ORDINANCE NO. 867 .....~ , - AN ORDINANCE ANNEXING ON FIRST READING THE HEREINAFTER DESCRIBED TERRITORY TO THE CITY OF LA PORTE, AND EXTENDING THE BOUNDARY LIMITS OF THE SAID CITY OF, LA PORTE, TEXAS~ PROVIDING A SAVINGS CLAUSE~ ,ANO PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: Section 1. The City of La Porte has heretofore adopted a Home Rule Charter granting the Commission the power by ordi- nance to fix the boundary limits of the City of La Porte and to provide for the extension of said boundary limits, and the annexation of additional territory lying adjacent to the City, pursuant to and in accordance with the present or hereinafter .- adopted or amended general and special laws of this State applicable to Home Rule cities. This annexation proceeding is conducted pursuant to the authority granted by Article 1175, Revised Civil Statutes, and Article 970a, Revised Civil Statutes. Section 2. The City Commission of the City of La Porte hereby finds, determines and declares that the hereinafter described territory is adjacent and contiguous to the present City Limits of the City of La Porte, and lies within the exclusive extraterritorial jurisdiction of the City of La Porte, and that the annexation of said territory to the City of e La Porte will promote the general health, safety and welfare of persons residing within the City and within the hereinafter described territory. Section 3. The City Commission of the City of La Porte heretofore, on September 14, 1970, passed and approved Ordinance No. 864, declaring its intention to institute proceedings to annex the hereinafter described territory. A public hearing was called, and was held on September 28, 1970, . at which public hearing all interested parties were given an opportunity to be heard. Notice of such public hearing was given by publication of Ordinance No. 864 in the La Porte- Bayshore Sun on September 17, 1970, said newspaper being the e . 867 , Page 2. Ordinance No. .' official newspaper of the City of La Porte, and having general circulation in the City of La Porte and in the territory pro- posed to be annexed. Such notice and such hearing were in conformity with the Municipal Annexation Act of 1963, Article 970a, Vernonia Annotated Texas Statutes. Section 4. The City Commission of the Cityof La Porte hereby institutes annexation proceedings as to the following described territory, and the same is hereby declared annexed to the City of La Porte, Texas, and the boundary limits of the City of La Porte, Texas, be, and the same are hereby extended to include the following described territory within . the City Limits of the City of La Porte, and the same shall hereafter be included within the territorial limits of the City of La Porte, and the inhabitants .thereof shall hereafter be entitled to all rights and privileges of other citizens of the City of La Porte, and they shall be bound by the acts, ordinances, resolutions and regulations of the City of La Porte. The territory to be so annexed is the same territory as described in said Ordinance No. 864, and is more particularly described as follows, to-wit: e All those tracts or parcels of land out of the W. P. Harris Survey, A-30, out of Harris County, Texas, and being more particularly described as follows: COMMENCING at a point of intersection of the North bank of Little Cedar Creek with the shoreline of Galveston Bay~ THENCE southwesterly, southerlY.i. and southeasterly following the meanders of the shoreline of Galveston Bay to a point at the intersection of the North line of the Pine Bluff Addition'with the westerly shoreline of Galveston Bay for a POINT OF BEGINNING~ THENCE westerly along the North line of the Pine Bluff Addition and the South line of the Crescent View Addition to a point in the East right-of-way of State Highway 146 (also known as South Broadway)~ . THENCE northerly along the East right-of-way of State Highway 146 to a point, said point being the intersection of the East right-of-way of State Highway 146 with an eastward projection of the North right-of-way of McCabe Road; e e Ordinance No. 867 , Page 3. . THENCE westerly with the eastward projection of the North right-of-way line of McCabe Road to a point in the West right-of-way of State Highway 146 (also known as South Broadway), said point being the inter- section of the North right-of-way line of McCabe Road with the West right-of-way line of State Highway 146; THENCE continuing along the North right-of-way line of McCabe Road and its westward projection to a point in the East right-of-way line of the G.H.&S.A. Rail- road (also known as T.&N.O. Railroad); - THENCE southeasterly along the East right-of-way line of the G.H.&S.A. Railroad to the northwest corner of that portion of Shoreacres Subdivision lying West of State Highway 146 according to the map or plat of said'Shoreacres Subdivision recorded in Volume 7, Page 10, of the Map Records of Harris County, Texas, said point also being the southwest corner of Tract 1, of the Bayshore Municipal Utility District as described in Vernon's Texas Civil Statutes, Art. 8280-268~ e THENCE easterly along the north boundary line of that portion of Shoareacres Subdivision lying West of the aforementioned State Highway 146 and the South boundary line of Tract 1 of the Bayshore Municipal Utility District to a point in the West right-of-way line of said State Highway 146; THENCE southerly along the West right-of-way line of said State Highway 146 to a point said point being the intersection of the westward projection of the North line of that portion of Shoreacres Subdivision lying East of State Highway 146 (also known as South Broadway) with the West right-of-way of said State Highway 146; THENCE easterly along the North boundary of that portion of Shoreacres Subdivision lying East of said State Highway 146 and its westward projection to a point on the shoreline of Galveston Bay~ THENCE in a northwesterly, northerly, and northeasterly direction along the meanders of the shoreline of Galveston Bay to the PLACE OF BEGINNING, said parcel containing 396 acres, more or less, a plat of said Territory being attached to this Ordinance as "Exhibit A," incorporated by reference herein, and made a part hereof for all purposes. Section 5. Should any section or part of this ordinance be held unconstitutional, illegal or invalid, or the applica- tion thereof ineffective or inapplicable as to any territory, such unconstitutionality, illegality, invalidity or ineffec- tiveness of such section or part shall in nowise affect, impair or invalidate the remaining portion or portions thereof, but ~ as to such remaining portion or portions the same shall be and remain in full force and effect; and should this ordinance , . .. Ordinance No. 867 , Page 4. . for any reason be ineffective as to any part of the area hereby annexed to the City of La Porte, such ineffectiveness of this ordinance as to any such part or parts of any such area shall not affect the effectiveness of this ordinance as to all of the remainder of such area, and the City Commission hereby declares it to be its purpose to annex to the City of La Porte every part of the area described in Section 4 of this ordinance, regardless of whether any other part of such described area is hereby effectively annexed to the City. Provided, further, that if there is included within the general description of territory set out in Section 4 of this ordinance to be hereby e annexed to the.'City of La Porte any lands or area which are presently part of and included within the limits of the City of La Porte, or which are presently part of and included within the limits of any other City, Town, or Village, or which are not within the City of La Porte's jurisdiction to annex, the same is hereby excluded and excepted from the territory to be hereby annexed as fully as if such excluded and excepted area were expressly described herein. Section 6. This ordinance shall not repeal, impair, modify, or in anywise affect any other annexation ordinance or ordinances of the City of La Porte, but such other ordi- e.. nance or ordinances shall remain and continue to be effective, wholly unaffected in any way or manner by the passage of this ordinance. Section 7. This Ordinance shall take effect and be in force from and after its passage and approval.
