HomeMy WebLinkAboutOrd 2025-4065_Amends Ch. 50 ParksORDINANCE 2025-4065 AN ORDINANCE AMENDING CHAPTER 50 "PARKS AND RECREATION", AND APPENDIX -A "FEES" OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE BY REVISING REGULATIONS APPLICABLE TO THE OPERATION OF CITY PARKS AND RELATED FACILITIES; PROVIDING A REPEALING CLAUSE; CONTAINING A SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS ACT; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN A SUM NOT TO EXCEED FIVE HUNDRED DOLLARS; PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF; CONTAINING A REPEALING CLAUSE; CONTAINING A SEVERABILITY CLAUSE;AND PROVIDING AN EFFECTIVE DATE HEREOF BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: Section 1: That Chapter 50, "Parks and Recreation," Article I "In General", Section 50-2 "Parks and park areas defined", of the Code of Ordinances, La Porte, Texas, is hereby amended and shall hereinafter read as follows: "Sec. 50-2. - Parks and park areas defined. The parks, park areas, park related facilities, and rental facilities which comprise the City of La Porte Parks System are listed below and their location within the city established. The City Council for the City of La Porte establishes hours of public operation for all city parks and park related facilities and rental facilities in the City of La Porte park system. Each park, park related facility or rental facility in the city park system shall be open to, and be closed to the general public each day according to the schedule described herein. The parks, park related facilities, and rental facilities of the City of La Porte Parks System are classified below and their hours of public operation are as follows, unless written authorization is given for a special event at the park or facility as provided for in this section. Section 3: That Chapter 50, "Parks and Recreation," Article III "Swimming Pools", of the Code of Ordinances, La Porte, Texas, is hereby amended in its entirety and shall hereinafter read as follows: "ARTICLE III. - SWIMMING POOLS Sec. 50-71. - General Admission Fees. (a) Admission to the municipal swimming pools may be obtained by paying a general admission fee. (b) Daily admission rates. Daily admission rates shall be in amounts established by the city and listed in appendix A of this Code. (c) Facility rentals. Facility rentals shall be in amounts established by the city and listed in appendix A of this Code. Hours for such rentals shall be set as follows: (1) Little Cedar Bayou Wave Pool: a. Monday through Thursday, 8:00 p.m. until 12:00 midnight; and b. Friday through Sunday, 6:00 p.m. until 12:00 midnight. (2) San Jacinto Swimming Pool: a. Tuesday through Friday, 9:00 p.m. until 12:00 midnight; and b. Saturday and Sunday, 9:00 p.m. until 12:00 midnight. (3) Northwest Park Swimming Pool: a. Tuesday through Friday, 9:00 p.m. until 12:00 midnight; and b. Saturday and Sunday, 9:00 p.m. until 12:00 midnight. (4) Fairmont Park Swimming Pool: a. Tuesday through Friday, 9:00 p.m. until 12:00 midnight; and b. Saturday and Sunday, 9:00 p.m. until 12:00 midnight. Sec. 50-72. - Discounting of admission prices and offering of special events and programs. Due to the fluctuation in monthly attendance (July and August) and low revenues, the parks and recreation department will retain the privilege to work with our major sponsors and marketing coordinator to discount admission prices and offer special events/programs. Sec. 50-73. - Hours of operation. (a) Generally. Wave pools will open for the Memorial Day Weekend (Saturday through Monday) and then all pools will open the first Saturday after the La Porte Independent School District's summer dismissal. Pools will be open for the July 4th holiday. Northwest, San Jacinto and Fairmont Pools will close for the season the last Wednesday prior to La Porte Independent School District classes resuming. The wave pool will close daily the Sunday prior to the La Porte Independent School District's classes resuming and shall be open weekends through Labor Day. (b) Hours of operation; specific enumeration. Specific hours of operation for municipal pools are as follows: (1) Little Cedar Bayou Wave Pool: a. Monday through Thursday, 11:00 a.m. to 8:00 p.m.; and b. Friday through Sunday, 11:00 a.m. to 6:00 p.m. (2) Northwest Pool, San Jacinto and Fairmont Pools: a. Mondays, closed; and b. Tuesday through Sundays, 11:00 a.m. to 5:00 p.m., 6:00 p.m. to 9:00 p.m. Sec. 50-74. - Rules governing use of municipal pools. (a) Use of pools. The following rules shall govern the use of municipal pools: (1) On weekdays, including Saturdays, the pool will be open from 1:00 p.m. to 5:00 p.m., and from 6:00 p.m. to 9:00 p.m. for general swimming. The pool will be closed Monday mornings for cleaning and maintenance. On Tuesdays through Saturdays the pool will be open from 8:00 a.m. until 12:30 p.m. for swimming classes. (2) No admission shall be allowed after 8:30 p.m. in the pool area. (3) On Sundays the pool will be open from 2:00 p.m. to 6:00 p.m. for general swimming. (4) Everyone must be out of the pool by 15 minutes before closing time, and shall be dressed and out of pool enclosure by the hour set for closing. (5) Swimming teams may use the municipal pool during available hours. Scheduled swim meets will be held if scheduled within three weeks prior to swim meet dates. (6) No person shall be admitted to pool who has sores, open abrasions, a cold or any other physical condition which might contaminate the pool or jeopardize such person's own safety, or that of others. (7) Everyone must take a shower bath before entering the pool. No bobby pins or hair pins allowed in pool. (8) No child under the age of seven will be permitted in the pool, unless under the direct supervision of a responsible person. (9) The attendant in charge shall enforce such other sanitary measures as are deemed necessary to safeguard the health, safety and well-being of persons using the pool and its facilities. (10) No bottles, glass, candy, or food of any kind will be permitted within the pool enclosure. Bottles of suntan lotion may be kept in one's basket, which shall be available to patrons for use in the bathhouse. (11) When diving from a springboard, not more than one jump will be permitted for each dive. (12) No running or rough playing will be permitted within the pool enclosure. (13) No person wearing street clothes will be allowed within the pool enclosure. (14) No drinking of alcoholic beverages will be allowed in, on or around the municipal pool and park area at any time. (15) No dogs or pets of any kind will be permitted within the pool enclosure or bathhouse. (16) No unauthorized persons will be allowed on the lifeguard platform at any time. (17) The manager or other person in charge shall have the power to eject any person from the pool enclosure, bathhouse or park for violation of any of the rules, or any person whose condition or conduct warrants such action, in his opinion. Further, the manager or other person in charge shall have the power to refuse admission to the pool, bathhouse or park, to any person. Section 4: That Chapter 50, "Parks and Recreation," Article IV "Softball Fields", Section 50-110 "Reservation methods; reservation and damage deposit; security service", of the Code of Ordinances, La Porte, Texas, is hereby amended and shall hereinafter read as follows: Sec. 50-107. - Reservation by city leagues and groups; payment. Any person participating in the city adult softball and adult soccer leagues, civic organizations, church groups and business or industrial groups may reserve any or all of the fields for league or tournament play on a first come, first served basis by paying all necessary fees and deposits. "Sec. 50-110. - Reservation methods, reservation, and security service. (a) Reservations for practice or league play at the adult softball or soccer fields may be made either by phone or in person at the parks and recreation administration office or any other place that may be designated from time to time. (b) It shall be the responsibility of the director of parks and recreation, or his designee, to determine the number of security officers required, if any, for each event and to arrange for such security service. The charge for security service will be the officers prevailing rate and will be in addition to the rental rate." Section 5: That Chapter 50, "Parks and Recreation," Article V "Fitness Center", of the Code of Ordinances, La Porte, Texas, Section 50-153 "Enumeration of membership plan and fees", is hereby amended shall hereinafter read as follows: "Sec. 50-153. - Enumeration of membership plans and fees. (a) Membership options. The following types of membership plans are available:] (1) Basic plan- includes use of all amenities (2) La Porte Commercial Membership. (3) La Porte Industrial Membership. (4) Non -La Porte Commercial/Industrial Membership. (5) Swim and handball/racquetball per day/use usage fees. (6) Guest fees. (7) Hotel/motel guest fees. (b) Facility use membership basic plan. The basic plan membership entitles holder to the use of all facility amenities. (c) Commercial, industrial, and non -La Porte Commercial/Industrial Membership Plan. Commercial membership may be purchased by an individual for an annual term according to the following schedule, and entitles holder to the use of all facility amenities. These memberships are only available to those companies/corporations with ten or more participating employees. La Porte Commercial La Porte Industrial *Non -La Porte Commercial/ Industrial (1)Individual annual plan (10-100 participants) $132.00 $144.00 $288.00 (2)Individual annual plan (over 100 participants)120.00 132.00 276.00 *Resident employees of a Non -La Porte Commercial entity may purchase resident membership independently and be counted as one of that entity's enrollment. (d) Guest fees. Any La Porte Recreation/Fitness Center member is allowed up to three guests per visit. Members assume responsibility for their guests and must participate together. (1) There will be a $5.00 per day per guest facility use fee. (2) There will be a $3.00 per guest charge for use of the swimming pool. (3) Senior citizens (60 and over), one-half price. (e) Hotel/motel guest fee. Registered guests of hotels or motels located within the City of La Porte city limits, are eligible for facility use of all amenities of the recreation and fitness center for a daily fee of $5.00. Section 6: That Chapter 50, "Parks and Recreation," Article VII "Civic and Recreation Centers", of the Code of Ordinances, La Porte, Texas, is hereby amended in its entirety and shall hereinafter read as follows: "ARTICLE VII. - CIVIC, RECREATION CENTERS AND SEABREEZE PAVILION Sec. 50-271. - Days and hours for rental of facilities. (a) Facilities may not be rented on the following holidays: (1) Thanksgiving; (2) Christmas Eve; (3) Christmas Day; (4) New Year's Day; (5) Good Friday; and (6) Easter Sunday. (b) The Evelyn Kennedy Civic Center, the Jennie Riley Recreation Center, the Charles Walker Annex, and the Brookglen Recreation Center, shall be available for rental Monday through Thursday, from 8:00 a.m. until 10:00 p.m., and Friday through Sunday, from 8:00 a.m. until 12:00 midnight, subject to availability. Seabreeze Pavilion will be available Monday through Sunday from March 1 - September 1 from 6:30 a.m. until 8:30 p.m. and from October 1 - February 28/29 from 7:00 a.m. until 6:30 p.m. Sec. 50-272. - Classification of users and hourly rates. (a) Civic/nonprofrtgroups. Civic and nonprofit groups shall pay an hourly rate as established by the city and listed in appendix A of this Code. This rental rate shall apply to any nonprofit organization which has a local office in the city. The requesting organization must present proof of its nonprofit status. This rate pertains to events such as exhibits, shows, demonstrations, seminars and other civic activities for which an admission fee is not charged, nor funds raised. This rate also applies to organizations, associations and religious activities or banquets held to raise money, when net receipts shall be donated to the charity or community project for which such function is intended. Verification of receipts will be requested. (b) Private individuals or groups. Private individuals or groups shall pay hourly rates as established by the city and listed in appendix A of this Code. This rental rate shall apply to professional exhibitions or contests, promotional and public dances, commercial shows and other attractions sponsored or contracted by profit making or commercial organizations or individuals at no charge to the public. This class shall also apply to private use, such as weddings and receptions, private parties, fund raising events for nonprofit groups that do not have an office in the city, and the like. (c) Commercial organizations engaged in for -profit activity. Commercial organizations engaged in for - profit activity shall pay an hourly rate as established by the city and listed in appendix A of this Code. This rental rate shall apply to any organization which charges instructional or admissions fees to participants or attendees for events at the centers such as karate classes, gymnastics, and the like. This rate shall also apply to any commercial event organized for the purpose of profiting from the public at these facilities. The commercial group must furnish a comprehensive general liability insurance policy, with the city named as an additional named insured, with limits of liability of not Tess than $1,000,000.00 dollars combined single limit bodily injury and property damage per occurrence. The organization shall furnish the city with certificate of insurance evidencing such coverage. (d) Hourly rate for set-up. Lessees will be required to pay the hourly rate for set-up, rehearsal event, and clean up. The city will not be responsible for any items left on the premises before, during, or after any event by organizations, participants, or attendees. Sec. 50-273. - Reservation and damage deposit. Reservations must be accompanied by a reservation and damage deposit as established by the city and listed in appendix A of this Code. The deposit is in addition to the rental rate. The reservation and damage deposit will reserve the facility for the lessee until rental payments are made and will provide protection to the lessor for any damage to the centers caused by lessee. Failure of lessee to vacate premises at the designated hour and/or damages, Toss or theft of city property, or failure to clean facility after the event will subject lessee to loss of the reservation and damage deposit. Lessee may also be billed for any damages exceeding the deposit amount. Sec. 50-274. - Cancellation. In the event a rental date is canceled, lessee shall provide written notice of the cancellation to the city at least 30 days prior to reservation date in order to receive a full refund. One-half of the reservation and damage deposit, as established by the city and listed in appendix A of this Code, is automatically forfeited on any cancellation made less than 30 days prior to the reserved date. If proper written notice is not received by the city more than 30 days prior to a scheduled event, Lessee may transfer rental monies to another date; however, one-half of the reservation and damage deposit will be retained by the city. In this case, lessee will be required to pay an additional fee, as established by the city and listed in appendix A of this Code. Sec. 50-275. - Cancellation and rescheduling by the city. The parks and recreation department reserves the right to cancel and/or reschedule any building or facility rental for just cause upon due notice including any safety, health or weather emergency, or any inability of the parks and recreation department to fulfil the rental agreement. Such cancellation by the parks and recreation department shall entitle the user to rescheduling or refund privileges. Sec. 50-276. - Alcohol consumption. Alcohol consumption shall be permitted at the Evelyn Kennedy Civic Center only. Alcohol cannot be sold at the Evelyn Kennedy Civic Center. Alcohol permits are required for alcohol consumption and are issued at the parks and recreation department, for an additional fee as established by the city and listed in appendix A of this Code. Alcohol consumption will be confined to the area designated by the city but to generally include only the congregate area. No alcoholic beverages can be carried out of that designated area, as identified in the rental contract. Sec. 50-277. - Parking charges. Neither the city nor its lessees, shall make any charge for parking at the centers. Sec. 50-278. - Religious services. No regularly scheduled religious services shall be permitted at the centers. Sec. 50-279. - Security officers. It shall be the responsibility of the director of parks and recreation, or his designee, to determine the number of security officers required for each event, and to arrange for such security service. The security service charge will be provided at the officers prevailing contract rate and will be in addition to the rental rate. Sec. 50-280. - Rules and regulations. Rental of centers will be subject to reasonable rules and regulations, which shall be promulgated by the director of parks and recreation, or his designee, with the approval of the city manager. The city reserves the right to refuse rental of its centers to any person, firm, or group, for lewd or immoral purposes, or when the activities of such group may reasonably be expected to result in a breach of the peace, or cause a threat to public health or safety." Section 7: That Chapter 50, "Parks and Recreation," Appendix — A "Fees", Article III "Swimming Pools", Article IV "Softball Fields", Article V "Fitness Center", Article VI "Sylvan Beach", and Article VII "Civic and Recreation Centers" is hereby amended and shall hereinafter read as follows: Article III. Swimming Pools Description Amount Section this Code (a) Daily admission rates 50-71(e) (1) *Little Cedar Bayou Wave Pool: a. Two years and under Free b. Three to 59 years old 3.00 c. Three years and over 1.00 c. Senior citizens (60 and over) 0.75 (3) Fairmont Municipal Pools: a. I All ages Free (b) Facility rentals: 50-71(f) (1) Little Cedar Bayou Wave Pool: a. Base rental (maximum of 200 people), minimum two- hour 125.00 b. Available for rental Monday through Sunday upon availability to any individual or organizations engaged in for profit activity at $100.00 per hour plus five percent of gross revenues or flat rate of $30.00 per hour, whichever is greater. This class shall also apply to any commercial event organized for the purpose of profiting from the public at this facility. The commercial group/individual must furnish a comprehensive general liability policy, with the city named as an additional named insured, with limits of liability of not Tess than $500,000.00 combined single limit bodily injury and property damage per occurrence. The organization shall furnish the city with a certificate of insurance evidencing such coverage. (2) Northwest Park Swimming Pool: a. *Base rental (maximum of 100 people), two-hour rentals only 100.00/hr (3) It shall be the responsibility of the director of parks and recreation, or his designee, to determine the number of security officers required for each event and to arrange for such security service. The security charge will be the actual cost and will be in addition to the rental rate. (4) Reservations for rentals of the Wave Pool and Northwest Pool may be made either by phone or in person at the parks and recreation administration office. Reservations must be accompanied by a reservation and damage deposit of $100.00 within 48 hours after booking. The reservation and damage deposit will reserve the facility for the lessee until rental payments are due and will provide protection to the lessor for any damage to the pools caused by lessee. Rental payment and security fee shall be paid in full no later than 14 days prior to the event. The reservation and damage deposit will be refunded to the lessee within 15 days after the event, less any deductions for damages incurred. (5) Rental dates that are canceled shall provide written notice of the cancellation to the city at least two weeks prior to reservation date in order to receive a full refund. (6) Rental of Wave Pool and Northwest Pool will be subject to reasonable rules and regulations, which shall be promulgated by the director of parks and recreation or his designee, with the approval of the city manager. The City of La Porte reserves the right to refuse rental to any person, firm, or group for lewd or immoral purposes, or where the activities of such group may reasonably be expected to result in a breach of the peace or cause a threat to public health or safety. (7) The parks and recreation director or his designee shall promulgate liability insurance requirements for lessees. (8) Neither the City of La Porte nor its lessees, shall make any charge for parking at the pools. (9) The parks and recreation director, with approval from the city manager, will retain the privilege to work with city administration to discount admission prices and/or offer special events/programs. Softball Fields (a) Fees for field rentals: 50-112 (1) Little Cedar Bayou Softball Fields 1 and 2, Northside Park Softball/Baseball Field, Pecan Parks Fields 1 through 10, and Fairmont Park Ballfields and Practice Fields a. Resident - Tournaments/leagues, per field, per day, day use only 60.00 Resident - If lights are needed, additional per hour, per field 10.00 Non -Resident - Tournaments/leagues, per field, per day, day use only 120.00 Non -Resident - If lights are needed, additional per hour, per field 10.00 b. Resident - Hourly rentals, per hour, per field, with lights 10.00 Resident - Per hour, per field, without lights 7.50 Non -Resident - Hourly rentals, per hour, per field, with lights 30.00 Non -Resident - Per hour, per field, without lights 20.00 (2) Little Cedar Bayou Soccer Fields: a. Tournaments/leagues, per field, per day, day use only 60.00 If lights are needed, additional per hour, per field 10.00 b. Section 9: Should any section or part of this ordinance be held unconstitutional, illegal, or invalid, or the application to any person or circumstance for any reasons thereof ineffective or inapplicable, such unconstitutionality, illegality, invalidity, or ineffectiveness of such section or part shall in no way affect, impair or invalidate the remaining portions thereof; but as to such remaining portion or portions, the same shall be and remain in full force and effect and to this end the provisions of this ordinance are declared to be severable. Section 10: The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council is posted at a place convenient to the public at the City Hall of the city for the time required by law preceding this meeting, as required by Chapter 551, Tx. Gov't Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 11: Any person, as defined in Section 1.07 (27), Texas Penal Code, who shall violate any provision of the ordinance, shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed FIVE HUNDRED DOLLARS ($500.00). Section 12: This ordinance shall be effective fourteen (14) days after its passage and approval. The City Secretary shall give notice of the passage of this ordinance by causing the caption hereof to be published in the official newspaper of the City of La Porte at least once within ten (10) days after the passage of this ordinance, in accordance with the City of La Porte Charter.
