DECISION OF THE ZONING BOARD OF ADJUSTMENT
RE: VAR-2024-0003 Carlos Martinez

La Porte, TX 77571 SUBJECT: Decision of the Zoning Board of Adjustment (ZBOA) The above-referenced request was for adoption of a variance to allow deviations from
Section 106-748, Swimming Pools, Spas and Hot Tubs, of the La Porte Zoning Ordinance to allow a 1-foot setback from the existing 16-foot utility easement and to be completely within an existing 5-foot unobstructed aerial easement. The variance was approved with conditions by the City of La Porte Zoning Board of Adjustment (“Board”) on October 24, 2024, by a vote of four (4) in favor of the variance and zero (0) against the variance. On
this date, the Board found that the request meets the conditions set forth in section 106-192 of the City of La Porte Zoning Ordinance. The conditions set forth in the Board’s approval include:
• Providing documentation from the utility providers that the infrastructure located within
the utility easement are a minimum of 6 feet from the proposed pool wall, and
• Providing a letter of no objection to encroach the aerial easement from CenterPoint.
Any interested person wishing to appeal this decision is required to file a petition for Writ of Certiorari in a district court, county court or county court at law within ten (10) days of
the date this decision is filed in the Board’s office in accordance with section 211.011 of
the Texas Local Government Code. This decision was filed in the Board’s office on October 25, 2024.
