All agenda items are subject to action. 1. Call to Older The Mayor will determine that a quorum of Councilpersons is present and open the business meeting. 2. Invocation and Pledges of Allegiance INVOCATION - The invocation will be given by Senior Pastor Walter Brumley of La Porte River of God Church. PLEDGES - Will be led by Ozzie Gonzalez. U.S. Flag Texas Flag: Honor the Texas Flag. I pledge allegiance to thee, Texas, one state, under God, one and indivisible. 3. Recognitions 3.a Recognition of Fire Chief Chris Pettis [Corby Alexander, City Manager] 3.b Recognition of October as National Community Planning Month in the City of La Porte [Ryan Hvitlek, Director of Planning & Development] 4. Citizen Comment State law provides that members of the public may speak before the Council considers an item of business. Complete a sign up sheet before speaking. (Generally limited to five minutes per person; the time may be reduced if there is a high number of speakers or for other considerations.) Members of the Council may ask questions or make statements of fact in response to comments but are not obligated to respond and will not participate in debate or take action during this portion of the agenda. Items may be requested for future agendas in accordance with the adopted Rules of Procedure. 5. Consent Agenda Approval of Consent Agenda items authorizes each to be implemented in accordance with staff recommendations provided. An item may be removed from the Consent Agenda and added to the Statutory Agenda for full discussion upon request by a member of the Council present at this meeting. 5.a Approve the minutes of the September 22, 2025, regular meeting of the City Council and the September 29, 2025, special meeting of the City Council [Lee Woodward, City Secretary/PIO] 5.b Appoint Mayor Helton to serve as the City's delegate to the TML 2025 annual business meeting, and Councilperson Guerra as an alternate. [Lee Woodward, City Secretary] 5.c Retail Recruitment Conbac Authorize the City Manager to execute a three- (3-) year contract for retail recruitment services with Retail Strategies in the amount of $50,000.00 per year, for a total authorization of $150,000.00, and authorize expenditure of $150,000.00 by the La Porte Development Corporation over three- (3-) year period to fund same. [Matt Daeumer, Assistant City Manager] 5.d Depository Banking Services Authorize the City Manager to execute Depository Banking Services Agreement between the City of La Porte and Amegy Bank. [Michael Dolby, Finance Director] 5.e FY25-26 Vehicles and Equipment Replacement Approve vehicle and equipment purchases through cooperative purchasing contracts; BuyBoard 706-23, HGACBuy HTO6-20 and BT01-19, Sourcewell 050625-CFC and 112624-KBA, and TIPS 240901, totaling $1,567,479.97. [Ray Mayo, Director of Public Works] 51 Ordinance 2025-5004 - Real Property Adopt Ordinance 2025-5004 for the purchase of real property located adjacent to the Five Points Plaza, legally described as Lot 16 and 17 in Block 198 of Town of La Porte, for an amount of $70,000.00, and miscellaneous closing costs for an amount up to $5000.00, for a total authorization not to exceed $75,000.00, and authorize the City Manager to execute any and all documents associated with this purchase. [Matt Daeumer, Assistant City Manager] 5.g Ordinance 2025 =3 Adopt Ordinance 2025-5003 providing for the repeal of Ordinance 2025-4079 passed on September 8, 2025, and which condemned a substandard carport structure located at 514 S. Blackwell St., La Porte. [Richard Glass, Chief Building Official] 5.h DSHS letter Authorize the Mayor to sign a letter requesting the Texas Department of State Health Services consider issuing an addendum to the report that disaggregates data by census tract on its 2025 East Harris County Cancer Assessment. Public Hearings and Associated Ordinances State law provides for public hearings on particular items, such as the annual City budget, tax rate, and some land use decisions. Members of the public may speak when the presiding Page 2 of 5 officer calls for comments, without signing up in advance. (Generally limited to five minutes per person; in accordance with state law, the time may be reduced if there is a high number of speakers or for other considerations.) Members of the Council may ask questions or make statements of fact in response to comments but are not obligated to respond and will not participate in debate or take action until the public hearing is closed and the item is placed before them for consideration. 6.a Southeast Texas Housing Finance Corporation - LSP Partners, LP - Seville Place Apartments The City Council will conduct a public hearing in accordance with Section 394.9025(a) of the Texas Local Government Code regarding a proposal by the Southeast Texas Housing Finance Corporation (SETH) to issue one or more series of tax-exempt obligations in an amount of not more than $22,500,000.00, for the benefit of LSP Partners, LP, in connection with the acquisition, rehabilitation, and equipping of a multifamily rental housing development located at 3701 Luella Boulevard, La Porte, Texas, 77571, known as Seville Place Apartments and consisting of 180 units; followed by discussion and possible action to authorize and direct the Mayor to execute 1) Certificate of Approval and 2) General and No Litigation Certificate by the Southeast Texas Housing Finance Corporation (SETH) for the benefit of LSP Partners, LP, for the acquisition, rehabilitation, and equipping of a multifamily housing development known as Seville Place Apartments, 3701 Luella Boulevard, La Porte, Texas, 77571. [Corby Alexander, City Manager] 7. Statutory Agenda Councilpersons will engage in debate in accordance with their adopted parliamentary authority. Members of the public may be permitted to answer questions from the Council or provide information if requested by the Council (either without objection or on a majority vote in favor). 7.a Battleground Concrete Workshop Presentation, discussion, and possible action to provide administrative staff direction related to the proposed project by Battleground Concrete at 1911 West Main Street, La Porte. [Ryan Hvitlok, Director of Planning and Development] 7.b Presentation, discussion, and possible action to adopt Ordinance 2025-5006 designating The Hometown Press as the Cily's official newspaper. [Lee Woodward, CRY Secretary] 7.b.1 ExecuWe Session The portion of the Texas Gov't. Code known as the Texas Open Gov't. Act (TOMA, TGC Ch. 551) provides a limited set of circumstances that allow the Council to meet in a session closed to the public. The Council will first meet in an open session, announce the exception that allows it to meet in a closed session, and announce the time it is convening in closed session. The Council will post executive sessions it is aware of in advance, but may go into an executive session if a situation arises during a meeting that calls for an appropriate exception. The Council will convene in executive session without a vote unless an objection is raised by a member of the Council. If, during the course of the meeting and discussion of any items covered by Page 3 of 5 this notice, City Council determines that a closed or executive session of the Council is required, then such closed meeting will be held as authorized by Texas Government Code, Chapter 551, Section 551.071 consultation with counsel on legal matters; Section 551.072 - deliberation regarding purchase, exchange, lease or value of real property; Section 551.073 - deliberation regarding a prospective gift; Section 551.074 - personnel matters regarding the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee; Section 551.076 - implementation of security personnel or devices; Section 551.087 - deliberation regarding economic development negotiation; Section 551.089 - deliberation regarding security devices or security audits, and/or other matters as authorized under the Texas Government Code. If a closed or executive session is held in accordance with the Texas Government Code as set out above, the City Council will reconvene in open session in order to take action, if necessary, on the items addressed during executive session. 7.b.1.1 Official newspaper executive session Texas Government Code Sec. 551.071(2)- Consultation with Attorney: The City Council will meet in closed session with the City Attorney to discuss legal issues in connection with agenda item 7b - selection of Hometown Press as official newspaper of the City of La Porte. 7.b.2 Reconvene The Council will reconvene in open session and consider action, if any, on item(s) discussed in executive session. Only action of the Council decided on in an open session is legal. The Council will announce the time it reconvenes before resuming consideration or adjourning. 7.c Discussion regarding consolidation of the City of Shoreacres with the City of La Porte [Corby Alexander, City Manager] B. Reports Presentation on major projects and/or departures from current practices are often provided here. Reports from selected committees and periodic updates may also be provided. 8.a Report of the La Porte Drainage and Flooding Committee meeting held on October 13, 2025. [Councliperson Martin] 8.b Administrative Reports [Corby Alexander, City Manager] 9. Items of Community Interest Per Texas Gov't. Code Sec. 551.0415, the Council may receive from staff and/or may make a report about items of community interest during a meeting without having given notice of the subject of the report, if no action is taken and, except as provided by Section 551.042, possible action is not discussed regarding the information provided in the report. Hear announcements concerning matters appearing on the agenda; items of community interest; and/or inquiries of staff regarding specific factual information or existing policy from the Mayor, Councilpersons, and City staff, for which no formal action will be discussed. 10. Adjourn Persons with disabilities who plan to attend this meeting and who may need auxiliary aids or services are requested to contact the City Secretary's Office (281-470-5021), three working Page 4 of 5 days prior to the meeting for appropriate arrangements. Pursuant to Texas Government Code Sec. 551.127, on a regular, non -emergency basis, members may attend and participate in the meeting remotely by video conference. Should that occur, a quorum of the members will be physically present at the location noted above on this agenda.
