The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council is posted at a place convenient to the public at the City Hall of the city for the time required by law preceding this meeting, as required by Chapter 551, TX. Gov't Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 5. The City Council of the City of La Porte hereby finds that public notice was properly mailed to all owners of all properties located within three hundred feet (300') of the properties under consideration. Section 6. The City Council of the City of La Porte hereby finds, determines, and declares that all prerequisites of law have been satisfied and hereby determines and declares that the amendments to the City of La Porte Zoning Classification contained in this Ordinance as amendments thereto are desirable and in furtherance of the goals and objectives stated in the City of La Porte's Comprehensive Plan. Reserve 2 is approximately 43-acres along Spencer Hwy. and will have an underlying zoning district of Business Industrial (BI) and are subject to regulations applicable to development within BI zoning district, except as specifically provided otherwise in this SCUP. The purpose of the BI district is to provide for the establishment of industrial development that is compatible with surrounding or abutting residential districts and to encourage high level performance standards. Development in the BI district is limited to administrative, wholesaling, manufacturing and related compatible uses, with suitable open spaces, landscaping and parking area. 5. Reserve 3 is approximately 72-acres along Bay Area Blvd. and will have an underlying zoning district of General Commercial (GC) and are subject to regulations applicable to development within GC zoning district, except as specifically provided otherwise in this SCUP. The purpose of the GC district is to provide for low intensity, retail or service outlets which deal directly with the customer for whom the foods or services are furnished. The uses allowed in this district are to provide goods and services on a community market scale and located in areas which are well served by collector or arterial street facilities. 6. No building shall be larger than 85,000 ft.' in total floor area in Reserves 1 and 2. 7. Architectural design guidelines for facades and buildings: (a) Building Form. (1) All buildings shall be designed and constructed in tri-partite architecture so that they have a distinct base, middle and top (paint or texture can be used to satisfy the tri-partite architecture requirement). 4 Examples of Single Story Tri-Partite (b) Top fi -•. • Middle Base Top Building Articulation. (1) Primary facades clearly visible from a public street or along an active storefront shall meet the following minimum standards for articulation: a. Horizontal Articulation. No building wall shall extend for a distance equal to three times the wall's height without having a minimum off -set of 5 feet, and that new plane shall extend for a distance equal to at least 25% of the maximum length of the first plane. b. Vehicles parked and/or stored outdoors overnight before or after being serviced must be screened in compliance with the designated commercial performance standards for outdoor storage. This restriction does not apply to establishments that maintain an average one -day turnaround time such as businesses offering oil changes. Establishments with pre-existing, nonconforming uses are prohibited from parking and/or storing any vehicle outdoors in locations visible from a public right-of-way for a duration exceeding 14 consecutive calendar days. 27. Use condition applies to NAICS 3341 (Footnote 18) — Proposed use must be located on a parcel that is no greater than 1.5 acres and building and/or buildings where use is located may not exceed 15,000 sq. ft. 28. Any substantive modifications to this SCUP will require an amendment to this SCUP in accordance with Chapter 106, "Zoning" of the City's Code of Ordinances. Failure to start construction of the site within 5 years (60 months) after issuance shall void the permit as approved, except upon an extension of time granted after application to the Planning and Zoning Commission. If contract or agreement is terminated after completion of any stage and there is ample evidence that further development is not contemplated, the ordinance establishing such SCUP may be rescinded by the City Council, upon its own motion or upon the recommendation of the Planning and Zoning Commission of the City of La Porte, and the previous zoning of the entire tract shall be in full effect on the portion which is undeveloped.
