RESOLUTION NO. 7i-Ol
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. In order to diminish the great threat to life
and property, represented by the unprotected grade crossing of
the Southern Pacific Railroad at Fairmont Parkway, and the lack
of mechanical gates on the grade crossing at Spencer Highway,
the City of La Porte hereby agrees and offers to pay the
Southern Pacific Company one-third (1/3) of the actual cost of
the hereinafter described improvements, but not to exceed Ten
Thousand Dollars ($10,000.00), which shall be payable by the
City to Southern Pacific Company in cash, upon completion of
said improvements, to-wit:
SPENCER HIGHWAY GRADE CROSSING: Add to the existing
automatic flashing system and overhead illumination,
mechanical gates.
FAIRMONT PARKWAY CROSSING: Construct on the northern
lane of Fairmont Parkway, which is now being used for
two-way traffic, overhead illumination; automatic
flashing signals, and gates.
The City of La Porte shall have no responsibility for the
cost of operation and maintenance of said facilities, and said
facilities shall be operated by the Southern Pacific Company,
its successors or assigns, for so long a period of time as
its railroad trains operate on such crossings.
PASSED AND APPROVED, this the 4th day of January, A.D. 1971.
