defend all and singular the title to the Property against every person
whomsoever lawfully claiming or to claim the same or any part thereof by
through or under Grantor but not otherwise subject however to the matters
herein excepted
Grantor to the extent that Grantor owns or holds any interest thereon or
thereto excepts from the Property and reserves unto Grantor and Grantor s
successors and assigns all oil gas hydrocarbon su taflces ulfur iron ore
coal lignite uranium Hmestone bunding stone caliche gravel sand or other
minerals whether or not of like kind or character with the substances recited
herein upon in and under the Property including all mineral rights mineral
interest and royalties provided that Grantor expressly waives the right to
damage the surface the Property in connection with the driUing mining
exploring or extracting any of the foregoing
Anything herein to the contrary notwithstanding this conveyance is made
subject to all easements leases agreements or licenses which affect the
Property hereby conveyed and any matter which would be disclosed by title

include the reservations by Grantor of their tight to retain rentals and the rights
to terminate any leases or pipelines other than public utility pipelines that cross
over the property conveyed herein and continue on to appurtenant Grantor

construction of public drainage improvements shall not be a Grantor expense
AS A MATERIAL INDUCEMENT TO GRANTOR TO EXECUTE AND
DELIVER THIS DEED BY ACCEPTANCE OF THIS DEED GRANTEE
