AN ORDINANCE AMENDING CHAPTER 12, "GARBAGE AND TRASH", " OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE; CONTAINING A SAVINGS CLAUSE AND A REPEALING CLAUSE; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE ~HAN TWO HUNDRED DOLLARS ($200.00) AND EACH DAY OF VIOLATION SHALL BE DEEMED A SEPARATE OFFENSE; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT .ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: Section 1. Paragraph 5 of Section 12-1 of the Code of Ordinances of the City of La Porte is hereby amended, to hereafter read as follows, to-wit: . "Trash. The term 'trash' shall mean rubbish, such as feathers, coffee grounds, ashes, paper, tin cans, rags, glass, broken dishes, boxes, old clothes and shoes; also grass trimmings, shrubs, yard cleanings, tree leaves, hedge trimmings, and tree limbs not to exceed six (6) lnches in diameter and cut in lengths not exceeding s~x (6) feet, and any other matter commonly understood to be trash." Section 2. Sub-paragraph (b) of Section 12-3 of the Code of Ordinances of the City of La Porte is hereby amended, to '. hereafter read as follows, to-wit: "(b) Holders for disposable refuse bags to be used by any person for garbage and trash disposal within the city, may be obtained from the city upon a cash deposit of two dollars and fifty cents ($2.50), refund- able upon the return of such holders in good condition, normal wear and tear excepted. In addition, the city will make available, at the city hall, approved dis- posable refuse bags, at a cost of fifteen cents ($0.15) each, which may"be purchased in minimum quantities of ten (10). Only such disposable refuse bags as are manufactured for use as garbage containers shall be approved by the ci ty . " . Section 3. Section 12-6 of the Code of Ordinances of the City of La Porte is hereby amended, to hereafter read as follows, to-wi,t: "Sec. 12-6. Collection of trash. .'. "The City Sanitation Department will pick up trash from customers on the west side of Broadway Street, on the 1st and 3rd Wednesdays of each month, and from customers on the east side of Broadway Street, on the 2nd and 4th Wednesdays of each month. Up to one cubic yard of trash will be picked up on each trash collection day without additional charge. A charge of One Dollar ($1.00) per cubic yard or fraction thereof, will be made for all trash picked up on each collection date from anyone customer, in excess of one cubic yard. Customers desiring the removal of tree limbs in excess of six ~ in diameter, or in excess of six feet in length, shall contact the City Sanitation . Ordinance No. 884 . , Page 2. . .. Department, which will have a supervisor contact the customer, examine the trash to be removed, and advise the customer of the cost for removing same. The cost shall be based on the City's actual cost of removal. The customer will be requested to sign an authorization to the City to remove the trash, which authorization shall state the cost to be billed to the customer. Household refrigerators will be collected for a charge of One Dollar ($1.00) per unit. Washers, dryers, water heaters and couches will be removed for a charge of Fifty.Cents ($0.50) per unit. Automobiles will be removed by the City at the request of the owner_, for a charge of Thirty-five Dollars ($35.00), which shall be payable in advance." Section 3. Section 12-7 of the Code of Ordinances of the City of La Porte is hereby amended, to hereafter read: as follows, to-wit: . "Cans, sacks or containers of garbage and trash and rubbish and tree limbs shall be placed at the curb- side of the street, in front of.the property, so as to be readily accessible to the city garbage vehicles. Where there is no curb, the city will designate the location. II Section 4. Section 12-9 of the Code of Ordinances of the City of La Porte is hereby amended, to hereafter read as follows, to-wit: "Sec. 12-9. Collection of construction debris. . "The City Sanitation Department will collect and dispose of construction debris. Customers desiring the removal of construction debris shall contact the City Sanitation Department, which will have a super- visor contact the customer, examine the debris to be removed, and adV:ise, the customer,' of the cost for removing same. '~he cost shall be based on the City's actual cost of removal. The customer' will be requested to sign an authorization to the City to remove the debris, which authorization shall state the cost to be billed to the customer~ Charges for collection of construction debris shall be payable in advance at the time of authorization." Section 5. Section 12-4l, sub-paragraph (a), of the Code of Ordinances of the City of La Porte is hereby amended, to hereafter read as follows, to-wit: - .. "(a) There shall be charged, assessed and collected, for garbage, trash and rubbish collection by the city. from residential dwelling units, which term shall be construed to include individual duplex units, indivi- dual apartment units, and individual trailer units at trailer courts, the sum of Two Dollars and Fifty Cents ($2.50) per unit per month. II Section 6. Section 12-42, sub-paragraphs (a) and (b), of the Code of Ordinances of the City of La Porte are hereby --- '," .: . . . . Ordinance No. 884 .. , Page 3. amended, to hereafter read as fo~lows, to-wit: "(a) The minimum charge for business and commercial establishments in the city where garbage and trash is picked up twice a week shall be Four Dollars ($4.00) per month, except where the proper operation of a commercial or business establishment requires daily (Saturdays and Sundays excepted) pickup, in which case, the minimum charge for such establishment shall be Nine Dollars ($9.00) per month. "(b) Subject to the foregoing minimum charges for business and commercial establishments, the following formula shall be used to determine the monthly charge for each user of a sanitation container furnished by the city at a business or commercial establishment: "Number of cubic yards furnished x $1.00 per cubic yard x number of pickups per week x 52 weeks = Monthly charge" 12 months Section 7. The invalidity of any section or provision of this ordiannce or of the changes hereby adopted shall not invalidate other sections or provisions thereof. Section 8. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 9. Any person, firm, corporation, association, partnership, trustee, or any agent, servant or employee thereof who shall violate any provision of this article, or any agent, servant, officer or employee of any corporation who shall direct any activities which shall result in .a violation of any provision of this article shall be guilty of a misdemeanor and upon conviction shall be fined in an amount not to exceed Two Hundred Dollars ($200.00). Each day of any such violation shall be deemed a separate offense. Section 10. This Ordinance shall be effective immediately upon its passage, approval, and publication.
