HomeMy WebLinkAboutO-1971-880 . . .=" -' ;, ORD INANCE NO. 880 AN ORDINANCE AUTHORIZING THE MAYOR TO CONVEY AN EASEMENT OUT OF AN ALLEYWAY LOCATED IN BLOCK TWENTY-TWO (22) OF BAYFRONT ADDITION TO THE CITY OF LA PORTE, TEXAS. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE, TEXAS: 1. WHEREAS, George L. Johnson and wife, Patsy Johnson, are the owners of Lots 1 and 2, Block 22, of BAYFRONT ADDITION in La Porte, Harris County, Texas, upon which there is situated and has been situated for a number of years, a 2-story residential dwelling with garage and porch, which encroaches on the alleyway located in said Block 22, a distance of some five or more feet. ... 2. WHEREAS, it appears to the said City Commission that said alleyway is not in fact presently utilized, and that the said home owners! rights should be stablished by granting them an easement on said alleyway to the extent of their encroachment, plus a reasonable use area. 3. THEREFORE, the Mayor of the City of La Porte is hereby authorized and directed to grant and convey unto the said George L. Johnson and wife, Patsy Johnson, their heirs and assigns, a perpetual easement in said alleyway, described as follows, to-wit: ..- .... '. . COMMENCING at the northwest corner of Lot 1, Block 22, BAY FRONT ADDITION, La Porte, Harris County, Texas, THENCE, N.37045'E. along the north line of said Lot 1, Block 22, BAYFRONT ADDITION,: a distance of 11. 70 feet to the PLACE OF BEGINNING; THENCE, N.52015'W., perpendicular to the north line of said Lot 1, Block 22, a distance of 7.00 feet to a point for corner; THENCE, N.37045'E., parallel to and 7.00' north of the north line of Lot 1 and Lot 2 of Block 22, BAYFRONT ADDITION, a distance of 34.50 feet to a point for corner; THENCE, S.52!15'E., perpendicular to the north line of Lot 2, Block 22, a distance of 7.00 feet to the north line of said Lot 2, Block 22; THENCE, S.37045'W., along the north line of said Lot 2, and Lot 1, Block 22, BAY FRONT ADDITION, La Porte, Harris County, Texas, a distance of 34.50 feet to the PLACE OF BEGINNING, with the provision that said easement shall cease and revert to the City of La Porte in the event the improve- ments presently situated on the said property be removed or destroyed. Gould Crofoot when, among other business, the following was transacted, to-wit: '\ 'e. The Mayor introduced an ordinance which was read in full. Commissioner Thomas moved that the ordinance be adopted as read. Cormnissioner Kibodeaux seconded the motion for adoption of said ordinance. The motion, carrying with it the adoption of the ordinance, prevailed by the following vote: AYES: 3 NOES: 0 The Mayor thereupon .announced that the motion had duly and lawfully carried and that the ordinance had been duly and lawfully a~opted.
