AN ORDINANCE AMENDING CHAPTER TWELVE OF THE CODE OF ORDINANCES
OF THE CITY OF LA PORTE, BY ADDING AN ARTICLE V, REGULATING
THROUGH GARBAGE TRUCKS~ PROVIDING THAT ANY PERSON VIOLATING
THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MIS-
DEMEANOR AND SHALL UPON CONVICTION BE FINED NOT TO EXCEED TWO
HUNDRED DOLLARS ($200.00) ~ AND PROVIDING AN EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. That the Code of Ordinances, City of La Porte,
Texas, is hereby amended by adding to Chapter 12 thereof,
Article V, "Through Garbage and Trash Trucks," with sections
to be numbered Section 12 - 70, et. seq., which said sections
shall read as follows:
"Article V. Through Ga:+bage and Trash Trucks
"Sec. 12-70. Vehicles to be covered.
"It shall be unlawful for any person to operate
on the streets of the City of La Porte, a vehicle
carrying garb~ge or trash, without providi~g an
adequate cover for the garbage and trash, which shall
be kept in place except when loading and unloading.
"Sec. 12-71. Routes for Through Garbage Trucks.
"All vehicles carrying garbage or trash from
outside the corporate limits of the City, for unloading
at the sanitary landfill operated by Harris County, or _
through the city, shall travel only on the following
designated ~Truck Routes for Through Garbage Trucks,'
both before and after unloadi~g:
(1) South Broadway Street (Old State Highway 146),
from the South city limits to South Avenue J;
(2) South Avenue J, from South Broadway Street to
New State H~ghway l46~
(3) New State Highway 146, from the South city
limits, to the North city limits;
(4) Crestlane, from New State H~ghway 146, to
North Broadway Street~

(5) North Broadway Street, from East Main Street
North to the sanitary landfill~
(6) Spencer Highway, from the West city limits
to New State Highway l46~
(7) East Main Street, from North Broadway Street
to the:East city limits."
Section 2. Saving,' Clause.
If any provision, exception, section, subsection, para-
graph, sentence, clause or phrase of this ordinance or the
application of same to any person or set of circumstances,
shall for any reason be held unconstitutional, void or invalid,
such invalidity shall not affect the validity of the remaining
provisions of this ordinance or their application to other
persons or sets of circumstances and to this end, all provisions
of this ordinance are declared to be severable.
Section 3. Penalty.
Any person, firm, corporation, association, partnership,
trustee, or any agent, servant or employee thereof who shall
violate any provision of this ordinance, or any agent, servant,
officer or employee of any corporation who shall direct any
activities which shall result in a violation of any provision
of this ordinance shall be guilty of a misdemeanor and upon
conviction shall be fined in an amount not to exceed Two
Hundred Dollars ($200.00). Each day of any such violation
shall be deemed a separate offense.
Section 4. This ordinance shall take effect and be in
force from and after its passage, approval and publication as
required by law.
