Notice is hereby given of a regular meeting of the La Porte City Council to be held on September 22,
2025, at 6:00 p.m. in the City Hall Council Chamber, 604 West Fairmont Parkway, La Porte, Texas,
for the purpose of considering the following agenda items. All agenda items are subject to action.
1. Call to Order
The Mayor will determine that a quorum of Councilpersons is present and open the business
meeting.
2. Invocation and Pledges of Allegiance
INVOCATION - The invocation will be given by Rev. Brian Christen.
PLEDGES - Will be led by Faith Carrizal.

3. Citizen Comment
State law provides that members of the public may speak before the Council considers an
item of business. Complete a sign up sheet before speaking. (Generally limited to five
minutes per person; the time may be reduced if there is a high number of speakers or for
other considerations.) Members of the Council may ask questions or make statements of
fact in response to comments but are not obligated to respond and will not participate in
debate or take action during this portion of the agenda. Items may be requested for future
agendas in accordance with the adopted Rules of Procedure.
4. ConsentAgsnda
Approval of Consent Agenda items authorizes each to be implemented in accordance with
staff recommendations provided. An item may be removed from the Consent Agenda and
added to the Statutory Agenda for full discussion upon request by a member of the Council
present at this meeting.
4.a Approve the minutes of the regular City Council meeting hell on September 8, 2025.

4.b Ordinance 20254098 for Street and Alley Closure (SAC) Request #SAC-2024-0003
Adopt Ordinance 2025-4098 for approval of Street and Alley Closure (SAC) Request
#SAC-2024-0003 for the purpose of vacating, abandoning, and closing an
approximately 2,000 square foot portion of an undeveloped sixteen (16) foot alleyway
between Lots 1-5 and Lots 28-32 in Block 981 of the Town of La Porte, Harris
County, Texas, and authorizing the execution and delivery of a deed to the adjoining

4.c Adopt Ordinance 2025.4097
Adopt Ordinance 2025-4097, amending La Porte City Ordinance No. 1285 by
changing the number of authorized positions for police civil service personnel by
decreasing Patrolman classification positions from sixty-three (63) to sixty-two (62)
and increasing Sergeant classification positions from eleven (11) to twelve (12).

4.d Interlocal Agreement - Hams County Housing Community Development
Authorize the City Manager to execute an Interlocal Agreement between Harris
County and City of La Porte for construction of sidewalk improvements and a
commitment of La Porte to fund the project at $1,588,616.19, which will be
reimbursed by Harris County at 100%. [Jameson Appel, Assistant Director of Public

4.e Alliance Water and Sewer Service Agreements
Adopt Ordinance 2020-IDA-142,and authorize the City Manager to execute one
Water Service Agreement and one Sanitary Sewer Service Agreement between the
City of La Porte, Texas, and Alliance, LP for its proposed development at 13200
Baypark Rd. in the Bayport Industrial District. [Andrew Brady, Assistant Director of

4.f Award Bid #25018 for Paving Materials
Award Bid 25018 "Asphalt: Type D and Black Base" to Vulcan Materials, Inc. and
authorize the City Manager to execute a purchasing contract for $136,400.00 to
supply paving materials to the City of La Porte, Texas, not to exceed contract

4.g Adopt Resolution 2025-24 for STEP Comprehensive Grant
Adopt Resolution 2025-24, authorizing the City Manager to sign the Texas Dept. of
Transportation S.T.E.P. Comprehensive Grant Award for the TXDOT S.T.E.P.

4.h Adopt Resolution 2025-25 for the STEP TXDOT Commercial Vehicle Grant
Adopt Resolution 2025-25, authorizing the City Manager to sign the Texas Dept. of

Adopt Resolution 2025-26 accepting the 2025 Harris County Appraisal Districts

Authorize the City Manager to execute an Interlocal Agreement between the City of
La Porte and the Reinvestment Zone Number One, City of La Porte, to bid, construct
and manage renovations and improvements to the wave pool located at 600 Little
Cedar Bayou Dr., La Porte, TX. [Matt Daeumer, Assistant City Manager]
5. Public Hearings and Associated Ordinances
State law provides for public hearings on particular items, such as the annual City budget,
tax rate, and some land use decisions. Members of the public may speak when the presiding
officer calls for comments, without signing up in advance. (Generally limited to five minutes
per person; in accordance with state law, the time may be reduced if there is a high number
of speakers or for other considerations)
Members of the Council may ask questions or make statements of fact in response to
comments but are not obligated to respond and will not participate in debate or take action
until the public hearing is closed and the item is placed before them for consideration.
5.a Ordinance 2025.6000 Special Conditional Use Permit (SCUP) #SCUP-2025-=4
The City Council will hold a public hearing to receive comments regarding a
recommendation by the Planning and Zoning Commission to approve Special
Conditional Use Permit (SCUP) #SCUP-2025-0024 to allow a gasoline with
convenience store (NAICS Code 44711) within the General Commercial (GC) zoning
district on approximately 0.3 acres of land located at 922 S. Broadway St., La Porte,
Harris County, Texas; followed by discussion and possible action to approve or deny
Ordinance 2025-5000 for Special Conditional Use Permit (SCUP) #SCUP-2025-0024
to allow a gasoline with convenience store (NAICS Code 44711) within the General
Commercial (GC) zoning district on approximately 0.3 acres of land located at 922 S.

5.b Ordinance 2025-5001 Chapter 106 (Zoning) Amendment
The City Council will hold a public hearing to receive comments regarding a
recommendation by the Planning and Zoning Commission to approve amendments to
Chapter 106 "Zoning" of the Code of Ordinances of the City of La Porte, Texas, by
adding a definition for "administratively approved," revising timing requirements for
public hearings, clarifying application and hearing procedures, aligning criteria with
state law, updating screening and parking standards, and correcting references to
ensure consistency with current practices; followed by discussion and possible action
to approve or deny Ordinance 2025-5001 amending Chapter 106 "Zoning" of the
Code of Ordinances of the City of La Porte, Texas, by adding a definition for
"administratively approved," revising timing requirements for public hearings,
clarifying application and hearing procedures, aligning criteria with state law, updating
screening and parking standards, and correcting references to ensure consistency

6. Statutory Agenda
Councilpersons will engage in debate in accordance with their adopted parliamentary
authority. Members of the public may be permitted to answer questions from the Council or

provide information if requested by the Council (either without objection or on a majority vote
in favor).
6.a Property Tax Rate
Presentation, discussion, and possible action to adopt Ordinance 2025-5002, setting
the City of La Porte, Texas' ad valorem tax rate and levying taxes on taxable property
located in the City of La Porte, Texas, for the 2025-26 Fiscal Year. [Michael Dolby,

6.b Planning and Zoning Commission Rules Amendments
Presentation, discussion, and possible action to approve the recommendation by the
Planning and Zoning Commission to adopt revisions to the Rules, Regulations, and
Bylaws of the City of La Porte, Texas, Planning and Zoning Commission, by adding
new section regarding decorum of commissioners and the public during meetings,
and revisions incorporating changes in state law regarding notice of meetings and

6.c Employee Handbook Revision - Physical Report Status and Nepotism
Presentation, discussion, and possible action to approve a proposed updates to the
City of La Porte Employee Policies Handbook section 7.08 - Physical Report Status

6.d Meet and Corder Agreement
Presentation, discussion, and possible action to approve the proposed Meet and
Confer Agreement between the City of La Porte and the La Porte Police Officers

Presentation, discussion, and possible action approve the selection of the City's post-

to the La Porte Rotary Foundation for the 2025 La Porte Rotary Reverse Draw in an

6.g Presentation, discussion, and possible action to select a candidate for the Texas

8. Items of Community Interest

Per Texas Gov't. Code Sec. 551.0415, the Council may receive from staff and/or may make
a report about items of community interest during a meeting without having given notice of
the subject of the report, if no action is taken and, except as provided by Section 551.042,
possible action is not discussed regarding the information provided in the report. Hear
announcements concerning matters appearing on the agenda; items of community interest;
and/or inquiries of staff regarding specific factual information or existing policy from the
Mayor, Councilpersons, and City staff, for which no formal action will be discussed.
9. Executive Session
The portion of the Texas Gov't. Code known as the Texas Open GovY. Act (TOMA, TGC Ch.
551) provides a limited set of circumstances that allow the Council to meet in a session
closed to the public. The Council will first meet in an open session, announce the exception
that allows it to meet in a closed session, and announce the time it is convening in closed
session. The Council will post executive sessions it is aware of in advance, but may go into
an executive session if a situation arises during a meeting that calls for an appropriate
exception.
The Council will convene in executive session without a vote unless an objection is raised by
a member of the Council.
If, during the course of the meeting and discussion of any items covered by this notice, City
Council determines that a closed or executive session of the Council is required, then such
closed meeting will be held as authorized by Texas Government Code, Chapter 551, Section
551.071 consultation with counsel on legal matters; Section 551.072 - deliberation regarding
purchase, exchange, lease or value of real property, Section 551.073 - deliberation
regarding a prospective gift; Section 551.074 - personnel matters regarding the appointment,
employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or
employee; Section 551.076 - implementation of security personnel or devices; Section
551.087 - deliberation regarding economic development negotiation; Section 551.089 -
deliberation regarding security devices or security audits, and/or other matters as authorized
under the Texas Government Code. If a closed or executive session is held in accordance
with the Texas Government Code as set out above, the City Council will reconvene in open
session in order to take action, if necessary, on the items addressed during executive
session.
9.a Real Property
Texas Government Code 551.072 - Deliberation regarding purchase, exchange,
lease, or values of real property: The City Council will meet in closed session with the
City Manager and the City Attorney to discuss purchase of real property located in
the City of La Porte, Texas.
10. Reconvene
The Council will reconvene in open session and consider action, if any, on item(s) discussed
in executive session. Only action of the Council decided on in an open session is legal. The
Council will announce the time it reconvenes before resuming consideration or adjourning.
11. Adjourn
Persons with disabilities who plan to attend this meeting and who may need auxiliary aids or
services are requested to contact the City Secretary's Office (281470-5021), three working
days prior to the meeting for appropriate arrangements.
Pursuant to Texas Government Code Sec. 551.127, on a regular, non -emergency basis,
members may attend and participate in the meeting remotely by video conference. Should

that occur, a quorum of the members will be physically present at the location noted above
on this agenda.
