HomeMy WebLinkAboutO-2014-3546 closing a portion of the North 3rd Street Right-of-Way and the alley in Block 330ORIGINAL ORDINANCE NO. 2 01*- _� 54W AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF THE, NORTH 3' STREET RIGHT-OF-WAY AND THE ALLEY IN BLOCK 330, LA PORTE, HARRIS COUNTY, TEXAS; RETAINING UTILITY EASEMENTS AND AUTHORIZING THE EXECUTION AND DELIVERY OF A DEED TO THE ADJOINING LANDOWNERS, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. WHEREAS, the City Council of the City of La Porte has been requested by the record owners of all of the property abutting the hereinafter described portion of the North 3rd Street Right -of -Way and the alley in Block 330, La Porte, to vacate, abandon, and permanently close the hereinafter described portion of the North 3rd Street Right - of -Way and the alley in Block 330, La Porte, and, WHEREAS, the City Council of the City of La Porte has determined and does hereby find, determine, and declare that the hereinafter described portion of the North 3rd Street Right -of -Way and the alley in Block 330, La Porte, is not suitable, needed, or beneficial to the public as a public road, street, or alley, and the closing of hereinafter described portion of the North 3rd Street Right -of -Way and the alley in Block 330, La Porte, is for the protection of the public and for the public interest and benefit, and that the hereinafter described portion of the North 3rd Street Right -of -Way and the alley in Block 330, La Porte, should be vacated, abandoned, and permanently closed. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. Under and by virtue of the power granted to the City of La Porte under its home rule charter and Chapter 253, Section 253.001, Texas Local Government Code, the hereinafter described portion of the North 3rd Street Right -of -Way and the alley in Block 330, La Porte, is hereby permanently vacated, abandoned, and closed by the City of La Porte, to wit: a "TRACT ONE" - NORTH 3"D STREET RIGHT-OF-WAY: A 32,000 square foot portion of the North 3rd Street Right - of -Way (80' wide), being generally illustrated on Exhibit "A" incorporated by reference herein, and further described by metes & bounds as follows: BEGINNING at a point at the intersection of the west line of the North 3rd Street Right -of -Way and the . south line of the Barbour's Cut Boulevard Right -of -Way, said point being the northeast corner of Lot 32, Block 330, La Porte; THENCE in an easterly direction, along the south right-of- way line of Barbour's Cut Boulevard, a distance of 80 feet to a point on the east line of the North 3rd Street Right - of -Way, said point being the northwest corner of Lot 1, Block 329, La Porte; THENCE in a southerly direction, along the east line of the North 3rd Street Right -of -Way, a distance of 400 feet to a point at the southwest corner of Lot 16, Block 329, La Porte; THENCE in a westerly direction, along the north right-of- way line of the North "E" Street Right -of -Way, a distance of 80 feet to a point at the southeast corner of Lot 17, Block 330, La Porte; THENCE in a northerly direction, along the projected west right-of-way line of the North 3rd Street Right -of -Way, a distance of 400 feet to the northeast corner of Lot 32, Block 330, La Porte and the POINT OF BEGINNING of the herein described Tract One. "TRACT TWO" - ALLEY IN BLOCK 330, LA PORTE: The entire 6,400 square foot alley in Block 330, La Porte (16' wide) being generally illustrated on Exhibit "A" incorporated by reference herein, and further described by metes & bounds as follows: BEGINNING at a point at the intersection of the northeast corner of Lot 1, Block 330, La Porte and the south line of the Barbour's Cut Boulevard Right -of -Way; THENCE in an easterly direction, along the south right-of- way line of Barbour's Cut Boulevard, a distance of 16 feet to a point at the northwest corner of Lot 32, Block 330, La Porte; THENCE in a southerly direction, along the west line of Lots 17 through 32, Block 330, La Porte, a distance of 400 feet to a point at the southwest corner of Lot 17, Block 3 330, La Porte, said point being located on the north line of the North "E" Street Right -of -Way; THENCE in a westerly direction, along the north line of the North "E" Street Right -of -Way a distance of 16 feet to its intersection with the southeast line of Lot 16, Block 330, La Porte; THENCE in a northerly direction, along the east line of Lots 1 through 16, Block 330, La Porte, a distance of 400 feet to the POINT OF BEGINNING of the herein described Tract Two. Section 2. The City of La Porte hereby retains for itself, its successors and assigns, the following easements to wit: "EASEMENT ONE" - 80' WIDE DRAINAGE EASEMENT: A 32,000 square foot portion of the North 3rd Street Right - of -Way (80' wide), being generally illustrated on Exhibit "A" incorporated by reference herein, and further described by metes & bounds as follows: BEGINNING at a point at the intersection of the west line of the North 3rd Street Right -of -Way and the south line of the Barbour's Cut Boulevard Right -of -Way, said point being the northeast corner of Lot 32, Block 330, La Porte; THENCE in an easterly direction, along the south right-of- way line of Barbour's Cut Boulevard, a distance of 80 feet to a point on the east line of the North 3rd Street Right - of -Way, said point being the northwest corner of Lot 1, Block 329, La Porte; THENCE in a southerly direction, along the east line of the North 3rd Street Right -of -Way, a distance of 400 feet to a point at the southwest corner of Lot 16, Block 329, La Porte; THENCE in a westerly direction, along the north right-of- way line of the North "E" Street Right -of -Way, a distance of 80 feet to a point at the southeast corner of Lot 17, Block 330, La Porte; THENCE in a northerly direction, along the projected west right-of-way line of the North 3rd Street Right -of -Way, a distance of 400 feet to the northeast corner of Lot 32, Block 330, La Porte and the POINT OF BEGINNING of the herein described Tract One. 4 "EASEMENT TWO" - 16' WIDE WATER & SANITARY SEWER EASEMENT: The entire 6,400 square foot alley in Block 330, La Porte (16' wide) being generally illustrated on Exhibit "A" incorporated by reference herein, and further described by metes & bounds as follows: BEGINNING at a point at the intersection of the northeast corner of Lot 1, Block 330, La Porte and the south line of the Barbour's Cut Boulevard Right -of -Way; THENCE in an easterly direction, along the south right-of- way line of Barbour's Cut Boulevard, a distance of 16 feet to a point at the northwest corner of Lot 32, Block 330, La Porte; THENCE in a southerly direction, along the west line of Lots 17 through 32, Block 330, LaPorte, a distance of 400 feet to a point at the southwest corner of Lot 17, Block 330, La Porte, said point being located on the north line of the North "E" Street Right -of -Way; THENCE in a westerly direction, along the north line of the North "E" Street Right -of -Way a distance of 16 feet to its intersection with the southeast line of Lot 16, Block 330, La Porte; THENCE in a northerly direction, along the east line of Lots 1 through 16, Block 330, La Porte, a distance of 400 feet to the POINT OF BEGINNING of the herein described Tract Two. Section 3. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place, and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered, and formally acted upon. The City Council further ratifies, approves, and confirms such written notice and the contents and posting thereof. Section 4.
