Members of the Board Present: Vivian Covington, Jack Humphrey, Jeanne Zemanek, Cecil Knight Others Present: Assistant City Attorney John Armstrong; Mark Lewis, Building Inspector; Mrs. Donnas Cooper 2. The Board considered approving the minutes of June 26, 1986. Motion was made bv Jack Humphrev to approve the minutes of June 26 as presented. Second by Cecil Knight. The motion carried, 4 ayes and 0 nays. Ayes: Covington, Humphrey, Zemanek, Knight Nays: None 3. The Board considered the request of Highway Transport, Inc., for a special use permit to allow expansion of tanker truck maintenance facility. Motion was made bv Jack Humphrev to grant the special use permit to Highway Transport, Inc., to allow expansion of their tanker truck maintenance facility for additional trailer parking for their existing truck terminal. Second by Jeanne Zemanek. The motion carried, ayes and 0 nays. Ayes: Covington, Humphrey, Zemanek, Knight Nays: None 4. The Board considered a "special exception" regarding rear yard setback requirements for Raymond and Linda Lott. This request was tabled due to Mr. and Mrs. Lott not being at the meeting to present their case. 5. The Board considered a request for variance regarding front yard fencing at the request of Donnas Cooper. This is two separate requests. Mrs. Cooper is requesting a variance to allow her to fence lots 18 and 19, Block 4, and lots 20 and 21, Block 3, in Pinegrove Valley in La Porte; and for a variance to allow for an extension of a front yard fence on lots 9 and 10, Block 4, Pinegrove Valley. t t Minutes, La Porte Zoning Board of Adjustment August 28, 1986, Page 2 Motion was made bv Jack Humphrev to allow the variance to extend the front yard fence. Highway Transport's request for Special Use Permit Lots 1-3 of Block 797; La Porte for SUBJECT: Highway Transport Inc. is requesting a Spec ial Use Permit for the above referenced property to allow them to provide additional trailer parking for their existing truck terminal. Section 13-505 (2) of Ordinance 780-ZZZ requires Special Use Permits as follows: "Uses for which Special Use Permi ts may be secured... are as follows: (1) Freight terminals [Truck terminals as per 7-163 of Ordinance 780 definitions]" Special Use regulations are specified by Section 13-505 of Ordinance 780 as follows: "Special Uses may be authorized by the Board of Adjustments in appropriate cases and subject to certain conditions and safeguards as might be required by the Board..." The following requirements apply: 1) The property must be industrially zoned. 2) Granting the permit depreciate the value neighborhoods. must not adversely affect of surrounding property or or 3) Granting the permit must be "in keeping with the spirit and intent" of the Zoning Ordinance and must not adversely affect the implementation of the Comprehensive Plan. . . 4) Finally, granting the permit must not adversely affect traffic, public utilities, public health, public safety and the general welfare. RECOMMENDATION Highway Transport's application meets all requirements for a Special Use Permit. The property in question is industrially zoned and adjoins Highway Transport's existing facility. The building inspector promptly informed us of the encroachment and advised us to apply to the Planning & Zoning Board. We have conducted our business favorably over the years and have an excellent reputation in Deer Park and have never had any problems in La Porte. The owners of course are very much interested in building the addition and the opinions I have gotten from others in the field is that the 9'0" we are away from the easement seems to be sufficient engineering-wise. Request by Raymond and Linda Lott for special exception to Zoning Ordinance for 8803 Gladwyne Ct. FROM: This request is for a special exception to the rear yard set back requirements of section 13-204 (3) of City Ordinance # 780-RR. A special exception may be granted under the following circumstances. Section 16-201 of Ordinance # 780: "The Board of Adjustment is hereby empowered to permit the following exceptions... (1) Permit such modifications of the height, vard only, spacing and parking regulations as may be necessary to secure appropriate development of a parcel of land of such unusual topographv or restricted area and shape that it cannot be appropriatelv developed without modification." BACKGROUND Plans for this room addition were reviewed and the permit was approved by the City on July 14, 1986. The City's plan reviewer made a notation on the site plan (copy enclosed) requiring the rear wall of the addition to be located 18 feet from the rear property line. This is in accordance with Section 13-204 (3) of City Zoning Ordinance # 780-RR which reads: "Rear Yard: The rear yard shall have a mInImum depth of 18 feet or 10 feet from any utility easement, whichever is greater..." .. . The Lotts submitted a copy of a registered survey (attached) with an earlier building permit application for an accessory building. This survey shows 8 feet of a utility easement running across the back portion of the rear yard. As layed out, the slab will be located 9 feet from the rear property line and 1 foot from the utility easement. In addition, the site plan shows a 25 foot pipeline easement, running down the side of the property, is shown to be clear of the existing house and addition by an unspecified distance. The survey shows the existing house against the easement. This would appear to have the room addition encroaching into the pipeline easement. RECOMMENDATION Staff recommends this special exception be denied. The property, as platted, is not of "such unusual topography or restricted area and shape" that appropriate development has been precluded. Secondly, in the case of possible encroachment into the adjacent pipeline easement, the City is in no way empowered to grant a special exception or variance to allow any encroachment into this easement. . . 7-29-86 Planning and Zoning Board of Adjustments Sherry Black, City Secretary P.O. Box 1115 La Porte, Texas, 77571 Dear Board Members, I spoke with David Pau1issen concerning "a Special Exception" for fencing of lots II 18 and 19 B1k 4 and lots 20 and 21 b1k 3 in Pinegrove Valley. We have a garden on these 4 lots. They border 2 streets and is adjacent to a stable area on the other side. (See graph below.) Due to increased act- ivity of 3 wheelers, horses and at times 4 wheel drive vehicles over lots and right of ways, we are asking the board to consider a Special Exception to the fencing ordinance now in effect. We plan to fence this area on all sides to control unwanted traffic accross our lots and garden area. We also ask for a Special Exception for fencing the front of lots 9 and 10 b1k 4, which is our place of residence with a decorative fence. I have ask the Board of Zoning for the "Special Exception" you mentioned. I am enclosing a copy of the letter to Sherry Black and would like to solicit your help in support- ing my request. I know this will control the 3 wheelers and horses crossing our lots and garden areas. I am enclosing a copy of the map you requested of our home and lots showing the Utility easement. Section 13-205 (3) of City Ordinance # 780 reads as follows: Fences: Front yard fences will not be permi tted, side or back yard fences will be permitted;... Ms. Cooper is requesting two separate variances to this section of the City's Zoning Ordinance. The first is to allow Lots 18-21 of Block 3; Pinegrove Valley to be fenced to their front property lines. Section 16-202 of Ordinance 780 reads as follows: Granting of Variances: The Board of Adjustment is hereby autho r i zed upon appeal from the dec i s ion of the admin istrat i ve officer to grant in specific cases such variance from the terms of this Ordinance as will not be contrary to public interest, where, owing to special conditions, a literal enforcement of the provisions of the Ordinance will result in unnecessary hardship, and so that the spirit of this Ordinance shall be observed and substantial justice done. Staff requests the Board to refer to the City Attorney for the definition of hardship under the State law. Leaving this property unfenced will not cause a hardship as defined. Staff therefore recommends against granting this variance. Ms. Cooper's second request is to expand an existing front yard fence. The present fence is located at the Cooper's residence at 11802 Plainbrook Road and encloses Lots 10-13 of Block 4. Ms. Cooper is requesting a variance to allow the front yard fence to be expanded to enclose Lot 9 as well. . .. In reviewing considered. this request, Section It reads as follows: 11-103 of Ordinance should be They [non conforming uses] may be expanded or structurally altered as hereinafter pl~ovided, unless located in District "R-1" Single Family and Duplex Residential District. A nonconforming use in District "R-1" Single Family and Duplex Residential District, which is a permitted use in District "e" or a nonconforming use in District "e" which otherwise is a lawfully established use, may be enlarged or changed by horizontal expansion upon but not beyond the tract or lot of record upon which located as of the date such a use becomes nonconforming; and any enlargement or expans ion shall not encroach upon any open space upon such lot that would be required as a yard if the use were a conforming use in the district in which located. Staff makes no recommendation in regards to this request.
