Members Present: Jody Seeger, James Parsons, Jack Humphrey Member Absent: Gladys Roth City Staff Present: Joel H. Albrecht, Director of Community Development; Ervin J. Griffith, Building Official/Zoning Administrator; Nina Bergeron, Community Development Secretary; John Armstrong, Assistant City Attorney Others Present: R.T. Sims, property owner at 525 South 7th; Teresa Sims, property owner at 525 South 7th; E.G. Clarke, District 6 Representative, City Council • First on the agenda was to consider approving the minutes from the May 12, 1933 Public Hearing and Regular Meeting. There was a motion by Jody Seeger and a second by Jack Humphrey to approve the minutes as presented. The vote was unanimous. Next on the agenda was to consider an appeal by Mr. R.T. Sims to the enforcing officer's decision regarding side yard setbacks as regulated by Section 5-700, Table "B" of Ordinance #1501. Staff reports that Mr. Sims carport not only exceeds the ten feet (101) side yard setback required by ordinance, but also encroaches four feet, six inches (4.51) into the adjacent west "E" Street right of way. The City did not permit the construction of this carport. Property owners within the two hundred feet (2001) area were notified. Seventeen (17) notices were sent out with five (5) replies returned in favor of and none in opposition. Staff, in conclusion, stated that this request does not meet the prerequisite requirements. Staff is recommending that the Board deny this appeal. After being sworn in under oath, R. T. Sims submitted fourteen (14) letters (plus the five mailed in) from surrounding property owners supporting his appeal along with pictures of the carport. He • expressed his reasons for keeping his carport. • • Board of Adjustments Minutes June 16, 1988 Page 2 E.G. Clarke came forward and spoke in Mr. Sims' behalf after being sworn in. Teresa Sims was sworn in and questioned the changes in the ordinance. After more discussion, there was a motion by Jack Humphrey and a second by Jody Seeger to deny the appeal by Mr. Sims to the enforcing officer's decision. The vote was unanimous and the motion carried. Mr. Sims will receive a letter from the Board of Adjustments notifying him of this decision. The fourth item on the agenda was to consider a request by Mr. Doug Latimer on behalf of Mechanical Repair and Engineering Inc. for a Special Exception to front yard setback requirements for 202 North 18th Street as provided for by Section 11-605.2.b.1 of Ordinance 1111501. Staff reports that in order for Mr. Latimer's overhead crane tracks to be extended and due to the fact that this is a non -conforming structure, a Special Exception is necessary because of the setback requirements in the current zoning ordinance. When the structure was constructed, the Mechanical Repair Building met all zoning requirements. Staff is recommending that the Special Exception be granted to Mechanical Repair and Engineering, Inc. They meet all of the necessary requirements. After being sworn in under oath, Mr. Doug Latimer explained to the Board the reason for this construction to extend the overhead crane tracks. After discussion, there was a motion by Jack Humphrey and a second by Jody Seeger to grant this Special Exception to Doug Latimer on behalf of Mechanical Repair and Engineering, Inc. The vote was unanimous and the motion carried. There was a motion by Jack Humphrey and a second by Jody Seeger to adjourn. The vote was unanimous and the meeting was adjourned at 8:10 P.M. Before they grant a special exception, The Board of Adjustments must determine that the exception is not contrary to the best public interest and will not adversely affect the value or use of adjoining property. Special exceptions may be granted for the following items only: (1) The reconstruction of or addition'to a building occupied by a non -conforming use. Additions cannot extend past the lot occupied by the original structure or use. The reconstruction or use cannot prevent the property from returning to a conforming use. O 0 •c E is PAGE 3 TYPE OF RELIEF BEING SOUGHT: McDonald's requests a Special Exception under the terms of Section 11-605.2.a of the City of La Porte's Zoning Ordinance No. 1501, THE GROUNDS FOR THE REQUEST: The La Porte State Bank sign, commonly known as GUS, is a leaal pre-existing non -conforming use. Section 11-602.2.a of the La Porte's Zoning Ordinance allows, (subject to the granting of a Special Exception)a non -conforming use to be reconstructed on the same lot of record. McDonald's feels the relocation of GUS will constitute such a reconstruction. A preexisting non -conforming off premise advertising sign located in an area that would interfere with the planned use of the property. Section 11-605.2.a of the City of La Porte Zoning Ordinance allows for a Special Exception "to reconstruct, enlarge or extend a building occupied by a non -conforming use on the lot or tract occupied by such building, providing that the reconstruction, extension, or enlargement does not prevent the return of the property to a conforming use." ANALYSIS• The sign in question was permitted on July 8, 1987, this was prior to the adoption of the Interim Sign Regulations (Section 10-1000 of the City of La Porte Zoning Ordinance), which rendered the sign to be a non -conforming structure. Staff feels reconstruction of the sign at another location on the property would not prevent the return of the property to a conforming use. This footnote requires a twenty (20) foot landscaped setback area adjacent to all designated ronGPrvarion areas. As indicated on exhibit A, the western side of this property is bounded by Little Cedar Bayou. The City's Official Parks and Recreation reap designates Little Cedar Bayou as a conservation area (See Exhibit B). Footnote IN of Commercial Table B (Section 6-500, See Exhibit C) requires a twenty (20) foot setback adjacent to designated conservation areas. McDonald's is seeking a Special Exception to this setback requirement. The exception is being requested under the provisions of Section 11-605.2.b.3 allows yard exceptions on corner lots. ANALYSIS: The primary intent of the twenty (20) foot landscaped setback adjacent to designated conservation areas, is to enhance the aesthetic appeal of La Porte. This is an important and worthwhile objective of the City's Comprehensive Plan & Zoning Ordinance.
