WATER AND SANITARY SEWER EASEMENT

KNOW ALL MEN BY THESE PRESENTS
COUNTY OF HARRIS
That A&J LEASING, LLP, ("Grantor"), for and in consideration of Ten and
no/100 Dollars ($10.00) and other good and valuable consideration paid by the
CITY OF LA PORTE ("Grantee"), a Municipal Corporation, the receipt and 110
sufficiency of which is hereby acknowledged and confessed, have this day
GRANTED, BARGAINED, SOLD AND CONVEYED and by these presents do
GRANT, SELL AND CONVEY unto said GRANTEE, and to its successors and
assigns the perpetual right, privilege and easement, with appropriate rights of
ingress and reasonable working area for construction and maintenance, to enter
upon and construct, reconstruct, maintain, operate, inspect, replace, repair and
remove AN 8" POTABLE WATER LINE AND A PRIVATELY -MAINTAINED 2"
SANITARY SEWER FORCE MAIN together with all necessary appurtenances,
over, across, through and under that certain tract or parcel of land lying and
being situated in Harris County, Texas and being more particularly described on
Exhibits "A" & "B" attached hereto and made a part hereof for all purposes.
TO HAVE AND TO HOLD the above described easement, together with all and
singular the rights and appurtenances thereto in anywise belonging unto said
GRANTEE, and its successors or assigns, in accordance with the terms and
conditions hereinabove set forth. The GRANTOR does hereby bind itself, its
successors or assigns to WARRANT AND FOREVER DEFEND, all and singular
the said easement unto the GRANTEE, its successors or assigns, against every
person whomsoever lawfully claiming or to claim the same or any part thereof.

A METES & BOUNDS description of a certain 0.1654 acre tract of land situated in the Enoch
Brinson Survey, Abstract No. 5 in Harris County, Texas; being a portion of a called 3.8135 acre
tract of land conveyed to A & J Leasing L.L.P. by Special Warranty Deed recorded in Clerk's
File No. 20100329409 of the Harris County Official Public Records of Real Property; said
0.1654 acre tract being more particularly described as follows with all bearings being based on
the Texas Coordinate System, South Central Zone, NAD 83;
BEGINNING at a 5/8-inch iron rod (with cap stamped "H.C. Smith RPLS 1228") found being the
northwest corner of said called 3.8135 acre tract, also being in the east right-of-way line of Strang
Road (based on a variable width);
THENCE, North 86058'50" East, 724.06 feet to the northeast corner of said called 3.8135 acre
tract, also being in the westerly right-of-way of State Highway 146 (based on a variable width),
from which a concrete monument (disturbed) found bears South 81 ° West, 0.21 feet;
THENCE, South 31 °48'27" West, 12.18 feet to a point for corner, from which a concrete
monument (broken) found being the southeast corner of said called 3.8135 acre tract bears South
31 °48'27" West, 309.97 feet;
THENCE, South 86058'50" West, 716.78 feet to a point for corner, from which a 5/8-inch iron rod
(with cap stamped "H.C. Smith RPLS 1228") found being the southwest corner of said called
3.8135 acre tract bears South 04050" 1" East, 254.87 feet;
THENCE, North 0405011" West, 10.01 feet to the POINT OF BEGINNING, CONTAINING 0.1654
