<br />e. <br /> <br />a <br />.'~.. <br /> <br />.,. <br /> <br />e-- <br /> <br />. <br /> <br />. <br /> <br />ORDINANCE NO. <br /> <br />866 <br /> <br />AN ORDINANCE PROHIBITING PARKING VEHICLES ON THE FRONTAGE <br />ROADS OF NEW STATE HIGHWAY #146, BETWEEN SPENCER HIGHWAY <br />(MAIN STREET) AND SOUTH AVENUE "J" (FAIRMONT PARKWAY)~ PROVIDING <br />FOR EFFECT OF PROOF OF OWNERSHIP OF VEHICLE~ PROVIDING THAT ANY <br />PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED <br />GUILTY OF A MISDEMEANOR, AND UPON CONVICTION SHALL BE FINED ANY <br />SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00); AND PROVIDING <br />FOR AN EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: <br /> <br />Section l. It shall be unlawful for any person to cause, <br /> <br />allow, permit or suffer any vehicle registered in his name or <br /> <br />owned or operated by him or in his possession or under his <br /> <br />control to be or remain parked or standing on the frontage <br /> <br />roads of New State Highway #146, between the South right-of-way <br />line of Spencer Highway (Main Street) and the North right-of-way <br /> <br />line of South Avenue "J" (Fairmont Parkway) . <br /> <br />Section 2. It shall be unlawful for any person, having <br /> <br />registered in his name or owning or operating or having in <br /> <br />charge any vehicle, to knowingly allow or suffer or permit the <br /> <br />same to stop, stand, or be parked on the aforesaid front~ge <br /> <br />roads, in violation of the terms of this Ordinance. <br /> <br />Section 3. When any person is charged with having parked <br />or left standing a vehicle on th~ aforesaid frontage roads in <br /> <br />violation of this Ordinance, proof that such vehicle was, at <br /> <br />the date of the offense alleged, owned by the person charged <br /> <br />with the offense, shall constitute prima facie evidence that <br /> <br />such vehicle was parked or left standing, at the place charged, <br /> <br />by the owner, but the owner shall have the right to introduce <br /> <br />evidence to show that such vehicle was not parked by him as <br /> <br />charged in the complaint. <br />Section 4. Any person violating any of the provisions of <br />this Ordinance shall be deemed guilty of a misdemeanor, and <br /> <br />upon conviction shall be fined in any sum not more than Two <br /> <br />Hundred Dollars ($200.00). <br /> <br />Section 5. This Ordinance shall take effect and be in <br /> <br />force from and after its passage and approval and publication <br />
