ORDINANCE NO. 875 AN ORDINANCE DEFINING "MODEL GLUE;" PROHIBITING THE INHALATION OF "MODEL GLUE;" PROHIBIT.J:NG SALE OR TRANSFER OF "MODEL GLUE" FOR UNLAWFUL PURPOSES; REGULATING THE USE OF "MODEL GLUE" BY MINORS; REQUIRING A RECORD OF SALES OF "MODEL GLUE" TO MINORS; PROVIDING THAT ANY PERSON VIOLATING THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN AN AMOUNT NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00), AND THAT EACH DAY OF ANY SUCH VIOLATION SHALL BE DEEMED A SEPARATE OFFENSE; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: Section I. Model glue--Definition. As used in this Ordinance the te:r:m "model glue" shall mean any glue or cement of the type commonly used in the building of model airplanes, boats, and automobiles, containing toluene, acetone, or other solvent or chemical having the property of releasing toxic vapors. Section 2. Same--Inhalation of fumes prohibited. No person shall, for the purpose of causing a condition of intoxication, euphoria, excitement, exhilaration, stupe- faction, or dulling of the senses or nervous system, intention- ally smell or inhale the fumes from any model glue; provided, however, that this section shall not apply to the inhalation of any medicine for medical or dental purposes, if such inhalation is caused by or administered by any licensed doctor, physician, dentist, anesthesiologist, or other licensed person engaging in the medical or dental profession. Section 3. Same--Possession or transfer for unlawful purposes prohibited. No person shall for the purpose of violating or aiding another to violate any provision of this Ordinance, intention- ally possess, buy, sell, transfer possession, or receive possession of any model glue. Section 4. Same--Use by minors regulated. (a) Except as provided in subsections (c) and (d) hereof and Section 5, no person under twenty-one (21) years of age shall possess or buy any model glue. .(' e--- - e-~..' A." ~_ e . . (b) Except as provided in subsections (c) and (d) hereof and Section 5, no person shall sell or transfer possession of any model glue to another person under twenty-one (21) years of age. (c) Provided, however, a person may sell or transfer possession of model glue to a person under twenty-one (21) years of age for model building or other lawful use where said minor has in his possession and exhibits the written consent of his parent or legal guardian. (d) Provided, however, a person may sell or transfer possession of model glue to a person under twenty-one (21) years of age when sold, delivered or given simultaneously with and as a part of a kit used for the construction of model airplanes, model boats, model automobiles, model trains or other similar models. The word "kit" for the purposes of this subsection shall mean a single box, package, or other container in which the necessary elements for a: ',mode 1 and appropriate cohesive agent, or glue, are included, said cohesive agent,. or glue, being included~at no increase in price or cost. Section 5. Same--Record of sales required. A person making a sale or transfer of possession of model glue to a person under twenty-one (21) years of age who exhibits the written consent of his parent or guardian, shall record the name, address, sex, and age of the minor and the name and address of the consenting parent or legal guardian. All data required by this section shall be kept in a permanent type register available for inspection by the chief of police or his duly appointed representative for a period of at least six (6) months after the date of this sale. Section 6. Penalty. Any person, firm, corporation, association, partnership, ... ."- e-" 0 .~. . . Ordinance No. 875 , Page 3. trustee, or any agent, servant, or employee thereof who shall violate any provision of this Ordinance, or any agent, servant, officer, or employee of any corporation who shall direct any activities which shall result in a violation of any provision of this Ordinance, shall be guilty of a misdemeanor and upon conviction shall be fined in an amount not to exceed Two Hundred Dollars ($200.00). Each day of any such violation shall be deemed a separate offense. Section 7. Effective date. This Ordinance shall be effective from and after its passage, approval, and publication, as required by law. PASSED AND APPROVED, this the 15th day of Mar eh A.D. 1971.
