AN ORDINANCE VACATING, ABANDONING AND CLOSING APPROXIMATELY
6,520 SQUARE FOOT PORTION OF THE DEVELOPED 80-FOOT W. ADAMS STREET
RIGHT-OF-WAY BETWEEN N. 13TH STREET TO THE WEST AND N. 12TH STREET
TO THE EAST, AN APPROXIMATELY 24,000 SQUARE FOOT PORTION OF THE
UNDEVELOPED 60-FOOT N. 12TH STREET RIGHT-OF-WAY BETWEEN W. POLK
STREET TO THE SOUTH AND W. ADAMS STREET TO THE NORTH, AND AN
APPROXIMATELY 6,400 SQUARE FOOT PORTION OF AN UNDEVELOPED 16-
FOOT ALLEYWAY BETWEEN LOTS 1-16 AND 17-32, BLOCK 685 OF THE TOWN OF
LA PORTE SUBDIVISION, HARRIS COUNTY, TEXAS; CONTAINING A
SEVERABILITY CLAUSE; CONTAINING A SAVINGS CLAUSE; FINDING
COMPLIANCE WITH THE OPEN MEETINGS ACT; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the City of La Porte has been requested by Twilight Cemetery,
Inc., the record owner of property abutting 1) an approximately 6,520 square -foot portion of the
W. Adams Street 80-foot right-of-way between N. 13th Street and N. 12th Street, 2) an
approximately 24,000 square -foot portion of the N. 12th Street 60-foot right-of-way between W.
Polk Street and W. Adams Street, and 3) an approximately 6,400 square -foot portion of the 16-
foot alleyway between Lots 1-16 and 17-32, Block 685 of the Town of La Porte subdivision, Harris
County, Texas, to vacate, abandon and close said rights -of way.
WHEREAS, the City Council of the City of La Porte has determined and does hereby find,
determine, and declare that 1) the approximately 6,520 square -foot portion of the W. Adams Street
80-foot right-of-way between N. 13th Street and N. 12th Street, 2) the approximately 24,000
square -foot portion of N. 12th Street 60-foot right-of-way between W. Polk Street and W. Adams
Street, and 3) an approximately 6,400 square -foot portion of the 16-foot alleyway between Lots 1-
16 and 17-32, Block 685 of the Town of La Porte subdivision, Harris County, Texas are not
suitable, needed, or beneficial to the public as a public road, street, or alley, and the closing of 1)
the approximately 6,520 square -foot portion of the W. Adams Street 80-foot right-of-way between
N. 13th Street and N. 12th Street, 2) the approximately 6,520 square -foot portion of N. 12th Street
60-foot right-of-way between W. Polk Street and W. Adams Street, and 3) an approximately 6,400
square -foot portion of the 16-foot alleyway between Lots 1-16 and 17-32, Block 685 of the Town
of La Porte subdivision, Harris County, Texas, is for the protection of the public and for the public
interest and benefit, and that 1) the approximately 6,520 square -foot portion of the W. Adams
Street 80-foot right-of-way between N. 13th Street and N. 12th Street, 2) the approximately 24,000
square -foot portion of N. 12th Street 60-foot right-of-way between W. Polk Street and W. Adams
Street, and 3) an approximately 6,400 square -foot portion of the 16-foot alleyway between Lots 1-
16 and 17-32, Block 685 of the Town of La Porte subdivision, Harris County, Texas, should be
vacated, abandoned, and permanently closed.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS:
Section 1. Under and by virtue of the power granted to the City of La Porte under its home rule
charter, Chapter 62 of the City of La Porte Code of Ordinances and Chapter 272, Texas
Local Government Code, that 1) an approximately 6,520 square -foot portion of the W.
Adams Street 80-foot right-of-way between N. 13th Street and N. 12th Street, 2) an
approximately 24,000 square -foot portion of the N. 12th Street 60-foot right-of-way
between W. Polk Street and W. Adams Street, and 3) an approximately 6,400 square -
foot portion of the 16-foot alleyway between Lots 1-16 and 17-32, Block 685 of the
Town of La Porte subdivision, Harris County, Texas, and containing 0.8476 acres or
36,920 square feet of land, is hereby permanently vacated, abandoned, and closed by
the City of La Porte, Texas, such right-of-way being generally illustrated on Exhibit
"A" incorporated herein, and further described to wit:
BEING a 0.8476 acre tract of land in the City of La Porte, Harris County, Texas, being
part of North 12th Street, part of West Adams Street and all of a 16 foot wide alley in
Block 685 of said Town of La Porte:
BEGINNING at the northwest corner of said Block 685 located at the intersection of
the east line of North 13th Street and the south line of West Adams Street;
THENCE north 20.00 feet to the northwest corner of this tract;
THENCE east, parallel with and 20.00 feet north of the south line of said West Adams
Street, a distance of 326.00 feet to the northeast corner of this tract;
THENCE south, at 20.00 feet pass the northwest corner of Block 72, Town of La Porte,
located at the intersection of the south line of said West Adams Street and the east line
of North 12th Street, a total distance of 420.00 feet to the southeast corner of this tract
and the southwest corner of said Block 72 located at the intersection of the east line of
said North 12th Street and the north line of West Polk Street;
THENCE west 60.00 feet along the north line of said West Polk Street to the southeast
corner of said Block 685 located at the intersection of the west line of said North 12th
Street and the north line of said West Polk Street;
THENCE north, along the west line of said North 12th Street and the east line of said
Block 685, a distance of 400.00 feet to the northeast corner of said Block 685 located
at the intersection of the west line of said North 12th Street and the south line of said
West Adams Street;
THENCE west, along the south line of said West Adams Street and the north line of
said Block 685, a distance 125.00 feet to a point located on the east line of a 16 foot
wide alley;
THENCE south, along the east line of said alley, a distance of 400.00 feet to a point
on the south line of said Block 685 and the north line of said West Polk Street;
THENCE west, along the south line of said Block 685 and the north line or said West
Adams Street, a distance of 16.00 feet to a point on the west line of said 16.00 foot
wide alley;
THENCE north along the west line of said alley, a distance of 400.00 feet to a point
on the north line of said Block 685 and the south line of said West Adams Street;
THENCE west, along the north line of said Block 685 and the south line of said West
Adams Street, a distance 125.00 feet to the point of beginning and containing 36,920
square feet or 0.8476 acre of land.
Section 2. That the abandonment, vacation and closure provided for herein is made and accepted
subject to all present zoning and deed restrictions if the latter exist, and all easements,
whether apparent or non -apparent, aerial, surface or underground.
Section 3. That the abandonment, vacation and closure provided for herein shall extend only to
the public right, title, easement and interest and shall be construed to extend only to
that interest which the governing body for the City of La Porte may legally and lawfully
abandon, vacate and close.
Section 4. The City Council finds that the applicant, Twilight Cemetery, Inc., and additionally,
Nettie Warren, BTE Properties, LLC, and Oakland Land and Development, LLC are
collectively all of the owners of property abutting the rights -of -way made the subject
of this ordinance, and that, Nettie Warren, BTE Properties, LLC, and Oakland Land
and Development, LLC have elected to release their interest in the said rights -of -way
as adjacent property owner to applicant Twilight Cemetery, Inc., as indicated in
Exhibit B in Twilight Cemetery, Inc.'s application; and
Section 5. That the City Manager is hereby authorized to execute and deliver a Deed Without
Warranty as the rights -of -way made the subject of this ordinance to Twilight Cemetery,
Inc., upon completion of all conditions and requirements set forth in this ordinance.
Section 6. The City Council finds that Twilight Cemetery, Inc. is a tax exempt non-profit
corporation, and that as allowed by Section 62-34 of the Code of Ordinances of the
City of La Porte, Texas, and Section 272.001(b) of the Texas Local Government Code,
should be exempted from paying fair market value to the city for the abandonment,
vacation and closure of the said rights -of -way.
Section 7. The City Council officially finds, determines, recites, and declares that a sufficient
written notice of the date, hour, place, and subject of this meeting of the City Council
was posted at a place convenient to the public at the City Hall of the City for the time
required by law preceding this meeting, as required by the Open Meetings Act,
Chapter 551, Texas Government Code; and that this meeting has been open to the
public as required by law at all times during which this ordinance and the subject
matter thereof have been discussed, considered, and formally acted upon. The City
Council further ratifies, approves, and confirms such written notice and the contents
and posting thereof.
Section 8: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the
extent of the conflict only.
Section 9. If any part or portion of this ordinance shall be
invalidity or unconstitutionality shall not affect or
provisions of the ordinance.
Section 10. This ordinance shall be effective from and after its
ordered.

Dear Ms. Briscoe:
It is my understanding that Twilight Cemetery, Inc., as Applicant, has applied to the City
of La Porte to abandon a portion of two streets along the northern and eastern boundary
of its property, along with an alleyway running through the center of its property. It is my
opinion that Applicanthas good fee simple title to the property, which is adjacent and
contiguous to or contains the portions of the streets and alleyway to be closed/abandoned.
I have attached a true and correct copy of the recorded Special Warranty Deed vesting fee
simple title in the Applicant, which shows the conveyance from the predecessor in interest,
anunincorporated cemetery association, to Applicant, a non-profit corporation established
as a cemetery.

4. A non-refundable processing fee of $750.00 made payable by check to CenterPoint Energy must accompany this application
before it can be processed.
If this request is approved, a letter will be issued by CenterPoint Energy, addressed to the appropriate government once, providing the Company's
approval to the closure request. This letter will be forwarded to the requestor unless CenterPoint Energy is requested otherwise.
if CenterPoint Energy's facilities must remain in a street/alley to be closed, new easements, as prepared by CenterPoint Energy must be granted by
each adjacent landowner who will assume title to any portion of the street/alley before an approval letter will be issued. In addition to the
processing fee. if CenterPoint Energy's facilities are located within the area to be abandoned, the cost for CenterPoint Energy to prepare these
easement documents will be passed along to the requestor of this service.
CenterPoint Energy requires a time period of approximately 5-6 weeks for review and document preparation. In the event electrical facilities must
be relocated or removed, or new easements granted because of this request. a longer time period may be required. Should the relocation of

The City of La Porte, Texas has been asked to close and abandon a portion of North
12th street, 16' wide alley located in block 685, and the most southerly 20' of West
Adams located adjacent to and adjoining the north property line of said block 685 of La
Porte, Tx. Those areas to be closed as highlighted on the Exhibit "A", attached hereto
and made a part hereof.
CenterPoint Energy Houston Electric, LLC, CenterPoint Energy Resources Corporation,
d/b/a CenterPoint Energy Texas Gas Operations and CenterPoint Energy Intrastate
Pipelines, Inc., herein collectively called "CenterPoint Energy", has investigated the
request and determined that it has no facilities located within the area to be abandoned.
Therefore, CenterPoint Energy will interpose no objection to the request as filed.
This letter of concurrence shall become null and void in the event two (2) years has
transpired from the above date and this street/alley closure has not been completed.
CenterPoint Energy respectfully requests that the City of La Porte, Texas forward a

[Comcast entity], a [Delaware Limited Liability Company], herein referred to as "Comcast
Cable", has been asked to provide a letter of "No Objection" for the above referenced property
dated [Jun 2025].
At this time, Comcast Cable has no objection associated with the general layout and utility
easements as exhibited on said plat, subject to the following caveats.
This "No Objection" letter is based solely on Comcast Cable's review of the survey plat and
Comcast Cable's preliminary review to confirm that it has no existing infrastructure or land use
rights within the area described on the survey plat (the "Property"). Comcast Cable has not
reviewed any declarations or other materials or filings related to the Property. If Comcast Cable
does in fact have infrastructure or land use rights within the Property, this No Objection letter is
deemed withdrawn, and Comcast Cable would require additional review before reissuing a No
Objection letter.
This letter should not be construed to mean that the utility easements and layout shown on the
plat are sufficient for Comcast Cable to provide service on the Property. In cases where utility
easements are overlapping with drainage or other specific or pre-existing easements, Comcast
Cable may require easements to provide service to the Property. This letter should not be
construed to mean that Comcast waives any rights it may have under federal or state law to
utilize the utility easements on the plat for Comcast Cable to provide service on the Property.
Upon completion of Comcast Cable's facility design, if so required, current dedicated utility
easements may be determined inadequate by Comcast Cable. In these cases, Comcast Cable will
request easements from the developer, or its successors or assigns, to provide service to the
Property.
This letter does not give consent to any encroachments, abandonments of pre-existing easements,
roads, alleys, or street rights -of -way. Abandonment of any of the above requires a formal review,
consent, and closure process. Further, by this letter, Comcast Cable provides no approval or
verification of any aspect of the survey, its compliance with law or industry standards or its
effectiveness. Comcast makes no representations, warranties, agreements, waivers or grants of
any kind, related to real property or otherwise, whether express or implied, and this letter does
not modify any agreement between Comcast Cable and you or any third party. This letter is for
your benefit only and should not be relied upon by third parties.
