M r AN ORDINANCE AMENDING CHAPTER 50 "PARKS AND RECREATION" BY ADDING ELECTRICAL USAGE FEE AND ADJUSTING RESERVATION AND DAMAGE DEPOSIT FEE, IN CONNECTION WITH RENTAL OF LIVESTOCK AND RODEO ARENA, AND AMENDING APPENDIX — A "FEES", OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE; PROVIDING A REPEALING CLAUSE; CONTAINING A SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HERE, OF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: Section 1: That Chapter 50, "Parks and Recreation," Article VIII "Livestock/Rodeo Arena", Section 50-302 "Days and hours available for rental; fees." of the Code of Ordinances of the City of La Porte, Texas, is hereby amended and shall hereinafter read as follows: "Sec. 50-302. Days and hours available for rental; fees. (a) The arena shall be available for rental, Monday through Sunday, at hours and rates as established by the city and listed in appendix A of this Code. (b) The arena may not be rented on the following holidays: Thanksgiving, Christmas Eve, Christmas Day, New Year's Day, Good Friday and Easter Sunday. (c) Lessees requiring additional time for move -in, move -out or rehearsal, prior to or immediately following an event, extending to additional days, will be charged one-half of the applicable full-time rate, providing the arena is not rented. The city will not be responsible for any items left on the premises. (d) Lessees renting the arena two or more consecutive days and requesting electrical usage connections for approved overnight stays shall be required to remit a fee for each electrical connection box utilized by the lessee at the rate established by the city and listed in appendix A of this Code." Section 2: That Chapter 50, "Parks and Recreation," Article VIII "Livestock/Rodeo Arena" Section 50-311 "Provision of free rental days to La Porte Livestock Show and Rodeo Association" of the Code of Ordinances of the City of La Porte, Texas, is hereby amended and shall hereinafter read as follows; "Sec. 50-311. Provision of free rental days to La Porte Livestock Show and Rodeo Association. The city has entered into an agreement with the La Porte Livestock Show and Rodeo Association, under the terms of which the city will provide to the association a total of 70 rental days at no charge per calendar year, in recognition of the association's contribution to the construction of the covered facility." Section 3: That Appendix — A "Fees", Chapter 50, "Parks and Recreation," Article VIII "Livestock/Rodeo Arena", is hereby amended and shall hereinafter read as follows: Article Vlll. Livestock/Rodeo Arena I (a) i I Rental hours and rates: 50-302(a) I (1) Monday—Thursday, 8:00 a.m. to 11:00 p.m...... 150.00 (2) Friday—Saturday, 8:00 a.m. to 12:00 midnight ..... 200.00 I (3) Sunday, 8:00 a.m. to 11:00 p.m...... 200.00 (b) Reservation and damage deposit ..... 200.00 50-304 (c) Electric usage fee for each overnight stay, per connection box I 20.00 50-302 Section 4: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 5: Should any section or part of this ordinance be held unconstitutional, illegal, or invalid, or the application to any person or circumstance for any reasons thereof ineffective or inapplicable, such unconstitutionality, illegality, invalidity, or ineffectiveness of such section or part shall in no way affect, impair or invalidate the remaining portions thereof, but as to such remaining portion or portions, the same shall be and remain in full force and effect and to this end the provisions of this ordinance are declared to be severable. Section 6. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council is posted at a place convenient to the public at the City Hall of the city for the time required by law preceding this meeting, as required by Chapter 551, Tx. Gov't Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 7.
