HomeMy WebLinkAboutOrd 2025-5020_renaming W. Tyler St. to Tommy C. Moser St.ORDINANCE 2025-5020 AN ORDINANCE APPROVING AND AUTHORIZING THE RENAMING OF THE W. TYLER STREET RIGHT-OF-WAY TO TOMMY C. MOSER STREET, BETWEEN NORTH BROADWAY STREET AND STATE HIGHWAY 146; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; CONTAINING SEVERABILITY AND REPEALING CLAUSES; FINDING COMPLIANCE WITH THE OPEN MEETINGS ACT; AND PROVIDING AN EFFECTIVE DATE HEREOF WHEREAS, Tommy C. Moser, former District 4 City Councilman, passed away on June 19, 2015; and WHEREAS, Tommy C. Moser served with distinction both as a member of the La Porte City Council and as a citizen of the La Porte community; and WHEREAS, the La Porte City Council desires to honor the legacy of Tommy C. Moser by renaming the W. Tyler Street right-of-way, between North Broadway Street and State Highway 146, to Tommy C. Moser Street; and WHEREAS, Chapter 2 "Administration" of the Code of Ordinances of the City of La Porte, Texas, establishes guidelines for the naming of municipal facilities; and WHEREAS, Chapter 2 of the Code of Code of Ordinances authorizes the renaming of municipal facilities in honor of individuals who have provided a positive impact on the development and wellbeing of the entire community, as well as local leaders who provided outstanding personal service that resulted in a significant and enduring contribution to the community; and WHEREAS, pursuant to the renaming policy a standing committee, composed of Councilmembers from the three at -large positions (mayor, position "A," and position "B"), met on November 17, 2025, to consider renaming the W. Tyler Street right-of-way, between North Broadway Street and State Highway 146, to Tommy C. Moser Street, and on such date voted unanimously to present their recommendation to the full City Council that the W. Tyler Street right-of-way, between North Broadway Street and State Highway 146, by renamed as Tommy C. Moser Street; and WHEREAS, the La Porte City Council finds that Tommy C. Moser held an elected position of the city as representative of District 4, and that during his entire tenure as a member of the La Porte City Council Tommy C. Moser provided outstanding personal service that has resulted in a significant and enduring contribution to the community. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: Section 1. That the facts and matters set forth in the preamble of this ordinance are hereby found to the true and correct. Section 2. The City Council hereby approves and authorizes the renaming of the W. Tyler Street right-of-way, between North Broadway Street and State Highway 146, to Tommy C. Moser Street. Section 3. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 4. All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 5. Should any section or part of this ordinance be held unconstitutional, illegal, or invalid, or the application to any person or circumstance for any reasons thereof ineffective or inapplicable, such unconstitutionality, illegality, invalidity, or ineffectiveness of such section or part shall in no way affect, impair or invalidate the remaining portions thereof; but as to such remaining portion or portions, the same shall be and remain in full force and effect and to this end the provisions of this ordinance are declared to be severable. Section 6. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council is posted at a place convenient to the public at the City Hall of the city for the time required by law preceding this meeting, as required by Chapter 551, Tx. Gov't Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof have been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 7. This ordinance shall be effective immediately upon its passage and approval. PASSED AND APPROVED this, the 8th day of December, 2025.
