AN ORDINANCE VACATING, ABANDONING AND CLOSING THE, SOUTH 11TA
STREET RIGHT-OF-WAY BETWEEN BLOCK 1 AND BLOCK 2, LA PORTE,
HARRIS COUNTY, TEXASI AUTHORIZING THE EXECUTION AND DELIVERY OF
A DEED TO THE ADJOINING LANDOWNER, FINDING COMPLIANCE WITH THE
OPEN MEETINGS LAW1 AND PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the City of La Porte has been
requested by the record owners of all of the property abutting
the hereinafter described South 11th Street Right -of -Way, to
vacate, abandon, and permanently close the hereinafter described
South 11th Street Right -of -Way; and,
WHEREAS, the City Council of the City of La Porte has
determined and does hereby find, determine, and declare that the
hereinafter described South 11th Street Right -of -Way is not
suitable, needed, or beneficial to the public as a public road,
street, or alley, and the closing of hereinafter described South
11th Street Right -of -Way is for the protection of the public and
for the public interest and benefit, and that the hereinafter
described South 11th Street Right -of -Way should be vacated,
abandoned, and permanently closed.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. Under and by virtue of the power granted to
the City of La Porte under its home rule charter and Chapter
253, Section 253.001, Texas Local Government Code, the
hereinafter described South lith Street Right -of -Way is hereby
permanently vacated, abandoned, and closed by the City of La
Porte, to wit:
A 24,000 square foot portion of the South lith Street
Right -of -Way (60, wide), being generally illustrated
on Exhibit "A" incorporated by reference herein, and
further described by metes & bounds as follows:

BEGINNING at the northeast corner of Lot 32, Block 1,
La Porte'
THENCE in an easterly direction, along the south
right-of-way line of West "C" Street (60' wide), a
distance of 60 feet to a point at the northwest corner
of Lot 1, Block 2, La Porter
THENCE in a southerly direction, along the west Line
of Lots 1 through 16, Block 2, La Porte, a distance of
400 feet to a point marking the southwest corner of
Lot 16, Block 2, La Porte, said point being in the
West "D" Street Right -of -Way (801 wide)f
THENCE in a westerly direction, along the north line
of West "D" Street Right -of -Way, a distance of 60 feet
to the southeast corner of Lot 17, Block I, La Porter
THENCE in a northerly direction, along the west line
of Lots I through 16, Block 2, La Porte, a distance of
400 feet to the northeast corner of Lot I, Block 1, La
Porte, and the POINT OF BEGINNING of the herein
described tract.
Section 2. Conditional to final execution and delivery of a
deed to the above described right-of-way, The City of La Porte
hereby requires that any and all improvements constructed within
this abandoned South 1Ith Street Right -of -Way fully accommodate,
in perpetuity, that portion of the overall volume of the F216-
00-00 detention basin originally designed within this abandoned
portion of the South 11th Street Right -of -Way as illustrated on
approved construction plans for F216-00-00 Linear Detention by
Binkley & Barfield Consulting Engineers (Job No. 108700 - dated
10/13/2008). No mitigation will be allowed in other areas of
the detention basin without prior approval of the City.
Section 3. The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the
date, hour, place, and7 subject of this meeting of the City
Council was posted at a place convenient to the public at the
City Hall of the City for the time required by law preceding

this meeting, as required by the Open Meetings Law, Chapter 551,
Texas Government Code; and that this meeting has been open to
the public as required. by law at all times during which this
ordinance and the subject matter thereof has been discussed,
considered, and formally acted upon. The City Council further
ratifies, approves, and confirms such written notice and the
contents and posting thereof.
Section 4. This ordinance shall be effective from and after its
passage and approval, and it is so ordered.
