No.1), and Gilbert Montemayor (Alt. No.2) Members Absent: George Maltsberger Masood Malik, City Planner; Clark Askins, Assistant City Attorney; and Shaye Bradley, Secretary. Cltv Staff Present: 1. CALL TO ORDER. Acting Chairman Bob Capen called the meeting to order at 6:00 p.m. 2. CONSIDER VARIANCE REQUEST #V07-001 FOR THE PROPERTY LOCATED AT 214 JAMIE COURT, FURTHER DESCRIBED BY THE HARRIS COUNTY APPRAISAL DISTRICT AS LOT 15, BLOCK 1, SPENCER LANDING SUBDIVISION, SECTION 4, LA PORTE, HARRIS COUNTY, TEXAS. THE APPLICANT, NOEL ANDERSON, SEEKS A VARIANCE TO ALLOW CONSTRUCTION OF A PORTION OF A SWIMMING POOL WITH DECK WITHIN THE SIDE YARD. THIS VARIANCE IS BEING SOUGHT UNDER THE TERMS OF SECTION 106-192 (b) (2) OF THE CODE OF ORDINANCES. A. STAFF PRESENTATION Masood Malik presented the Staffs Report. The applicant, Mr. Noel Anderson, is requesting approval to construct a swimming pool at 214 Jamie Court. Mr. Anderson's request for a building permit was denied. The swimming pool design, as proposed by Blue Haven Pools, does not comply with the City ordinance requirement. Due to the narrowness of the yard directly behind the house and the unusual shape of the rear yard, a portion of the pool was designed to extend into the side yard. This exception is being requested under the terms of Section 106-192 (b) (2) of the City's Code of Ordinances. Twenty-four property owners located within 200 feet of the subject tract were sent notification of the public hearing. Four responses were received favoring and none opposing the request. B. PROPONENTS Acting Chairman Capen swore in Mr. Noel Anderson, of 214 Jamie Court. Mr. Anderson addressed the Board favoring the request. Mr. Anderson advised that he wanted to construct a swimming pool for him and his grandchildren to enjoy. Acting Chairman Capen swore in Mr. Sam Williams, representative for Blue Haven Pools. Mr. Williams addressed the Board favoring the request. Mr. Williams answered various questions from the Board regarding the shape of the swimming pool. C. OPPONENTS There were none. Zoning Board of Adjustment Minutes of March 1, 2007 Page 2 of 2 Motion by Charles Schoppe to approve Variance Request #V07 -001 for the property located at 214 Jamie Court to allow construction of a portion of a swimming pool with deck within the side yard. Second by Lawrence McNeal. The motion Carried. Ayes: Nays: Abstain: Rothermel, Shoppe, Capen, McNeal and Montemayor None None Assistant City Attorney, Clark Askins, read aloud from Section 106-196 of the Code of Ordinances, which addresses Appeals. 3. ADMINISTRATIVE REPORTS Masood Malik . Preliminary Plat for Lakes at Fairmont Greens Section 9 has been submitted. . Site Plan submittal for a commercial development of a strip center to be located at Driftwood and Fairmont Parkway have been submitted. 4. BOARD COMMENTS There were none. 5.
