Special Exception Request #SE06-004 & 005
Bayway Homes, Inc.
Lots 7 & 12, Block 14, Sylvan Beach 1 sl Addition, Johnson Hunter Survey,
Abstract No. 35, La Porte, Harris County, Texas.
221 and 201 Forest Ave.
Low Density Residential (R-1)
In July 2005, the applicant received a property survey that identified the size
of this property (50'x125') 6,250 square feet for each lot. The property is
further described as Lots 7&12, Block 14, Sylvan Beach 1 sl Addition,
Volume 3, Page 72, Map Records of the Harris County, Johnson Hunter
Survey, Abstract No. 35, La Porte, Harris County, Texas. (See Exhibit B).
The subject lots are located at the northeast comer of Forest Avenue at
Oregon A venue (a.k.a Willow Ave.) and northwest comer of F orest Avenue
at Park Drive. Due to comer lots, total area of each lot equals 6,202 sq. ft.
In reviewing the survey, there was no mention of building lines and/or
required yard setbacks. The applicant proceeded with selecting a home
design and the development of construction plans. The proposed house
plans provided to the City allowed a five-foot (5') setback for both side
yards. (See Exhibit C). In developing a comer lot, zoning regulations
require a minimum ten-foot (10') setback on the side that adjoins a public
right-of-way (Oregon Avenue). (See Exhibit D).
To develop in the Low-Density Residential (R-1) zoning district, the City's
minimum 50' lot width and minimum lot area of 6,000 sq. ft. are needed. In
addition, minimum yard setbacks are Front 25', Rear 15', and Sides 5'
(adjacent to public right-of-way 10'). The lots meet these requirements;
however, as a comer lot, it cannot meet the required 10' side lot setback
when adjacent to the public right-of-way. The plan is to build a 1958 sq. ft.
and 2,199 sq.ft. area with a width of approximately 40'(Exhibit B). After the
required 5' setback is added to the east side of the property, the 10' side
setback requirement at Oregon Avenue and Park Drive cannot be met.
Therefore, the developer is requesting a 5' yard exception to the side yard
setback requirement on these comer lots.

Analvsis:
Conclusion:
The Code of Ordinances defines a special exception as a specified
enumerated deviation from zoning regulations. The Board is empowered to
grant a special exception when it finds the following:
.:. Granting the exception will not adversely affect the value, or use of
neighboring property.
.:. Granting the exception will not be contrary to the best public interest.
The applicant's request is based on Section 106-191 (b )(2)( c), which states
the following:
. To deviate yard requirements in the following circumstances: a yard
exception on corner lots.
Contributing factors played a role in creating this situation. The initial factor
was the property survey's lack of reference regarding building setback
requirements and subsequently, the developer did not contemplate the
requirement for 10' side building lines on comer lots. The developer has
stated that, there are number of structures built in the area having 5' side
building lines and allowing an exception to the side setback would not create
a visual obstacle for vehicular traffic or motorists. For similar reasoning and
for neighborhood consistency, Section 106-191 (b )(2)( c) provides the
flexibility or relief needed to address the challenge being faced on these
comer lots development.
The Board is charged with deciding whether the applicant's request for a
five-foot (5') comer lot yard exception is "reasonable" and that granting the
special exception will not adversely affect the value and use of adjacent or
neighboring property, or be contrary to the public's best interest.
The application merits review by the Board based upon the parameters
set by the Ordinance.
The Board may consider:
. Granting a Special Exception for 221 Forest Avenue (Lot 7, Block 14)
and allowing a 5' side yard setback along Oregon Avenue.
· Granting a Special Exception for 201 Forest Avenue (Lot 12, Block 14)
and allowing a 5' side yard setback along Park Drive.
Board of Adjustment
November 15, 2006
#SE 06-004,005
Page 3 of3
Avveals:
. Denying the Special Exception Requests thereby results reinstating 10'
side yard setbacks on a comer lot adjacent to public right-of-way.
As per Section 106-196 of the Code of Ordinances of the City of La Porte:
Any person or persons, jointly or severally, aggrieved by any decision of the
Board of Adjustment, or any taxpayer, or any officer, department, board or
bureau of the city may present to a court of record a petition for a writ of
certiorari, as provided by V T CA" Local Government Code Section
211.011, duly verified, setting forth that such decision is illegal, in whole or
in part, specifYing the grounds of the illegality. Such petition shall be
presented to the court within ten days after the filing of the decision in the
office of the Board of Adjustment.

Special Exception Request #SE06-006
Requested by: Frankie Periou, Property Owner
Requested for: Lot Size and Lot Width requirements in the Large Lot District
Location: 11318 North P Street
Lee:al Description: TRS 311 A, 311 B, & 311 C, La Porte Outlots
Zonine:: Large Lot District (LL)
Back2round:
. The applicant owns 1.86 acre tract located at 11318 North P Street in
Lomax area.
. Existing house has a fenced yard and occupies approx. 0.5 acre lot. In
addition, a 1.36 ac. tract is undeveloped and has access along North P
Street.
. The applicant wants to subdivide the property in its present shape to
build another house on the undeveloped parcel of land.
. The subject property is currently zoned Large Lot Residential District
(LL).
. Large Lot District was created due to large acreage in particular and
suburban/rural type of developments in Lomax.
. Provisions of the current ordinance require minimum lot size to be one
acre (43560 sq.ft.) and minimum lot width as 90'.
· On February 23, 2006, the La Porte Zoning Board of Adjustment
considered Special Exception Request #SE06-001. The Board
approved an exception to the lot size (minimum one acre) for Large
Lot District to allow proposed subdivision and single-family residency
with the stipulation that the subject property (1.86 ac.) is divided
evenly, and each lot shall have a minimum of 94 foot frontage along
the public roadway (North P Street). However, there was no action
taken by the applicant in this regard. In addition, the applicant did not
file a petition to appeal to District Court within the stipulated period
(10 days) after the decision of the Board.

Analvsis:
Non-Conformities: Sect. 106-261 is the beginning of the "nonconforming"
section in the Zoning Ordinance and the opening paragraph provides
guidance regarding the intent of these regulations. "The general public, the
Planning and Zoning Commission and the Board of Adjustment are directed
to take note that nonconformities in the use and development of land and
buildings are to be avoided, or eliminated where now existing, wherever and
whenever possible,". . ..
Consequences of the proposed subdivision are as follows:
Section 106-416(a) - Minimum lot size is one acre (43560 sq. ft.). The total
subject property is 1.86 acres. With the proposed subdivision, one lot would
be approx. 1.36 acres and the other lot, with an existing house, will be 0.5
acres; creating a nonconforming lot.
Section 106-416(b) - Minimum lot width is 90'. With the current proposal,
the existing house has a lot width of approx.140'along North 'P' Street. The
proposed lot would have a width of approx. 48' along North 'P' Street,
creating a non-conformity.
The Code of Ordinances defines a Special Exception as a specified
enumerated deviation from zoning regulations. The Board is empowered to
grant a Special Exception when it finds the following:
a. that one or more lots located in the same block as the subject
property are not uniform in terms of shape and/or size so that any
further subdivision of the subject property cannot be in accordance
with the regulations governing the District;
b. it can be demonstrated that the subdivision will not circumvent the
spirit of the District regulations, or particularly, the rural character of
the District; and,
c. granting the Special Exception will not be injurious to the value or
enjoyment of adjacent properties within the District.
The applicant's request is based on Section 106-191 b (4) of the Code of
Ordinances, which states the following:
· To deviate from the minimum lot size or width requirements in the large
lot district.
The applicant cited personal reasons for this request. Provisions of
Section 106-191 provide the flexibility/relief for development challenges.
The parameters for the requested special exception may meet the provisions
established by Section 106-191 of the Code of Ordinances.
Board of Adjustment

#SE 06-006
Page 3
Conclusion:
Appeals:
The applicant's request does not constitute a conventional subdivision of
land.
The application merits review by the Board based upon the parameters set by
the Ordinance. The Board may consider:
y Approving Special Exception and allowing the subdivision of
property as follows: a) lot with existing house to be 0.5 acre with
140' width, and b) lot for future home to be 1.36 acres with only 48'
width.
y Denying Special Exception will revert to the Board's decision made
on February 23,2006.
As per Section 106-196 of the Code of Ordinances of the City of La Porte:
Any person or persons, joint~v or severally, aggrieved by any decision of the
Board of Adjustment, or any taxpayer, or any officer, department, board or
bureau of the city may present to a court of record a petition for a writ of
certiorari, as provided by V T CA., Local Government Code Section
211.011, duly verified, setting forth that such decision is illegal, in whole or
in part, specifYing the grounds of the illegality. Such petition shall be
presented to the court within ten days after the filing of the decision in the
office of the Board of Adjustment.

A Special Exception is a deviation from the requirements of the Zoning Ordinance. Before they
grant a special exception, The Board of Adjustments must determine that the exception is not
contrary to the best public interest and will not adversely affect the value or use of adjoining
property.
Special exceptions may be granted for the following items only:
1) The reconstruction of or addition to a building occupied by a non-conforming use.
Additions cannot extend past the lot occupied by the original structure or use. The
reconstruction or use cannot prevent the property from returning to a conforming use.
2) Deviation of yard requirements under the following circumstances.
a) Exceptions to front yard requirements if front yard setbacks are not met on abutting
pieces of property.
b) Exception to rear yard setbacks if any four (4) lots within a block do not meet
setback requirements.
c) Exceptions to yard requirements on corner lots.
d) Exceptions to front yard requirements if existing front yard setbacks on a block are
not uniform.
3) Waiving or reduction of off street parking and loading requirements if the Board feels
they are unnecessary for the proposed use of a building or piece of property.
Please remember it is the Applicant's responsibility to prove that a Special Exception will meet
the above conditions.
If there is not adequate room on the remainder of this form to list all pertinent information,
please feel free to attach an additional letter or any information and exhibits you feel the Board
should consider.

To Whom It May Concern:
I respectively request consideration for two exceptions from the Board.
1. Less than 1 acre
2. Less than 90 feet
I decided to send letters to people in Lomax to ask their opinion, rather than ask a few to
appear before you. These were letters to addresses from the tax role. I did not look to
see if! knew them. These are true opinions of people I do not know. As you can see
from the attached letters, it was overwhelmingly in favor of the exceptions. The letters
are still coming in because I was not sure when we would appear before you. I will send
the additional letters before we appear.
My residence is 11318 North P Street in Lomax. My husband, Bobby, passed away April
9,2004. As a result, it has become increasingly difficult to maintain the yard and
pasture. Frequent mowing of both areas presents an undo hardship, both financially and
physically. As I grow older, I know the task will become even harder.
I would like my daughter and son-in-law to build their home on the property. As you can
see from the attached documents, they have a separate drive coming in from P Street. I
would like to keep my fenced yard. It is a chore to maintain, but the grandkids enjoy the
yard.
If my family lived behind me, I would be able to grow old in the last home Bobby and I
shared. I do not want to be forced from my home or to live with one of my children.
They would be close, but not too close. I do not want to give up my home. I firmly
believe my place is in my own home.
The spirit of the ordinance would not be broken. The exception will not adversely affect
the value or use of adjacent properties. The rural character of the District will remain.
The property would be intact with the family. Our original intention was to keep it in the
family after we were gone.
Thank you in advance for your time and consideration with this matter.
Sincerely,
~,(4~ 4itv

Dear Neighbor,
I am asking you to take a few moments to read this letter, give your opinion, sign, and return in the pre-paid
envelope.
I will soon go before the Zoning Board of Adjustments to request two exceptions trom the Large Lot
District Ordinance. 1) Less than I acre 2) Less than 90 feet
My husband, Bobby, passed away in 2004, As a result, it has become increasingly difficult to maintain the
fenced yard (1/2 acre) and the pasture (1.3 8 acres). Frequent care of both areas present an undo hardsh ip,
both physically and financially. As I get older, I know the task will become even harder.
I would like my daughter and son-in-law to build their dream home on the 1.38 acres. It has a separate
drive trom P Street and their house would be behind mine. I would like to keep the fenced area for my
grandchildren to play. Although it alone is a chore, the children enjoy it.
Family would be close, but I could maintain my own space. I would like to grow old in the last home
Bobby and I shared. [do not want to be forced trom my home because [ have too much to care for. I
finnly believe my place is in my little trame house.
The spirit of the ordinance would not be broken. The exceptions will not adversely affect the value or use
of the adjacent properties. The rural character of the District will remain in tact. I would be keeping the
land in the family as Bobby and I intended. The building of their home would not hann anyone, but greatly
help me and my family.
Hopefully, it will help our cause if we have written prooftrom our neighbors showing they approve of the
exceptions for my situation. I am not asking to change the ordinance, just consider my situation. Please
help by voting yes to the exceptions.
Thank you in advance for your time and consideration. Regardless of your opinion, your effort is greatly
appreciated.
Sincerely,
Frankie Periou

Family would be close, but I could maintain my own space. I would like to grow old in the last home
Bobby and I :shared. I do not want to be forced from my home because I have too much to care for. I
firmly believe my place is in my little frame house.
The spirit of the ordinance would not be broken. The exceptions will not adversely affect the value or use
ofthe adjacent properties. The rural character of the District will remain in tact. I would be keeping the
land in the family as Bobby and I intended. The building of their home would not harm anyone, but greatly
help me and my family.
Hopefully, it will help our cause if we have written prooffrom our neighbors showing they approve of the
exceptions for my situation. I am not asking to change the ordinance, just consider my situation. Please
help by voting yes to the exceptions.
Thank you in advance for your time and consideration. Regardless of your opinion, your effort is greatly
apprec iated.

Dear Neighbor,
I am asking you to take a few moments to read this letter, give your opinion, sign, and return in the pre-paid

I will soon go before the Zoning Board of Adjustments to request two exceptions trom the Large Lot
District Ordinance, I) Less than I acre 2) Less than 90 feet
My husband, Bobby, passed away in 2004. As a result, it has become increasingly difficult to maintain the
fenced yard (I/2 acre) and the pasture (1.38 acres). Frequent care of both areas present an undo hardship,
both physically and financially. As I get older, I know the task will become even harder.

drive trom P Street and their house would be behind mine. I would like to keep the fenced area for my
grandchildren to play. Although it alone is a chore, the children enjoy it.

land in the family as Bobby and I intended. The building of their home would not harm anyone, but greatly
help me and my family.
Hopefully, it will help our cause if we have written proof from our neighbors showing they approve of the
exceptions for my situation. I am not asking to change the ordinance, just consider my situation. Please
help by voting yes to the exceptions.
Thank you in' advance for your time and consideration. Regardless of your opinion, your effort is greatly

Dear Neighbor,
I am asking you to take a few moments to read this letter, give your opinion, sign, and return in the pre-paid
envelope.
I will soon go before the Zoning Board of Adjustments to request two exceptions from the Large Lot
District Ordinance. I) Less than I acre 2) Less than 90 feet
My husband, Bobby, passed away in 2004. As a result, it has become increasingly difficult to maintain the
fenced yard (1/2 acre) and the pasture (1.38 acres). Frequent care of both areas present an undo hardship,
both physically and financially. As I get older, I know the task will become even harder.
I would like my daughter and son-in-law to build their dream home on the 1.38 acres. It has a separate
drive from P Street and their house would be behind mine. I would like to keep the fenced area for my
grandchildren to play. Although it alone is a chore, the children enjoy it.
Family would be close, but I could maintain my own space. I would like to grow old in the last home
Bobby and I shared. I do not want to be forced from my home because I have too much to care for. I
firmly believe my place is in my little frame house.
The spirit of the ordinance would not be broken. The exceptions will not adversely affect the value or use

drive from P Street and their house would be behind mine.
The exceptions will not adversely affect the value or use
of the adjacent properties. The rural character of the District will remain in tact. I would be keeping the
land in the family as Bobby and I intended. The building of their home would not hann anyone, but greatly
help me and my family.
Hopefully, it will help our cause if we have written proof from our neighbors showing they approve of the
exceptions for my situation. I am not asking to change the ordinance, just consider my situation. Please
help by voting yes to the exceptions.
Thank you in advance for your time and consideration. Regardless of your opinion, your effort is greatly
appreciated.
Sincerely,
Frankie Periou

Dear Neighbor,
I am asking you to take a few moments to read this letter, give your opinion, sign, and return in the pre-paid
envelope.
I will soon go before the Zoning Board of Adjustments to request two exceptions from the Large Lot
District Ordinance. J) Less than I acre 2) Less than 90 feet
I would like to keep the fenced area for my
grandchildren to play, Although it alone is a chore, the children enjoy it.
Family would be close, but I could maintain my own space. I would like to grow old in the last home
Bobby and I shared. I do not want to be forced from my home because I have too much to care for. I
firmly believe my place is in my little frame house.
The spirit of the ordinance would not be broken. The exceptions will not adversely affect the value or use
of the adjacent properties. The rural character of the District will remain in tact. I would be keeping the
land in the family as Bobby and I intended.
Thank you in advance for your time and consideration. Regardless of your opinion, your effort is greatly
appreciated.
Sincerely,
Frankie Periou
