Spencer Highway Estates, a subdivision with the map or plat thereof recorded in Volume 38,
Page 57 of the Map Records of Harris County, Texas; being that some tract of land as described
in Warranty Deed to Julia Jan Atkinson and Anthony Jason Atkinson, dated September 30, 2002
and recorded under Clerk's File Number W126514 of the Official Public Records of Real Property
of Harris County, Texas; said 0.4514 acre tract being more particularly described by metes and
bounds as follows with all bearings referenced to the North line of Belfast Lane, a 60 foot wide
right—of—way, as found monumented on the ground:
COMMENCING at a brass cap, found for the City of Lo Porte City Marker #109, based on a
coordinate value of North 13,808,784.5010 and East 3,209,537.6618 Texas Plane Coordinates,
South Central Zone, NAD83, scale factor 0.99994454;
THENCE North 64°52'32"West, a distance of 1,319.79 feet to a 5/8 inch iron rod with a survey
cap marked 'iGlezman, RPLS 4627", set for the Southeast corner and the Point of Beginning of
the herein described tract and being the Southeast corner of Lot 58, the Southwest corner of Lot
75, the Northwest corner of Lot 74, and the Northeast corner of Lot 59, in Block 5 of Spencer
Highway Estates;
THENCE West, a distance of 151.25 feet along the common line of Lot 58 and Lot 59, to a 5/8
inch iron rod with survey cap, set for the Southwest corner of the herein described tract
at the common corner of Lot 58 and Lot 59, in the East line of Bernard Street, a 60 foot
wide right—of—way;
THENCE North 00°16'00" West, a distance of 130.00 feet along the West line of Lot 58 and Lot

inch iron rod with survey cap, set for the Southeast corner of the 6000 square foot tract;
continuing in all, a distance of 130.00 feet, back to the Point of Beginning and
containing 0.4514 acre of land, based on the survey and plat prepared by Glezman
Surveying, Inc., dated June 6, 2013.

Atkinson, owner hereinafter referred to as
Owners of the 0.4514 acre tract described in
the above and foregoing map of Atkinson
Estates, do hereby make and establish said
subdivision and development plan of said
property according to all lines, dedications,
restrictions and notations on said map or plat
and hereby dedicate to the use of the public,
forever, all streets (except those streets
designated as private streets or permanent
access easements), alleys, parks, water courses,
drains, easements and public places shown'
thereon for the purposes and considerations
therein expressed; and do hereby bind ourselves,
our heirs, successors and assigns to warrant
and forever defend the title to the land so
dedicated.
FURTHER, Owners have dedicated and by
these presents do dedicate to the use of, the
public for public utility purposes forever
unobstructed aerial easement five (5) feet ` in
width from a plane twenty (20) feet above the
ground level upward, located adjacent to all
common use public utility easements shown
hereon.
FURTHER, Owners do hereby declare that all
parcels of land designated as lots on this plat
are originally intended for the construction of
single family residential dwelling units thereon
and shall be restricted for same under the
terms and conditions of such restrictions filed
separately.
Owners do hereby dedicate to the public a
strip of land fifteen (15) feet wide on each side
of the high bank of any and all bayous, creeks,
gullies, ravines, draws, sloughs or other natural
drainage courses located and depicted upon in
said plat, as easements for drainage purposes,
giving the City of La Porte, Harris County, or
any other governmental agency, the right to
enter upon said easement at any time and all
times for the purpose of construction and
maintenance of drainage facilities and
structures.
Owners do hereby covenant and agree that
all of the property within the boundaries of this
plat and adjacent to any drainage easement,
ditch, drainage ways and easements clear of
fences, buildings, and other obstructions to the
operations and maintenance of the drainage
facility and that such abutting property shall
not be permitted to drain directly into this
easement except by means of an approved
drainage structure.
FURTHER, Owners hereby certify that this replat does not
attempt to alter, amend, or remove any covenants or restrictions.
