ORDINANCE N0. ~ ~ ~~Y AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF SECTION 8 OF ARTICLE 827a, VERNON'S TEXAS PENAL CODE, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION, UPON CERTAIN STREETS AND HIGHRAYS, OR PARTS THEREOF, RITHIN THE CORPORATE LIDITS OF THE CITY OF LA FORTE, TEXAS, AS SET OUT IN THIS ORDINANCE; AND PROV IDING THAT ANY .PERSON VIOLATING ANY OF THE PROVISIONS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION THEREOF SHALL BE FINED IN ANY SUM NOT MORE THAN TRO HUNDRED DOLLARS ($ 200.00). NHEREAS, Section 8 of Article 827a, Vernon`s Penal Code of the State • of Texas, provides that whenever the governing body of a city shall determine upon the basis of an engineering and traffic investigation that any prima facie speed therein set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or up- on any part of a street or highway within the city, taking into consideration the width and condition of the pavements and other circumstances on such portioi of said street or highway, as well as the usual traffic thereon, said governing body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway, now therefore, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA FORTE, TEXAS, THAT ; Section 1. Upon the basis of an engineering and traffic investigation heretofore made as authorized by the provisions of Section 8 of Article 827a, Vernon's Texas Penal Code, the fallowing prima facie speed limits hereafter in- dicated for vehicles are hereby determined and declared to be reasonable and saf and such speed limits are hereby fixed at the rate of speed indicated for vehi- cles traveling upon the named streets and highways, or parts thereof, described as followst (a) On North Tenth Street (State Highway No. 146) from the Northern corporate limits of the City of La Porte, at the T C N 0 Railroad Overpass to Tyler Street, forty- five (45) miles per hour; (b) On North Tenth Street (State Highway No. 146) from Tyler Street to Polk .Street, forty (40) miles per hour; ~~ (c) On North Tenth .Street (State Highway No. 146) from Polk Street to Rest Main Street, thirty (30) miles per hour; ~e; __ a i -2- (d) On West Main Street (State Highway No. 146) from Tenth Street to South Broadway (State Highway No. 146), thirty (30) miles per hour; (e) On South Broadway (State Highway No. 146) to H Street, thirty (30) miles per hour, except within the "School Zone" from C Street to G Street when marked with signs, twenty (20) miles per hour; (f) On South Broadway Street (State Highway No. 146) from H Street to K Street, forty (40) miles per hour; (g) On South Broadway Street (State Highway No. 146) from K Street to the bridge over Little Cedar Bayou, forty- five (45) miles per hour. Section 2. Any person violating any of the provisions of this ordi- nance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not more than Two .Hundred Dollars ($200.00). Section 3. This ordinance shall take effect and be in force from and after its passage and approval and publication as required by law.
