AN ORDINANCE ADOPTING AND MAKING APPLICABLE TO THE CITY OF LA PORTE THE PROVISIONS OF STATE LAW RELATING TO WORKMEN'S COMPENSATION INSURANCE FOR MUNICIPAL EMPLOYEES; PROVIDING THAT THE CITY OF LA PORTE SHALL BE SELF-INSURING; PROVIDING THAT SAID WORKMEN'S COMPENSATION INSURANCE SHALL BE APPLICABLE TO ALL EMPLOYEES OF THE CITY OF LA PORTE; PROVIDING FOR NOTICES OF SUCH ACTION TO BE GIVEN; ESTABLISHING THE CITY OF LA PORTE WORKMEN'S COMPENSATION ACCOUNT; AND PROVIDING FOR ~HE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: Section 1. The City Commission of the City of La Porte hereby adopts the provisions of Article 830ge-2, Vernon's . Revised Civil Statutes of Texas (Acts 1969, 6lst Legislature, Page 87, Chapter 22), and makes the same applicable to all of the employees of the City of La Porte. Section 2. The City of La Porte hereby elects to become a self-insurer under the provisions of said Article 830ge-2, Vernon's Revised Civil Statutes of Texas. Section 3. The City Clerk is hereby directed to give notice to the Texas Industrial Accident Board, stating the effective date of the self-insurance, which shall be the effective date of this Ordinance; advising the Industrial Accident Board that all employees of the City of La Porte shall be covered by such workmen's compensation benefits; and advisi~g the approximate number of employees to be ~ covered, and the estimated amount of the payroll or payrolls. Notice shall also be, given by the City Clerk to the employees of the City, that provision has been made by the adoption of this ordinance, for workmen's compensation benefits and the effective date thereof, which shall be the effective date of this ordinance; and all employees of the City of La Porte shall be conclusively deemed to have accepted the compensation . provisions in lieu of common-law or statutory liability or cause of action, if any, for injuries received in the course of employment or death resulting from injuries so received. Section 4. The Director of Finance is hereby authorized to establish at one of the City's depositories, an account to (. Ordinance No. 844, P~ge 2. . be known as the "City of La Porte Workmen's Compensation '. Account." The City is hereby authorized to set aside from available appropriations, other than itemized salary appro- priations, in an amount not to exceed five per cent (5%) of the annual employee payroll of the City, for the payment of all costs, administrative expenses, charges, benefits, and awards authorized by the said Article 830ge-2, Vernon's Revised Civil Statutes of Texas. Such account shall show the disbursements authorized by the said Article 830ge-2; provided the amount so set aside shall not exceed five per cent (5%) of the annual employee payroll at anyone time. A statement of the amount set aside for the disbursements :. from the account shall be included in an annual report made to the City treasurer (Director of Finance), and the City Commission of the City of La Porte. Section 5. This Ordinance shall take effect and be in force from and after midnight, December 31, 1969. 18th day of December, PASSED AND APPROVED, this the A.D. 1969.
