APPROVE MINUTES OF THE AUGUST 26,1999 MEETING. - With no objections from the Board, Chairperson Grant declared the minutes approved as presented. III. CONSIDER VARIANCE REQUEST #V99-001 WHICH SEEKS TO ALLOW THE CONSTRUCTION OF A TRUCK MAINTENANCE BUILDING WITH A SIDE SETBACK OF FIVE FEET (8') AS PER SECTION 106-192(B)(2) OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE. Staffs report presented by Debbie Wilmore. Port Properties intends to construct a building at 629 N. 8'' Street They have -requested a variance to build within five feet (5) of the west property line. Twelve (12) public hearing notices were mailed to property owners within 200 feet of the site. Six (6) responses were received favoring the variance; none were received in opposition; and one (1) was returned undeliverable. Two (2) favorable responses were received from individuals that were not on the mailing list A. PROPONENTS - Chairperson Grant swore in Charlie Young, District 5 Councilperson. Mr.. Young stated that the current property owner, Mr. Momin, has done a first class job in the past and has made a definite improvement to the area. Mr. Young has looked at the proposed building plans and believes the project will be an asset to the area. B. OPPONENTS No opposition was presented. Motion made by Rod Rothermel to approve Variance #V99-001, Motion seconded by Ruben Salinas. All were in favor and the motion passed. (An Explanation of the Funding Process) Each year, the State of Texas receives an allocation from the U.S. Department of Housing and Urban Development to be used for the purpose of providing decent, safe and affordable housing, and to alleviate the problems of excessive rent burdens, homelessness and deteriorating housing stock. The Texas Department of Housing and Community Affairs' HOME Investment Partnerships Program is the agency designated to oversee the distribution of these funds through a highly competitive application process. The funds may be used for several types of projects including Home Ownership Assistance, Tenant -based Rental Assistance, Single-family Housing Rehabilitation, and Multifamily Rental Projects. Any unit of local government, Public Housing Authority, Community Housing Development Organization (CHODO), or other -non-profit or for. -profit organization, not within a participating jurisdiction, is eligible to apply. Once the applications are received by the State, the are then scored. according to the HOME Program's criteria, and ranked in a point system. Those Rental applications meeting the HOME Program's stringent criteria (called "meeting threshold") are then sent to the Agency's Underwriting department to determine their financial soundness. If the project -Is approved.by.Underwriting, It is sent back to HOME, ranked according to merit, and funds are allocated according to availability. Having been deemed worthy of funding, the project then goes through -the process of `Interim Closing.' This is. a legal process conducted by the Texas Department of Housing and Community Afsirs and the Recipient's Title Company whereby Tide is transferred and funds are freed for use. Once a project 'closes into Interim,' the Construction Phase can begin. Throughout this period, the HOME Program monitors the project for compliance with all Federal, State and Local laws, rules, 011'1'1f 2017b l (: l95 51244SbUJ2 PAM ORR PAGE 03 and regulations. The money for the project Is not given out in a lump sum, but kept in an account at the HUD office, In order to access these funds, the project must submit what is called a "Draw Request" to the HOME Program. This Draw Request must be signed by the designated signatory (in this case, the Executive Director of Lakeside Center, Inc.), and be accompanied by an Architect's Schedule of Values, certifying that the work being billed for has, in fact, been completed. Periodically, the HOME Program's Regional Coordinator will make a site visit to assure that the work is being completed properly. if there are no problems, the Regional Coordinator signs off on the Draw Request and submits it to the Agency's Acxounting- Department. It is then submitted to HUD for payment. The process takes approximately two weeks. Once the funds are released, they go to the Administrator (Lakeside Center, Inc.) to pay the invoicing parties. Every aspect of the project is closely monitored throughout the construction phase. Once construction is completed, a "Final Draw Request" is submitted and a final monitoring visit is conducted. During this visit, all paperwork is inspected and the structures are examined for compliance. The Regional Coordinator then approves the Final Draw Request and Issues a letter stating that the project has met approval and is considered closed. With the receipt of this letter, the project closes into the Permanent Financing Phase, and the payback of the loan begins. Once the rental project "closes into Permanent", it is required to operate In accordance with the "Land Use Restriction Agreement' for the entire term of the "Affordability Period". This Agreement, often referred to as the LURA, Is developed by the -Agency and delineates what can and cannot be done with the property. Among other things, it specifies the income requirements for the tenants, how much can be charged for rent, and provides for the proper maintenance of the apartments. Compliance with the LURA is monitored by the Texas Department of Housing and Community Affairs Compliance Division through yearly on -site inspections, and quarterly and annual reports. Having met all criteria for funding by the State of Texas and HUD,- the acquisition and rehabilitation of the Flamingo Bay Apartments is being funded entirely with a loan from the Texas Department of 01/12:2000. 17:05 5124436832 PAM ORR PAGE 04 Housing and Community Affairs HOME Program. Case, Executive Director Requested for: Occupation of Abandoned, Nonconforming Structures and Lot of Record Background: The current zoning designation for this property is R 3 which is appropriate for multi -family development. The issue at hand is the occupation of abandoned, nonconforming structures and lot of record. Section 106-261 of the City's zoning code states that the general public,, the Planning and Zoning Commission and the Zoning Board of Adjustment have been directed to take note that no es in the- use and development of land and buildings are to be avoided, or eliminated where now existing, wherever and whenever possible. Section 106-268 regarding nonconforming lots of record states that no new use or change in occupancy may be undertaken on nonconforming lots of record, unless said change in use or occupancy is first submitted to the Planning Director for review. The Planning Director shall review said proposed change in use or occupancy, for purposes of insuring maximum compliance with zoning regulations, taking into account the particular restraints imposed by the degree of nonconformity. The Director's review shall include, but not be limited to parking, loading, vehicular access, landscaping, setbacks, utility availability, and other requirements as imposed by zoning and development regulations. Decisions of the Planning Director pursuant to these provisions are subject to appeal to the Board of Adjustment The multi -family apartment complex located at 200 Garfield just off S. Broadway was constructed in the mid-60s. Over the years, these apartments have been operated under the names of Kings Bay, Queens Bay, Flamingo Bay, and most recently Little Cedar Bayou Manor. This apartment complex was occupied until July, 1997,. at which time utility service was discontinued because of non-payment of several thousand dollars of utility fees. There have been some problems associated with this apartment complex in the past City of La Porte Police records indicate that from the period January 1, 1993 to July, 1997, hundreds of calls were made to this location to deal with different situations. Interviews with locaf residents reveal that parking on Garfield and Forest created traffic and pedestrian safety concerns. Also, a combination of no security fencing and a lack of on -site recreational Board of Adjustment January 27, 2000 #NCS 2000-001 Page 2 of 5 facilities resulted in children of all ages playing in the paved parking areas and sometimes in the streets. Nonconforming Issues: The City's current building and development regulations would require a new facility like this. to be constructed and configured in a different manner. There are several aspects of the existing development that are considered nonconforming when compared to current City development standards. These items are as follows: Parking — There are 85 existing vehicle parking spaces. The applicant proposes 16 additional spaces for a total of 101 parking spaces. Current City standards would require 135 parking spaces. In. addition, 66 of the existing spaces are located within public street right-of-way. Current standards would require complete and total off-street parking. Building Setbacks — The City's Zoning Ordinance stipulates minimum setbacks for this type facility of Front — 25', Side — 20', and Rear — 20'. Five of the nine existing buildings encroach, to varying degrees, into setback areas. Existing building setbacks are Front — 15', Side - Y, and Rear — 5' Number of Dwelling Units per Acre — There are currently 57 dwelling units on approximately 1.83 acres of land. This calculates to a density of 31 dwelling units per acre. -Current City standards allow up to 27 dwelling units per acre in an R 3 (multi -family residential) zoning district Landscaping — There is little to no landscaping presently at the facility. Current City standards would require 6% of the site to be landscaped with trees, shrubbery, and groundcover. In addition, landscaping should be maintained in a healthy state. Discussion: If a building or facility is constructed in accordance with the development ., standards, ordinances or policies that are in affect at that time, any changes or modifications in City development standards would create a situation commonly referred to as "pre-existing nonconforming". Section 106-262 of the City's Code of Ordinances addresses non -conforming structures. In this case, paragraph (h) would apply because the structure has been abandoned longer than the 180 consecutive. calendar days stipulated in this section of the City Code. In addition, Section 106-268 addresses non- conforming lots of record. The applicant has been notified of the Boad of Adjustment January 27, 2000 #NCS 2000-001 Page 3 of 5 previously discussed non -conforming aspects of this project. Options available to address each one are as follows: Parking — Currently there are 85 parking spaces surrounding the complex. The applicant proposes to construct an additional 16 off-street parking spaces within an open area at the southwest corner of the complex making the total 101 spaces. Current development standards require 135 spaces or an additional 34. In addition, current standards require that all parking be off-street. There is no area within the 1.83 acre site to accommodate additional parking. An option available to the applicant to achieve the 135 required parking spaces requires acquiring additional land from the vacant areas surrounding this facility. With regard to the use of public right-of- way for parking, the layout at Flamingo Bay requires parked vehicles to back into the adjacent streets. This would occur on a daily basis and create a traffic safety issue. The only cure for this non -conformity would be to acquire enough adjacent property to accommodate all the parking on -site. Building Setbacks — As stated earlier, 5 of the 9 buildings encroach into current required setback areas. Physically moving or relocating the buildings is not a reasonable solution. However, setback requirements could be accomplished by acquiring additional property around the boundary of the site. On the west side, additional land could be acquired from the property owner: Number of Dwelling Units per Acre — There are currently 57 dwelling units on a 1.83 acre site. This calculates to a density of 31 units per acre. There are two directions available to remedy this nonconformity. The first requires the elimination of 7 dwelling units within the existing 1.83 acre site which creates a conforming density of 27 units pre acre. The second alternative would be to gain approximately 12,245 square feet of land and apply to the existing 57 units. This again would create a conforming density of 27 units per acre. Landscaping — Current development standards require 6% landscaping. .. There currently is little to no landscaping for this site. The site plan submitted by the applicant shows a significant amount of proposed landscaping estimated to -be approximately 12% to 15%. Recommendation: Parking — Staff research concludes that previously, while occupied, vehicles were using the opposite side of the street along Garfield, Forest, and Oregon as parking and that this activity was occurring on a daily Board of Adjustment January 27, 2000 #NCS 2000-001 Page 4 of 5 basis. This would indicate that additional parking is needed, probably beyond the 16 spaces proposed by the applicant. For this facility, 135 on - site spaces should be available for parking. Building Setbacks — Gaining compliance in this area would not provide a measurable benefit. Acquiring additional property to meet the building setback provisions is not recommended. Number of Dwelling Units per Acre — The submitted proposal does include a playground and recreational amenities along with a new Gazebo which would provide some activity centers for the occupants. Current development standards limit buildable area or lot coverage to 600/0. Flamingo Bay has a lot coverage of 32% which would indicate that there is a sufficient amount of open space within this site. The number of dwelling units per acre or density of this site has previously not had an adverse affect on utility service. For these reasons, reducing the dwelling units per acre from 31 to 27 is not recommended. Landscaping — The proposed plan submitted by the applicant shows a sufficient amount of landscaping distributed around the buildings and throughout the site. A recommendation would be to include additional landscaping around buildings #2, #4, and #7 to enhance the appearance from the adjacent streets and provide some relief from the setback encroachment. In addition, all landscaped areas should have a sprinkler system to ensure healthy, sustainable plants. Conclusions: Of all the nonconforming issues discussed in this report the most critical is the deficiency in parking. While occupied, the existing amount of Parking was not adequate for residents and visitors which resulted in overflow parking onto the adjacent streets. This created an unsafe situation with through traffic having to maneuver around parked vehicles. In addition, vehicles backing into the streets would not have as much room to maneuver. The Planning Director's recommendations are as follows: • Re4uire the applicant to provide 135 on -site (off-street) parking spaces. • Accept the existing building setback encroachments. • Accept the existing number of dwelling units per acre. Board of Adjustment January 27, 2000 #NCS 2000-001 Page 5 of 5 • Accept the applicant's landscape plan as being sufficient to meet current City requirements. Include a provision to provide some landscaping around buildings #2, #4, and #7. Include a provision to provide irrigation for all landscaping. The cost of tearing down the buildings and removing ant the debris would be very high. The value of the remaining land would probably not even cover the cost of demolition. Lakeside Is committed to saving housing units at a price which allow them to remain affordable to people who make lees than 80% of the mean Income in the county. For a couple this will be around S 28,000 and for a family of four about $ 38.000. These are not the destitute and poor. These people are school teachers raising a child, rookie pages and firemen, young couples just starting their lives, grocery clerics, secretaries, andcity workers. The Notice stated the Environmental Review Record is on file at 455 East Beach Rd Suite 209, Galveston, TX, 77553 and is available for copying. On the afternoon of October 4, 1999, a staff member drove to Galveston and attempted to find 455 East Beach Rd. Suite 209 to obtain a copy -of the - Environmental Review Record. However, after review of the Statutory Cheddist, there is one category, State and Local'Statutes, that the City needs to comment on. - There are several aspects of the Flamingo Bay Apartments that are considered nonconforming by current zoning ordinance provisions. The attached excerpt from the Cis Code of Ordinances, Sections 106-261, 106-262, and 106-288 addresses these nonconformides. Section 109- 262 (h). Our architect, Ron Kent, met with you yesterday and sold that you indicated that this could happen as early as December 8, 1999. While we understand that the meeting must be advertised, and notices sent to citizens living within a certain radius of the project, we would appreciate it very much if the meeting could, in fact be held on this date. The proposed project, as you know, Is for the rehabilitation of an existing, 57-unit apartment complex known as the Flamingo Bay Apartments. In addition to the rehabilitation of the structures, we are also adding parking spaces, landscaping, a playground area, gazebo, and replacing the existing root structure. Dear Mr. Chant: City of La Porte Established 1892 On January. 27, 2000, the Zoning Board of Adjustment will be hearing a request from Lakeside Center, Inc. on the proposed rehabilitation of property known as the Flamingo Bay Apartments. My office first met with representatives of the Lakeside Center on September 2,1998. During this meeting they shared their thoughts about acquiring and renovating the Flamingo Bay. complex. I informed the representatives that the City has had a bad experience with this. property and that I wanted the City to pursue condemnation of the complex. This apartment project was not a good neighbor to the community in its later years and was visited frequently by the QVs Police and Code Enforcement personnel. Even knowing of this position, Lakeside Center still wanted to move forward with their plans and sought a letter from the City they could forward to a State agency showing a need for affordable to low-income rents in La Porte. The letter was needed on a very short timeline so that an application packet could be prepared and submitted. On September 9, .1998, my office forwarded such a letter. The letter did not endorse their proposal. The letter recognized that the apartment units needed improvements and better management, that zoning was appropriate, and that our City is in need of clean, safe, and decent housing for low-income families. In an effort to meet the submission timeline that Lakeside Center was under, staff did not expend City resources to study their preliminary concept, nor were there any development plans to review. Lakeside Center's I & Porte proposal was unfunded at the time. P.O. We were not presented with any site plans or construction documents. Their initial visit was solely to 'help them obtain a letter from the City showing our community was in need of affordable housing for low-income working families, to attach to an application. The September 9,1998, letter never was intended to be interpreted as an approval by my office or by the City Council for Lakeside Center, Ins.'s proposed project. Also, the letter was not intended to waive any permits, building codes, or City development standards. To waive any of these attributes would not provide the renters with the same level of standards we require of other builders and developers who compete in this field. . I believe there is a need within our community for decent housing at. affordable rents. Lakeside Center, Inc. appears to have the prior experience to do this type of venture.
