NOTICE OF RECEIPT OF APPLICATION ANDINTENT TO OBTAIN WATER QUALITY PERMIT RENEWAL PERMIT NO. WQ0014013001
APPLICATION. Aqua Texas Inc., 1106 Clayton Lane, Suite 400W, Austin, Texas 78723, has applied to the Texas Commission on Environmental Quality (TCEQ) to renew Texas Pollutant Discharge Elimination System (TPDES) Permit No. WQ0014013001 (EPA I.D. No. TX0118028) to authorize the discharge of treated wastewater at a volume not to ex-ceed a daily average flow of 50,000 gallons per day. The domestic wastewater treatment facility is located at 32916 Greenfield Forest Drive, Magnolia, in Montgomery County, Texas 77354. The discharge route is from the plant site to an unnamed ditch; thence to Bear Branch; thence to Bear branch Reservoir; thence to Bear Branch; thence to Panther Branch; thence to Lake Woodlands; thence to Panther Branch; thence to Spring Creek. TCEQ re-ceived this application on October 4, 2022. The permit application is available for view-ing and copying at Montgomery County Central Library, 104 Interstate 45 North, Conroe, Texas. ADDITIONAL NOTICE. TCEQ’s Executive Director has determined the application is administratively complete and will conduct a technical review of the application. After technical review of the application is complete, the Executive Director may prepare a draft permit and will issue a preliminary decision on the application. Notice of the Application and Preliminary Decision will be published and mailed to those who are on the county-wide mailing list and to those who are on the mailing list for this application. That notice will contain the deadline for submitting public comments.
PUBLIC COMMENT / PUBLIC MEETING. You may submit public comments or re-quest a public meeting on this application. The purpose of a public meeting is to provide the opportunity to submit comments or to ask questions about the application. TCEQ will hold a public meeting if the Executive Director determines that there is a significant degree of public interest in the application or if requested by a local legislator. A public meeting is not a contested case hearing.
OPPORTUNITY FOR A CONTESTED CASE HEARING. After the deadline for sub-mitting public comments, the Executive Director will consider all timely comments and prepare a response to all relevant and material, or significant public comments. Unless the application is directly referred for a contested case hearing, the response to comments, and the Executive Director’s decision on the application, will be mailed to everyone who submitted public comments and to those persons who are on the mailing list for this application. If comments are received, the mailing will also provide instructions for requesting reconsideration of the Executive Director’s decision and for requesting a contested case hearing. A contested case hearing is a legal proceeding similar to a civil trial in state district court.
TO REQUEST A CONTESTED CASE HEARING, YOU MUST INCLUDE THE FOLLOWING ITEMS IN YOUR REQUEST: your name, address, phone number; applicant’s name and proposed permit number; the location and distance of your property/activities relative to the proposed facility; a specific description of how you would be adversely affected by the facility in a way not common to the general public; a list of all disputed issues of fact that you submit during the comment period and, the statement “[I/we] request a contested case hearing.” If the request for contested case hearing is filed on behalf of a group or association, the request must designate the group’s representative for receiving future correspondence; identify by name and physical address an individual member of the group who would be adversely affected by the proposed facility or activity; provide the information discussed above regarding the affected member’s location and distance from the facility or activity; explain how and why the member would be affected; and explain how the interests the group seeks to protect are relevant to the group’s purpose.
Following the close of all applicable comment and request periods, the Executive Director will forward the application and any requests for reconsideration or for a contested case hearing to the TCEQ Commissioners for their consideration at a scheduled Commission meeting.
The Commission may only grant a request for a contested case hearing on issues the re-questor submitted in their timely comments that were not subsequently withdrawn. If a hearing is granted, the subject of a hearing will be limited to disputed issues of fact or mixed questions of fact and law relating to relevant and material water quality con-cerns submitted during the comment period. MAILING LIST. If you submit public comments, a request for a contested case hearing or a reconsideration of the Executive Director’s decision, you will be added to the mailing list for this specific application to receive future public notices mailed by the Office of the Chief Clerk. In addition, you may request to be placed on: (1) the permanent mailing list for a specific applicant name and permit number; and/or (2) the mailing list for a specific county. If you wish to be placed on the permanent and/or the county mailing list, clearly specify which list(s) and send your request to TCEQ Office of the Chief Clerk at the address below.

Trinity BaySLOW. 77 degrees. Birds working over schools of small trout and sand trout in Jack’s Pocket. Bays north of the Fred Hartman Bridge producing decent catches of redfish, a few speckled trout and black drum. Best bite is on live shrimp. East Galveston BayGOOD. 78 degrees. Scattered birds working open bay, but mostly sand trout and small speckled trout under them biting on soft plastics. Shorelines producing redfish and flounder biting on live natural bait or soft plastics, especially Gulps for the flounder. Report by Captain David Dillman, Galveston Bay Charter Fish-ing. As fall weather approaches, look for redfish in big schools near marshes, structures, jetties and rock barriers. Look for trout on deeper reefs. One month left for flounder season and they are definitely here, a good flounder pounder color is Nuclear Chicken. Yates to Big Pasture Bayou drain, and Marsh Point to Rollover, holding some redfish, trout, and flounder drifting popping cork with live shrimp against the grass line. Galveston BayGOOD. 77 degrees. Winds have limited catches in the open bay. Protected shorelines producing redfish, black drum, and flounder. Best bite has been on live shrimp. Redfish at both ends of the harbor on cut mullet, sand trout, or crab. There are a trout being caught at the causeway. Hannah’s Reef still holding trout and redfish drifting artificial, popping cork with shrimp, chatter weight and croaker. Swan Lake holding redfish on artificial. West Galveston BayGOOD. 79 degrees. Speckled trout bite has slowed, but catches of redfish are good, along with some black drum. Giggers are doing well at night on the flounder. Look for trout on deeper reefs. One month left for flounder season and they are definitely here, a good flounder pounder color is Nuclear Chicken. Trout and redfish holding on the reefs drifting be-tween Carancahua Reef to Confederate Reef on artificials, or popping cork with live shrimp. Greens Lake still holding redfish and flounder up against the grass line early on popping cork with artificial or live. SLP bridge holding oversized redfish with a few slots. Texas CityGOOD. 77 degrees. Bull redfish, and a few big black drum being caught off the dike and the Galveston jet-ties. A few flounder are being caught in the Galveston harbor. Tarpon fishing remains good when conditions allow off the Galveston beachfront. Strong cold front next week may stop the bite. Report by Captain David Dillman, Galveston Bay Charter Fishing. The dike is seeing redfish on Carolina rigged cut mullet, sand trout, shad, or crab at the end. Rock barriers just south of the dike holding trout, redfish, and flounder under pop in cork with shrimp, or Carolina rig mullet. FreeportGOOD. 78 degrees. Fishing has slowed with the full moon. Flounder bite has turned on in the river, pass, and cuts leading into bays. Jigging is producing the best bite. Redfish and trout are good in Bastrop, Christ-mas and Chocolate Bays drifting with shrimp or lures. Redfish are good in the back lakes. River and the cuts leading into the bay are full of big croaker, sand trout, drum and sheepshead on the fall spawn run bit-ing on live or dead shrimp. East Matagorda BaySLOW. 81 degrees. The high water temperatures are not normal for this time of year slowing the shrimp migration, and the bite.Trout are slow due to the weather and increase in the water temperature, but wade fishing will produce a few bites. Port O’ConnorGOOD. 80 degrees. Fishing patterns are the same. Look for the trout action to pick up in November. Slot redfish are very good in the jetties on Spanish sardines and dead shrimp. Bull redfish are good at the back of jetties on dead shrimp and Spanish sardines. Oversized black drum are good on dead shrimp at the end of jetties. Slot drums are good where the jetties widen. RockportGREAT. 86 degrees. Redfish are good in inlets and channels with jetty access drifting with artificials, espe-cially gulp shrimp. As the sun gets high fish move into the flats. Cut bait in sand pockets has also been good. Trout are good early morning on flats near deep water access. Great bite on topwater plugs early switching to soft plastics mid morning or using live shrimp. Drum are good on outgoing tides near backwater inlets on dead shrimp. Port AransasGOOD. 81 degrees. Bull redfish at the jetteis in 35-40 feet of water fished off the bottom with cut mullet. Slot redfish are in the jetties at 25 feet of water in the rocks. Vermillion snapper, Spanish mackerel, big black drum, and sheepshead are in the jetties on live shrimp. Report by Captain Doug Stanford, Pirates of the Bay Fishing Charters.
Corpus ChristiSLOW. 81 degrees. Catching a few trout off the wells, the bite is hampered by the wind. Redfish are good in the Ingleside shoreline in potholes. Report by Captain Doug Stanford, Pirates of the Bay Fishing Charters.
Baffin BayGOOD. 91 degrees. Fishing patterns have been different with the full moon slowing the early morning bite. Trout, redfish and limits of drum are biting on gulps under a popping cork. Using a gulp instead of live shrimp will attract the better quality fish, so you do not have to sift through the trash fish. Hope the future brings us many more good days on the water. Port MansfieldFAIR. 84 degrees. The lighter winds have been good for the west shoreline. Redfish remain close to the bank, falling to Mansfield Knocker or Bart’s Bay Ninja paddle tail by KWiggler. In the mid thigh to waist deep depth the trout bite has been productive. KWiggler Pollo Loco or Mansfield Margarita Ball Tail Shad have worked the best. The water level remains high which allows you access to further in on the East Flats than normal. The best action there recently has been around mid morning over the spotted grass. Golden Croaker or Cinderella Story single hooked Mansfield Knocker is a great way to locate the fish. Recently they have been waking or pushing water behind the M.K slow it down or dona twitch to trick them into biting. Another lure of choice is a 1/2 oz gold weedless spoon or Bart’s Bay Ninja or Salt n Pepper four inch paddle tail. Hope this report helps out. Until next time, tight lines and calm seas. South PadreGOOD. 84 degrees. Limits of good speckled trout are in the intercoastal. Seeing lot of skipjack which can be fun. Trout have been constant all summer fishing the intercoastal from marker 38 to the Arroyo. Redfish on cut mullet and skipjack are holding between the two drum boats fairly constant. Sheephead and puppy drum at entrance to south bay and the old causeway. End of Brownsville Channel is excellent for mangrove snapper with the chance of a redfish or trout also. Stay safe out there.
