AN ORDINANCE REPEALING ORDINANCE 2025-4079, WHICH CONDEMNED AS
SUBSTANDARD A CARPORT ADJACENT TO A SINGLE-FAMILY DWELLING
LOCATED ON REAL PROPERTY AT 514 SOUTH BLACKWELL STREET, LA PORTE,
TEXAS AND LEGALLY DESCRIBED AS LOTS NINETEEN (19) AND TWENTY (20) IN
BLOCK THIRTY-FOUR (34), OF BAY FRONT ADDITION ON THE MAP OF LA PORTE, A
SUBDIVISION IN HARRIS COUNTY, TEXAS; CONTAINING A SEVERABLITY CLAUSE;
CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPEN
MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, on September 8, 2025, the City Council of the City of La Porte passed and
approved Ordinance 2025-4079 for the purpose of condemning and ordering the removal of a sub-
standard carport adjacent to the single-family dwelling situated on real property commonly known
as 514 South Blackwell St., La Porte, Texas; and
WHEREAS, Ordinance 2025-4079 imposed a forty-five (45) day deadline for the property
owner to complete the removal of the substandard carport at 514 South Blackwell St., La Porte,
Texas; and
WHEREAS, the owner of 514 South Blackwell St. repaired the said carport before the
conclusion of the forty-five (45) day deadline for removal, thereby causing the said carport to no
longer constitute a substandard structure.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA
PORTE:
Section 1: That the facts and recitations set forth in the preamble of this ordinance are
true and correct.
Section 2. Ordinance 2025-4079, passed by the La Porte City Council on September
8, 2025, and which ordered the demolition of the carport adjacent to the single-family dwelling at
514 South Blackwell St., La Porte, Texas., La Porte, Texas, is hereby repealed in its entirety.
Section 3. If any provision, section, subsection, sentence, clause, or phrase of this
ordinance, or the application of same to any person or set of circumstances is for any reason held
to be unconstitutional, void or invalid, the validity of the remaining portions of this ordinance or
their application to other persons or sets of circumstances shall not be affected thereby, it being
the intent of the City Council in adopting this ordinance that no portion hereof or provision or
regulation contained herein shall become inoperative or fail by reason of any unconstitutionality,
vividness or invalidity of any other portion hereof, and all provisions of this ordinance are declared
to be severable for that purpose.
Section 4. The City Council officially finds, determines, and recites and declares that
a sufficient written notice of the date, hour, place and subject of this meeting of the City Council
was posted at a place convenient to the public at the City Hall of the City for the time required by
law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas
Government Code; and that this meeting has been open to the public as required by law at all times
during which this ordinance and the subject matter thereof has been discussed, considered and
formally acted upon. The City Council further ratifies, approves and confirms such written notice
and the contents and posting thereof.
Section 5. This Ordinance shall take effect immediately upon its passage and approval.
