HomeMy WebLinkAboutR-2008-15A (amended to read effective "upon written notification by the State" removing January 1, 2009) RESOLUTION NO. 2008- 15-A A RESOLUTION REQUESTING THAT A PORTION OF STATE HIGHWAY BUSINESS 146 BE REMOVED FROM THE STATE HIGHWAY SYSTEM, FROM WHARTON WEEMS BOULEVARD TO STATE HIGHWAY 146 (BF 146D); FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. WHEREAS, State Highway Business 146 traverses through the City of La Porte; WHEREAS, a portion of State Highway Business 146 includes the City's Main Street district; WHEREAS, the City of La Porte desires to increase economic development within the City's Main Street district, including planned development within the existing State Highway Business 146 right-of-way; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City of La Porte requests that State Highway Business 146 (BF 146D) from the North right-of-way line of Fairmont Parkway Northward and Westward (Broadway and Main Street) be removed from the State Highway System effective upon written notification by the State. Also, the City requests that State Highway Business 146 (BF 146D) from the North right-of-way line of Fairmont Parkway to the North right-of- way line of Wharton Weems Boulevard be removed from the State Highway System no later than six (6) months after the state has overlayed and striped this segment based on a formal agreement between the City of La Porte and the Texas Department of Transportation. It is also understood that the State may re-designate the remaining portions of State Highway Business 146 and Spur 501. Section 2. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council is posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Chapter 551, Tx. Gov't Code; and that this meeting has been open to the public as required by law at all times during which this resolution and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 3. This Resolution shall be effective upon its passage and approval.
