Before they grant a special exception, The Board of Adjustments must determine that the exception is not contrary to the best public interest and will not adversely affect the value or use of adjoining property. Special exceptions may be granted for the following items only: (1) The reconstruction of or addition to a building occupied by a non-conforming use. Additions cannot extend past the lot occupied by the original structure or use. The reconstruction or use cannot prevent the property from returning to a conforming use. (2) Deviation of yard requirements under the following cir- cumstances: • (a) Exceptions to front yard requirements if front yard setbacks are not met on abutting pieces of property. (b) Exception to rear yard setbacks if any four (4~) lots within a block do not meet setback requirements. (c) Exceptions to yard requirements on corner lots. (d) Exceptions to front yard requirements if existing front yard setbacks on a block are not uniform. Ownership of buildings and property in this location is somewhat complex. Mr. Groda owns lots 4 & 5 of this block ano" the building located on it. This building is joined by means of a covered breezetaay to the building on the adjoining property. Both the Zoning Ordinance and building code consider these joined structures to be a single building. Although, Groda Enterprises occupies and utilize s• both portions of the joined building, due to the fact that Mr. Groda only owns lots 4 & 5, only these lots may be considered in this request. In addition to the 40 ft. X 40 ft. building located on these lots, there is, .also a 12 ft. X 8 ft. portable storage building. I~Ir. Groda is proposing a 40 ft. X 40 ft., 2 story addition to be located on the front side of the existing primary structure (See Exhibit A). At the time of the existing building's construction, Zoning Ordinance 4780 was in~..effect. This property was, at that time, zoned for Commercial use and the existing building met all zoning requirements. The building and use of the property (Groda Enterprises has occupied this building since March 1984) were rendered non-conforming with the adoption of Zoning Ordinance ~~1501 (January 26, 1987). As it .is occupied by a non-conforming use, Mr. Groda's building may only be enlarged if a Special Exception is granted by the board. It is for this reason, Mr. Groda has requested a Special Exception under the provisions of Section 11-605.2a. ® • Special Exception Request 8g-001, Page 2 • Section 4-200 states: "The general public, the Planning Commission and the Board are directed to take note that non-conformities in the use and development of land and buildings are to be avoided, or eliminated where now existing, wherever and whenever possible, er.cept when necessary to preserve property rights, specific structures, lots, or uses established prior to tt~e date these regulations became effective as to the property in question, and when necessary to promote the general welfare and to protect the character of surrounding property." As noted earlier, both the existing building and its use (sales and service of fire protection equipment) 'are non-conforming. The building is non-conforming due to failure to meet R-3 setback requirements. Section 4-201 states: "...no non-conforming structure shall be enlarged or extended unless the enlargement or extension can be, and is, made in • compliance with all of the provisions herein established for structures in the district in which the non-conforming structure is located." Section 11-605.2 states: "[to grant a special exception,] the Board [must find] that such special exception will not adversely affect the value and use of adjacent or neighboring property or be contrary to the best public interest." Section 11-60~ 2a continues: "[A special exception to] enlarge or extend a building occupied by a non-conforming use on the lot of record [may be granted] provided that ~the...enlargement does not prevent the return of the property to a conforming use." Y1hen considering a special exception request, the Board must use these ordinance sections as their guide. Ana~sis: • The two (2) lots which make up this tract are comprised of 6250 sq. ft. There is presently 1696 sq. ft. of structure on the property. This constitutes a lot coverage of 27~. The proposed addition would increase lot coverage to approximately 53~• Special Exeption Request 89-001, Page 3 r~ L • The small size of this tract limits the conforming uses to which it could be placed. The only use which this property lends itself to is a single family dwelling. A lot coverage of 53~ exceeds the maximum allowable single family lot coverage by 13ro. Additionally, the type of structures existing and proposed are expressly designed for commercial activities and~are not readily adaptable to residential use. Construction of this addition would therefore make an eventual return of this property to a conforming use much more difficult. Another important issue to be considered is parking. Under current ordinance requirements, the present building requires nine (9) parking spaces. The proposed addition would require an additional ten (10) spaces for a total of nineteen (1g) spaces. The front setback area 1 the addition is built cannot accommodate more than si . (6) parking spac~s_;--i_f ia;r~ n-ut in accordance with ordina ce equir"- ents. Parking for this facility would therefore be very inadequate and as a result, the degree of non-conformity at this location would be greatly 7 increased. Finally, the intent of the Comprehensive Plan and the best • interest of the neighborhood must be considered. While the best public interest must be determined by the Board, based on testimony of the applicant and surrounding property owners, staff can speak to Comprehensive plan issues. A review of land use and zoning maps indicate the clear intent to promote residential redevelopment of this area. (see Exhibits B & C). Approval of this request would be clearly contrary to the plan's intent. Conclusion• Construction of this building addition cannot be accomplished in a manner cahich will comply with R-3 zoning requirements. It would make .a return t~o a conforming proper°ty use much more difficult. Inadequate parking would increase the degree of non-conformity on the property. The request is clearly contrary to the intent of the Comprehensive Plan. Recommendation: Deny special exception request SE89-001. Permit was denied for failure to comply with the requirements of Ordinance ;1501, Section 6-500, Table B. Requested For: Garza's Tire & Mechanic Shop 318 North 8th St., La Porte, Texas Legal Description: Blk 77, Lots 8 & 9; La Porte Tract (See Exhibit A) Owner: t;oe Garza Zoning: General Commercial (G.C.) Background: On February 16, 1989, Mr. Noe Garza submitted a certified_ site plan (C.S.P.) for review. C.S.P. review and approval is the required first step for obtaining a building permit for • commercial construction. On February 21, 1989, this site plan was reviewed and disapproved (See Exhibit B). Disapproval was primarily based on t}ie pr•or~osed addition's failure to comply with City Zoning and Fire Code requirements. On February 22, 1989, in order to initiate the appeal process, Mr. Garza submitted a building permit application which was denied by the Code Enforcement staff (See Exhibit C). Specific areas cf non-compliance with zoning requirements were as follows. 1. Addition would cause maximum allowable G.C. lot coverage of 40~ to be" exceeded by 900 square feet or approximately 10~ (Section 6-500, Table B; See Exhibit D) 2. Addition would encroach f9.fteen (15) feet into the required ttaenty (20)~ feet rear set-back area (Section 6-500, Table B). 3. There is not adequate room on the property to deveicp required parking. As an existing building, the present parking is a given. However, additional parking would be required for any building addition. To comply with current ordinance requirements .all parking spaces and maneuvering room must be contained on premise. .4 A total of ten (10) parking spaces (8 for the existing • building and 2 for the proposed addition) would be required. Parking for this establishment is limited to a 34.4 ft. X 50 ft. area located in front of the building. Using any parking arrangement currently allowed by ordinance (See Exhibit E), no more than four parking spaces could be developed on this property. As noted earlier, in addition to these zoning problems, the site plan review noted the problem of inadequate fire protection. The City's Fire Code requires a fire hydrant to be located within three hundred (300) feet of the furthest point of a building. This distance is measured along the lines the fire department would have to follow when laying down a hose during a fire. An additional fire hydrant would be necessary in order to provide required fire protection to a building addition in this location. Conclusion: Under the provisions of Zoning Ordinance Section 11-604.3, the Board, in order to grant an appeal must find the following conditions to be met. A. That there is a reasonable difference of interpretation as to the specific intent of the zoning regulations or • zoning map, provided the interruption of the enforcement officer is a reasonable presumption and the zoning ordinance is unreasonable. B. That the resulting interpretation will not grant a special privilege to one property inconsistent with other properties or uses similarly situated. C. The decision of the Board must be in the best interest of the community and consistent with the spirit and interest of the City's zoning laws and the Comprehensive Plan of the City of La Porte. Regarding this appeal, the provisions of Section 6-500 are very clear. There has been no evidence presented to indicate a misinterpretation on staff's part as required by paragraph a. Secondly, granting this appeal would show special privilege to this property. The special privilege would result in the reduction of setback, lot coverage, and parking requirements entailed in an approval of this request. This would be contrary to the requirements of paragraph b. The project was disapproved at this time because of the following reasons: 1) No fire protection within three hundred feet (300') of the building addition. Any questions can be directed to Mr. Paul Hickenbottom the City's fire marshal. 2)~ Zoning Ordinance No. 1501 regulates the following items. __~ A) Maximum lot coverage in a General Commercial (G.C.) zone is forty percent (40~) or 2500 square feet on the two lots in question. The addition would exceed this restriction. B) For G.C, zoned property adjoining residential zoned property, the minimum rear building setback is twenty feet (20'). C) Additional parking would be required if an addition is built. D) For G.C. zoned property, a landscaping requirement of six percent (6%) w~oul'd apply if are addition is built. 3) ~ The site plan ref'lects~three (3) lines leaving the power pole and crossing the intended building location. Houston Lighting and Power may wish to address this if the addition is built. 4) If the addition is built, signature blocks for the•Approving Authority Certificate would need to be shown on the approved site plan. Once the above items are satisfied, a new site plan must be filed for Department approval. If you feel the disapproval was unjust, enclosed is 'an application for appeal of the Enforcement Officer's • Decision.
