PUBLIC NOTICE UNITED STATES ENVIRONMENTAL PROTECTION AGENCYREGION 6 PROPOSAL TO APPROVEAUTHORIZATION OF CLEAN HARBORS LA PORTE, LLC FOR THE STOR-AGE OF ONSITE GENERATED LIQUID POLYCHLORINATED BIPHENYLS (PCBs) IN ITS FACILITY LOCATED IN LA PORTE, TX; EPA ID TXD982290140 The United States Environmental Protection Agency (EPA) Region 6 proposes to grant re-authorization approval to Clean Harbors La Porte to store and dispose of off-site generated polychlorinated biphenyls (PCBs) at their facility in Temple, Texas. EPA has the authority to approve the storage of PCBs under Title 40 of the Code of Federal Regulations (CFR), part 761, subpart D. PCBs are a group of chemical compounds previously used extensively in industries and do not readily break down once they enter the environment. At high concentrations, PCBs have been shown to cause liver and kidney damage in humans, usually through direct exposure or ingestion through contaminated seafood. PCBs are suspected carcinogens (Class B). EPA reviewed the information that Clean Harbors submitted and found that Clean Har-bors La Porte facility meets the regulatory requirements for the storage of onsite generated PCBs. EPA has determined under Section 106 of the National Historic Preservation Act that his-toric properties will not be affected by the proposed reauthorization. EPA has determined under Section 7 of the Endangered Species Act that the proposed reau-thorization will not affect any listed species or designated critical habitat. This notice opens a 45-day comment period, starting October 3, 2022, during which re-quests may be made for a public meeting. EPA may hold a public meeting if it determines there is a significant degree of public interest in the application, or if requested by a local legislator. TCEQ’s Executive Director has determined the application is administratively complete and will conduct a technical review of the application.
