In the absence of a Chairman, the meeting was called to order at 7:02 P.M. by City Secretary Cherie Black. Members of the Board Present: Deborah Bernay, Jody Seeger, Gladys Roth, Jim Parson, Jack Humphrey Members of the Board Absent: None Members of City Staff Present: City Secretary Cherie Black, Inspector Mark Lewis Others Present: Greg Allison, Anthony Pools, representing Elegar Garcia 2. The oath of office was given to all members by City Secretary Black. 3. Officers were duly elected under the supervision of the City Secretary. They are as follows: Chairman - Jack Humphrey Vice Chairman - Gladys Roth Secretary - Deborah Bernay Chairman Humphrey took the Chair and proceeded with the next order of business. 4. A presentation by Staff regarding the powers and duties of the Board of Adjustment was postponed due to the illness of Assistant City Attorney John Armstrong. 5. The public hearing was called to order to hear the request of Elegar Garcia for a variance to setback requirements of the Zoning Ordinance in order to construct a swimming pool at 3830 Roseway Lane; Lot 11, Block 45, Fairmont Park West, Section 5. Inspector Mark Lewis presented a background report on this item and Staff's recommendation. Greg Allison, Anthony Pools, spoke on the owner's behalf. After discussion, the Chairman called for a vote. . There being no further business to come before the Board, the meeting was duly adjourned at 7:59 P.M. on motion of Deborah Bernay with second by Jody Seeger. " CITY OF LA PORTE INTER-OFFICE MEMORANDUM JULY 6, 1987 TO: FROM: ZONING BOARD OF ADJUSTMENTS D~ULISSEN, ZONING ADMINISTRATOR NEW JERUSALEM CHURCH; SPECIAL EXCEPTION REQUEST FOR BLOCK 62; LOTS 17-20; LA PORTE SUBJECT: . BACKGROUND The New Jerusalem Church is proposing to build a new educational/recreational building adjacent to their existing facility located at 210 West Polk. This building will be located on Lots 17-20 of Block 62, La Porte. This property is presently zoned "R-1". The church is requesting a special exception to the setback requirements of Section 5-700, Table B. This section designates the following setbacks for religious institutions: 30 ft. front 20 ft. - rear 10 ft. - side The church is specifically requesting exceptions to the front and rear setback requirements. They are making this request under the guide lines set forth in Section 11-605 (2) & (4). Item 2 deals with rear yards and reads as follows: A rear yard exception where the actual rear yard setback of any four (4) or more lots in the same block does not meet the rear yard requirements of these regulations. Item 4 deals with front yards and reads as follows: An exception where the existing front yard setbacks shall, for buildings hereafter constructed or extended, be the required minimum front yard depth. f ~ Zoning Board of Adjustments July 6, 1987 Page 2 ANALYSIS Front Setbac~ The only adjacent structure to remain on this face of the block is the existing church. There is also a frame house, but the site plan submitted by the church indicates a parking lot where this house presently stands. The front church setback is shown as 12.4 ft. at the narrowest point. Originally the church had requested a front setback of 21 ft. However, in subsequent communication with Rev. Haggerty, this request has been amended. The church is now requesting a setback of 12.4 ft. to match the setback of the existing church building. This request is in keeping with the gu~delines laid down by item #4. Rear Setback: The existing church building originally had a rear setback of 3.2 ft. (as per attached site plan). They have subsequently acquired an additional 2 lots behind this building. These lots are to be used for parking. Again the church had originally requested a rear setback of 10 ft. After shifting the proposed building forward to the 12.4 front setback, the rear setback will become 18.6 ft. This is an encroachment of 1.4 ft. into the required rear yard area. Staff considers this setback encroachment to be minimal and in keeping with the intent of item #2. RECOMMENDATION Staff recommends that the New Jerusalem Church be granted a Special Exception to allow a new building be erected on Lots 17-20 of Block 62, with a front and rear setback of 12.4 ft. and 18.6 ft. respectively. '. . " PAGE 2 A variance is a "deviation from the literal proVIsIons of the Zoning Ordinance". The City's Board of Adjustments may NOT grant a variance that does not meet all of the following conditions: 1) The variance must not be contrary to the public interest. 2) Literal enforcement of the Zoning Ordinance must result in a hardship. This hardship must be unique to the property in question. Property that is undevelopable due to its unusual shape, narrowness, shallowness, or topography con- stitutes the primary exampl~ of hardship. Hardships that are financial in nature or due to the owner's actions cannot be granted. 3) Granting the variance must not violate the spirit of the Zoning Ordinance. LI) No variance that allows a use that is prohibited within the Use zone in question may be granted. For example, a variance allowing a commercial use in a residential zone is not allow- able.
