HomeMy WebLinkAboutOrd 2025-5010_closing 0.79 acres in blk. 11 of Brookglen Sec. 2ORDINANCE NO. 2025-5010 AN ORDINANCE VACATING, ABANDONING AND CLOSING APPROXIMATELY 0.79 ACRES OF LAND (34,328 SQUARE FEET), OAKHAVEN ROAD RIGHT-OF-WAY IN BLOCK 11 OF THE BROOKGLEN SECTION 2 SUBDIVISION, HARRIS COUNTY, TEXAS, AND AUTHORIZING THE EXECUTION AND DELIVERY OF A DEED TO THE ADJOINING LANDOWNER; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; CONTAINING A SEVERABILITY CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE HEREOF. WHEREAS, the City Council of the City of La Porte has been requested by the record owner of the property abutting the 60-foot right-of-way in Block 11 of the Brookglen Section 2 subdivision, Harris County, Texas, to vacate, abandon and close 34,328 square feet of said right -of way, and; WHEREAS, the City Council of the City of La Porte has determined and does hereby find, determine, and declare that the Oakhaven Road 60-foot right-of-way in Block 11 of the Brookglen Section 2 subdivision, Harris County, Texas is not suitable, needed, or beneficial to the public as a public road, street, or alley, and the closing Oakhaven Road 60-foot right-of-way in Block 11 of the Brookglen Section 2 subdivision, Harris County, Texas, is for the protection of the public and for the public interest and benefit, and that Oakhaven Road 60-foot right-of-way in Block 11 of the Brookglen Section 2 subdivision, Harris County, Texas, should be vacated, abandoned, and permanently closed. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: Section 1. Under and by virtue of the power granted to the City of La Porte under its home rule charter, Chapter 62 of the City of La Porte Code of Ordinances and Chapter 253, Texas Local Government Code, Oakhaven Road 60-foot right-of-way in Block 11 of the Brookglen Section 2 subdivision, Harris County, Texas is hereby permanently vacated, abandoned, and closed by the City of La Porte, such right-of-way being generally illustrated on Exhibit "A" incorporated herein, and further described to wit: BEING a parcel of land containing 0.7881 acres (34,328 square feet) situated in the William M. Jones Survey, Abstract 482, of Harris County, Texas, and being out of Brookglen Section 2 as recorded in Volume 167, Page 109 of the Map Records of Harris County, Texas (MRHC). Said 34,328 square foot parcel being more particularly described by metes and bounds as follows: Note: The basis of bearing for this legal description is tied to NSRS and expressed in the Texas Coordinate System, South Central Zone 4204, NAD '83 (2011), ITD+RF (EPOCH 2010.0000, NADD '88 (GD 99), all coordinates are expressed in grid and all distances and bearings are expressed in surface values. To obtain grid values multiply surface values by the scale factor 0.999882464089. COMMENCING at a 3/8-inch iron rod found in the west right of way of Gladwyne Lane (60' wide) and being the southeast corner of Lot 56 and northeast corner of Lot 55, Block 1 of said Brookglen, Section 2, point having grid coordinates X=3,205,986.87, Y=13,808,121.07. THENCE South 03° 06' 37" East with the west right of way line of said Gladwyne Lane (60' wide), a distance of 125.49 feet to the southeast comer of Lot 54, Block 1 of said Brookglen, Section 2 and the northwest corner at the intersection of said Gladwyne Lane (60' wide) and Ashwyne Lane (60' wide); THENCE South 03° 06' 37" East, over and across said Ashwyne Lane (60' wide), a distance of 60.00 feet to the northeast corner of Lot 18, Block 11 of said Brookglen, Section 2 and the southwest corner at the intersection of said Gladwyne Lane (60' wide) and Ashwyne Lane (60' wide); THENCE South 03° 06' 37" East continuing with the west right of way line of said Gladwyne Lane (60' wide), a distance of 210.00 feet to a point (unable to set) for the southeast corner of Lot 17, Block 11 of said Brookglen, Section 2, the northwest corner at the intersection of said Gladwyne Lane (60' wide) and Oakhaven Road (60' wide) and to the POINT OF BEGINNING, said point having grid coordinates X=3,206,008.33, Y=13,807,726.20; THENCE South 03° 06' 37" East, over and across said Oakhaven Road (60' wide), a distance of 60.00 feet to a 5/8-inch iron rod with UEI cap set for the northeast corner of Lot 1, Block 11 of said Brookglen, Section 2 and the southwest corner of the intersection of said Gladwyne Lane (60' wide) and Oakhaven Road (60' wide); THENCE South 87° 08' 55" West, with the south right of way line od said Oakhaven Road (60' wide), a distance of 482.38 feet to a 5/8-inch iron rod with UEI cap set on the north line of Lot 8, Block 11 of said Brookglen, Section 2 and being the beginning of a non -tangent curve to the right; THENCE, in a northwesterly direction, continuing along the southerly/northerly right of way line of said Oakhaven Road (60' wide) and with the arc of siad curve to the right whose central angle is 258° 27' 09, and whose radius is 50.00 feet, (chord bears North 36° 23' 08" East, a distance of 77.47 feet) for an arc length of 225.54 feet to an 'X' cutin concrete set for angle point on the northerly right of way line of said Oakhaven Road (60' wide) and being on the soiuth line of Lot 11, Block 11 of said Brookglen, Section 2; THENCE North 87° 08' 55" East, with the north right of way line of said Oakhaven Road (60' ide), a distance of 433.11 feet to the POINT OF BEGINNING and containing 0.7881 acres (34,328 square feet) of land. Note: This metes and bounds description is referenced to a survey plat prepared by United Engineers, Inc. dated October 7, 2024 and titled "STANDARD LAND SURVEY OF 0.7881 ACRE TRACT" Section 2. That the abandonment, vacation and closure provided for herein is made and accepted subject to all present zoning and deed restrictions if the latter exist, and all easements, whether apparent or non -apparent, aerial, surface or underground. Section 3. That the abandonment, vacation and closure provided for herein shall extend only to the public right, title, easement and interest and shall be construed to extend only to that interest which the governing body for the City of La Porte may legally and lawfully abandon, vacate and close. Section 4. That the City Manager is hereby authorized to execute and deliver a Deed Without Warranty to the abutting owner upon completion of all conditions and requirements set forth in this Ordinance. Section 5. That the abutting property owner shall pay all costs associated with procedures necessitated by the request to abandon Oakhaven Road 60-foot right-of-way in Block 11 of the Brookglen Section 2 subdivision, Harris County, Texas, as described in this Ordinance, of such abandoned property in accordance Chapter 62 of the City of La Porte Code of Ordinances. Section 6. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place, and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered, and formally acted upon. The City Council further ratifies, approves, and confirms such written notice and the contents and posting thereof. Section 7: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. Section 8. If any part or portion of this ordinance shall be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect or impair any remaining portions or provisions of the ordinance. Section 9. This ordinance shall be effective from and after its passage and approval, and it is so ordered. PASSED AND APPROVED THIS 8TH DAY OF DECEMBER 2025.
