CALL TO ORDER. Vice-Chairman George Maltsberger called the meeting to order at 6:00 p.m, 2. APPROVE MINUTES OF THE MARCH 23, 2006, MEETING. Minutes of the meeting were approved as presented. 3. CONSIDER VARIANCE REQUEST #V06-002 FOR PROPERTY LOCATED AT 728 S. CARROLL STREET, FURTHER DESCRIBED BY THE HARRIS COUNTY APPRAISAL DISTRICT AS LOTS 45 & 46, BLOCK 22, BAY FRONT ADDITION TO LA PORTE, JOHNSON HUNTER SURVEY, ABSTRACT 35, LA PORTE, HARRIS COUNTY, TEXAS. THE APPLICANT SEEKS VARIANCES TO ALLOW AN EXTRA HEIGHT AND OVERSIZED DETACHED GARAGE WITH A 41' WIDE DRIVEWAY, PROHIBITED BY THE CODE OF ORDINANCES. THESE VARIANCES ARE BEING SOUGHT UNDER THE TERMS OF SECTION 106-191(B) OF THE CITY'S CODE OF ORDINANCES. A. STAFF PRESENTATION Wayne Sabo presented Staff's Report. The applicants, Robert and Krista Britt, have requested a variance to the maximum allowable height requirements, maximum allowable floor area requirements, and maximum allowable driveway width requirements for property located at 728 S. Carroll Street. 17 property owners located within 200 feet of the subject tract were sent notification of the public hearing. Five responses were received favoring the variance, B. PROPONENTS Vice-Chairman Maltsberger swore in Robert Britt, 730 S. Carroll. Mr, Britt provided a brief history of the subject property. He plans to utilize the garage for storage of his personal vehicles and a boat. The height variance being requested is the same height as his home, C. OPPONENTS No opposition was presented. Motion by Bob Capen to approve Variance #V06-002 for property located at 728 S. Carroll Street for construction of a two-story garage for storage of private personal cars and storage on the second story, The proposed structure shall not exceed 25' in height. The maximum floor area shall not exceed 1,435 sq. ft. The variance also allows construction of a 41' driveway to service the garage. Second by Rod Rothermel. CONSIDER APPEAL OF THE BUILDING OFFICIAL'S DECISION #A06-002 FOR PROPERTY LOCATED AT 628 N. 5TH STREET, FURTHER DESCRIBED BY THE HARRIS COUNTY APPRAISAL DISTRICT AS LOTS 3 AND 4, BLOCK 331, TOWN OF LA PORTE, JOHNSON HUNTER SURVEY, ABSTRACT 35, LA PORTE, HARRIS COUNTY, TEXAS. THE APPLICANT SEEKS APPROVAL TO REINSTATE THE RESIDENTIAL USE OF AN ABANDONED NONCONFORMING STRUCTURE PROHIBITED PER SECTION 106-262 (H)(1) OF THE CODE OF ORDINANCES. THIS APPEAL IS BEING MADE UNDER THE PROVISIONS OF SECTION 106-89 OF THE CITY'S CODE OF ORDINANCES. A. STAFF PRESENTATION Mr, Sabo presented Staff's Report, The applicant, Andrew Mehring, has appealed the Building Official's decision to apply Code of Ordinances Division 9, Nonconforming Buildings, Structures, and Uses, Sections 106-261, 106-262 to the existing building at 628 N, 5th Street. The property is currently zoned Business Industrial. As a pre-existing nonconforming structure abandoned in excess of 180 days, the nonconformity ceases and is not allowed to resume, B. PROPONENTS Vice-Chairman Maltsberger swore in Andy Mehring, of 911 Ridgefield Lane, Houston, Texas. Mr. Mehring purchased the property June 6, 2005, and had plans to rehabilitate it. He had the house re-Ieveled and the wiring and plumbing need updating. On November 8, 2005, he had water turned on at the property, not the house. On November 16, 2005, he was made aware of the property's nonconforming status. Mr. Mehring intends to lease the property or reside there himself. His investment is approximately $20,000. C. OPPONENTS There were none. Motion by Rod Rothermel to sustain the Building Official's decision to not allow reinstatement of the residential use of the abandoned nonconforming structure located at 628 N. 5th Street. Second by Charles Schoppe, The motion carried. Lots 7 & 12, Block 14, Sylvan Beach 1 sl Addition, Johnson Hunter Survey, Abstract No. 35, La Porte, Harris County, Texas. 221 and 201 Forest Ave. Low Density Residential (R-1) In July 2005, the applicant received a property survey that identified the size of this property (50'x125') 6,250 square feet for each lot. The property is further described as Lots 7&12, Block 14, Sylvan Beach 1 sl Addition, Volume 3, Page 72, Map Records of the Harris County, Johnson Hunter Survey, Abstract No. 35, La Porte, Harris County, Texas. (See Exhibit B). The subject lots are located at the northeast comer of Forest Avenue at Oregon A venue (a.k.a Willow Ave.) and northwest comer of F orest Avenue at Park Drive. Due to comer lots, total area of each lot equals 6,202 sq. ft. In reviewing the survey, there was no mention of building lines and/or required yard setbacks. The applicant proceeded with selecting a home design and the development of construction plans. The proposed house plans provided to the City allowed a five-foot (5') setback for both side yards. (See Exhibit C). In developing a comer lot, zoning regulations require a minimum ten-foot (10') setback on the side that adjoins a public right-of-way (Oregon Avenue). (See Exhibit D). To develop in the Low-Density Residential (R-1) zoning district, the City's minimum 50' lot width and minimum lot area of 6,000 sq. ft. are needed. In addition, minimum yard setbacks are Front 25', Rear 15', and Sides 5' (adjacent to public right-of-way 10'). The lots meet these requirements; however, as a comer lot, it cannot meet the required 10' side lot setback when adjacent to the public right-of-way. The plan is to build a 1958 sq. ft. and 2,199 sq.ft. area with a width of approximately 40'(Exhibit B). After the required 5' setback is added to the east side of the property, the 10' side setback requirement at Oregon Avenue and Park Drive cannot be met. Therefore, the developer is requesting a 5' yard exception to the side yard setback requirement on these comer lots. Board of Adjustment November 15,2006 #SE 06-004,005 Page 2 of3 Analvsis: Conclusion: The Code of Ordinances defines a special exception as a specified enumerated deviation from zoning regulations. The Board is empowered to grant a special exception when it finds the following: .:. Granting the exception will not adversely affect the value, or use of neighboring property. .:. Granting the exception will not be contrary to the best public interest. The applicant's request is based on Section 106-191 (b )(2)( c), which states the following: . To deviate yard requirements in the following circumstances: a yard exception on corner lots. Contributing factors played a role in creating this situation. The initial factor was the property survey's lack of reference regarding building setback requirements and subsequently, the developer did not contemplate the requirement for 10' side building lines on comer lots. The developer has stated that, there are number of structures built in the area having 5' side building lines and allowing an exception to the side setback would not create a visual obstacle for vehicular traffic or motorists. For similar reasoning and for neighborhood consistency, Section 106-191 (b )(2)( c) provides the flexibility or relief needed to address the challenge being faced on these comer lots development. The Board is charged with deciding whether the applicant's request for a five-foot (5') comer lot yard exception is "reasonable" and that granting the special exception will not adversely affect the value and use of adjacent or neighboring property, or be contrary to the public's best interest. The application merits review by the Board based upon the parameters set by the Ordinance. The Board may consider: . Granting a Special Exception for 221 Forest Avenue (Lot 7, Block 14) and allowing a 5' side yard setback along Oregon Avenue. · Granting a Special Exception for 201 Forest Avenue (Lot 12, Block 14) and allowing a 5' side yard setback along Park Drive. In addition, a 1.36 ac. tract is undeveloped and has access along North P Street. . The applicant wants to subdivide the property in its present shape to build another house on the undeveloped parcel of land. . The subject property is currently zoned Large Lot Residential District (LL). . Large Lot District was created due to large acreage in particular and suburban/rural type of developments in Lomax. . Provisions of the current ordinance require minimum lot size to be one acre (43560 sq.ft.) and minimum lot width as 90'. · On February 23, 2006, the La Porte Zoning Board of Adjustment considered Special Exception Request #SE06-001. The Board approved an exception to the lot size (minimum one acre) for Large Lot District to allow proposed subdivision and single-family residency with the stipulation that the subject property (1.86 ac.) is divided evenly, and each lot shall have a minimum of 94 foot frontage along the public roadway (North P Street). However, there was no action taken by the applicant in this regard. In addition, the applicant did not file a petition to appeal to District Court within the stipulated period (10 days) after the decision of the Board. Board of Adjustment November 15,2006 #SE 06-006 Page 2 Analvsis: Non-Conformities: Sect. 106-261 is the beginning of the "nonconforming" section in the Zoning Ordinance and the opening paragraph provides guidance regarding the intent of these regulations. "The general public, the Planning and Zoning Commission and the Board of Adjustment are directed to take note that nonconformities in the use and development of land and buildings are to be avoided, or eliminated where now existing, wherever and whenever possible,". . .. Consequences of the proposed subdivision are as follows: Section 106-416(a) - Minimum lot size is one acre (43560 sq. ft.). The total subject property is 1.86 acres. With the proposed subdivision, one lot would be approx. 1.36 acres and the other lot, with an existing house, will be 0.5 acres; creating a nonconforming lot. Section 106-416(b) - Minimum lot width is 90'. With the current proposal, the existing house has a lot width of approx.140'along North 'P' Street. The proposed lot would have a width of approx. 48' along North 'P' Street, creating a non-conformity. The Code of Ordinances defines a Special Exception as a specified enumerated deviation from zoning regulations. The Board is empowered to grant a Special Exception when it finds the following: a. that one or more lots located in the same block as the subject property are not uniform in terms of shape and/or size so that any further subdivision of the subject property cannot be in accordance with the regulations governing the District; b. it can be demonstrated that the subdivision will not circumvent the spirit of the District regulations, or particularly, the rural character of the District; and, c. granting the Special Exception will not be injurious to the value or enjoyment of adjacent properties within the District. The applicant's request is based on Section 106-191 b (4) of the Code of Ordinances, which states the following: · To deviate from the minimum lot size or width requirements in the large lot district. The applicant cited personal reasons for this request. Provisions of Section 106-191 provide the flexibility/relief for development challenges. The parameters for the requested special exception may meet the provisions established by Section 106-191 of the Code of Ordinances. The application merits review by the Board based upon the parameters set by the Ordinance. The Board may consider: y Approving Special Exception and allowing the subdivision of property as follows: a) lot with existing house to be 0.5 acre with 140' width, and b) lot for future home to be 1.36 acres with only 48' width. y Denying Special Exception will revert to the Board's decision made on February 23,2006.
