ayes and 0 nays.

4. The board considered the variance request by Bennie and Melba
Contreras to allow a front yard fence for 128 East Plainbrook
and to allow a vacant lot behind their house to be fenced to
the front property line (fronting on Sunset Ridge) .

After discussion, the Assistant City Attorney asked that the
minutes reflect that any vote to grant the variance in this
case would be against his advice and over his objections.
Motion was made by Jack Humphrey to deny the variance. Second
by Cecil Knight. The motion to deny carried, 4 ayes and 0 nays.

5. There being no further business, motion was made by Cecil
Knight to adjourn. Second by Jeanne Zemanek.
6. The meeting was duly adjourned at 7:55 P.M.

SUBJECT: Variance request, setbacks, Paul Thomassee
A request for rear setback variance has been recei ved from Mr.
Paul Thomassee. It has been determined subsequent to the
scheduling of the agenda that this request should go to the
Planning and Zoning Commission. The reason for the determination
is the fact that the variance requested is from a platted building
setback. The Board of Adjustments may deal with these variances
only on unplatted
property.

To Whom It May Concern:
I am writing this letter in reference to the City Ordinance
on building fences around the front of our homes in the La Porte
City Limits.
I feel that I ought to have a variance permit given on this
request because I am going about it in the right way, by asking
permission; I am not just building it on my own.
I work shift work, and we feel that with a fence around our
home, my wife would feel much more secure; our dog would be able
to roam around the front of the house as well as the back. Also,
we have two very old cats that need to go out sometime, and we
feel that with the fence they would be better protected from cars,
and from wandering dogs.
I have enclosed a drawing of our property with the fence that
is there now, and with what we want to put up.
I am also enclosing a letter signed by residents of this
area, showing their approval of our request.

I am signing this letter to show that I do not have any ~bjection
toward Mr. and Mrs. Bennie Contreras building a fence in front of
.-their home, which faces Plainbrook Street. I also do not object
to them building a fence to the corner posts on the two lots
behind them, facing Sunset Ridge Street.

SUBJECT: Front yard fence request B. G. Contreras Jr.
The City has received a request for a variance to build a front
yard fence from Mr. Bennie G. Contreras Jr. of 11803 Plainbrook in
La Porte. The property is described as lots 11, 12, 27, & 28
Pinegrove Valley Subdivision. The request does not meet the
hardship requirements for a variance and should be denied.
Mr. Contreras has actually a two part request outlined below:
1. Allow a front yard fence on the property facing
Plainbrook adjacent to his home;
2. Allow a fence to be built to the rear property lines
that in the case of this through lot situation front on
Sunset Ridge.
Both of these situations are prohibited by the current ordinance.
Item 1 above is prohibited under section 13-205-(3) Fences:
"Front yard fences will not be permitted,...." Item 2 is
prohibited by section 7-159 Lot, Through. A "through lot" is a
building lot not a corner lot, both the front a rear lot lines of
which adjoin street lines. On a "through lot" both street lines
shall be deemed front lot lines.
The zoning ord inance language tracks State law spec ifically in
this s i tua t ion and requ i res the proof of a ha rd ship before a
variance may be granted. A hardship is a situation where the
parcel of land is of such unusual topography or restricted area
and shape that it cannot be appropriately developed without such
modification. Self imposed or financial hardships may not be
considered as grounds for a variance.
The front yard fence issue has and will be discussed in the
adoption process of the new proposed zoning ordinance.
Based on the above discussion, staff must recommend the denial of
this request.
